The Secretary of State for Health, in exercise of powers conferred on him by section 126(3) of the National Health Service Act 1977(1) and section 5(1) of the National Health Service and Community Care Act 1990(2) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Hull and Holderness Community Health National Health Service Trust (Establishment) Amendment Order 1996, and shall come into force on 6th April 1996.

Amendment of Establishment Order

2.  In Article 3 of the Hull and Holderness Community Health National Health Service Trust (Establishment) Order 1993(3) (functions of the trust)—

(a)in paragraph (1) for “section 5(1)(a)” there shall be substituted “section 5(1)(b)”; and

(b)in paragraph (2) for “to own” there shall be substituted “to provide”.

Explanatory Note

(This note is not part of the Order)
This Order amends the Order which established the Hull and Holderness Community Health National Health Service Trust to alter the purpose for which the trust has been established and to amend its functions. (The trust has, in exercise of its existing functions, assumed responsibility for the management of community health services provided from Victoria House, Hull, previously managed by the East Riding Health Authority, and for the ownership of the associated premises.)
This Order confers on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990—to provide and manage hospitals or other establishments or facilities—and amends the trust’s functions so that it is no longer required to own the premises from which it is to provide community health services.
