The North Eastern Sea Fisheries District (Constitution of Committee and Expenses) (Variation) Order 1996

The Minister of Agriculture, Fisheries and Food, on the application of the local fisheries committee for the North Eastern Sea Fisheries District and after consultation with every council concerned, in exercise of the powers conferred on him by section 1 of the Sea Fisheries Regulation Act 1966(1) and of all other powers enabling him in that behalf, hereby makes the following Order, a draft of which has lain before Parliament for forty days prior to its being made:

Title and commencement

1.  This Order may be cited as the North Eastern Sea Fisheries District (Constitution of Committee and Expenses) (Variation) Order 1996 and shall come into force on 1st April 1996.

Variation of principal Order

2.—(1) The North Eastern Sea Fisheries District Order 1986(2) shall be varied in accordance with the following paragraphs of this article.

(2) In paragraph 3 of article 3 (local fisheries committee) for the sentence beginning “After that date” there shall be substituted the following sentence—

“After that date the members shall come into office on the day specified for that purpose in the instrument appointing them and shall hold office—

(i)
in respect of those members appointed by the constituent councils, until the end of the twelve month period in which that day falls; and

(ii)
in respect of all other members, until the end of the quadrennial period in which that day falls.”.

(3) For Schedule 1 there shall be substituted the new Schedule 1 set out in the Schedule to this Order.

Hartlepool District Council and Redcar and Cleveland District Council shall appoint one member between them,, the power to appoint alternating between the Councils annually. The first appointment made after this Order comes into force will be made by Redcar and Cleveland District Council. The Councils shall each contribute 1/36 of the Committee’s expenses per annum.”

Explanatory Note

(This note is not part of the Order)
This Order varies those provisions of the North Eastern Sea Fisheries District Order 1986 which relate to the constitution of the Committee and the expenses payable by the constituent authorities, in consequence of the changes to the local Government areas contained in the Cleveland (Structural Change) Order 1995 (S.I. 1995 No. 187) and the Humberside (Structural Change) Order 1995 (S.I. 1995 No. 600).
Cleveland County Council and Humberside County Council cease to be constituent authorities of the Committee, while East Riding of Yorkshire Council, Hartlepool District Council, Kingston Upon Hull City Council, North East Lincolnshire District Council, North Lincolnshire District Council and Redcar and Cleveland District Council, all become constituent Councils (article 2(5) and the Schedule).
The reference in the 1986 Order to South Tyneside Borough Council is corrected to South Tyneside Metropolitan Borough Council and the reference to Sunderland Borough Council is varied to reflect the grant to Sunderland of city status.
Consequential adjustments are made to the liability of constituent Councils to contribute to the Committee’s expenses (article 2(5) and the Schedule).
