Education (Assessment Arrangements for Key Stages 1 and 2) (Exceptions) Regulations (Northern Ireland) 1996

The Department of Education, in exercise of the powers conferred on it by Article 15(b) of the Education Reform (Northern Ireland) Order 1989(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (Assessment Arrangements for Key Stages 1 and 2) (Exceptions) Regulations (Northern Ireland) 1996 and shall come into operation on 1st January 1997.

(2) In these Regulations, “school year” means a year beginning on 1st August and ending on 31st July, both dates inclusive.

Exceptions to assessment requirements

2.  Article 6(3) of the Education Reform (Northern Ireland) Order 1989 shall not apply to an Irish speaking school which provides only primary education—

(a)in the school year commencing with the date from which the school becomes grant-aided; or

(b)where a school becomes grant-aided from a date other than the beginning of a school year, for the remainder of that school year.

Explanatory Note

(This note is not part of the Regulations.)
These Regulations, made under Article 15(b) of the Education Reform (Northern Ireland) Order 1989, provide that an Irish speaking primary school shall be excepted from the requirement to assess pupils at the end of Key Stages 1 and 2 in the school year commencing with the date on which the school becomes a grant-aided school. Where such a school becomes a grant-aided school from a date other than the beginning of a school year, it shall be excepted for the remainder of that school year.
