In exercise of the powers conferred on the Secretary of State by sections 22 and 232(5) of the Education Reform Act 1988(1), and after consulting with those persons with whom consultation appeared to her to be desirable, the Secretary of State hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (Individual Pupils' Achievements) (Information) (Amendment) Regulations 1996 and shall come into force on 21st May 1996.

(2) Any reference in these Regulations to the principal Regulations is a reference to the Education (Individual Pupils' Achievements) (Information) Regulations 1993(2).

Amendment of the principal Regulations

2.  Regulation 4 of the principal Regulations (head teacher’s report to parents and adult pupils) shall be amended by the insertion after paragraph (4A)(3) of the following paragraph—

“(4AA) In the case of the pupils registered at the school in the final year of the second key stage there shall be included in the report the information specified in paragraph 2 of Schedule 2A relating to the educational achievements of all pupils at schools in England who were in the final year of that key stage in the preceding school year and whose achievements were assessed or examined, as the case may be, in that preceding school year.”.

3.—(1) Regulation 6 of the principal Regulations (school leaver’s report) shall be amended as follows.

(2) In paragraph (2)—

(a)sub-paragraph (c) shall be omitted; and

(b)in sub-paragraph (d) there shall be omitted the word “other” and there shall be inserted after “curriculum” the words “(other than those in relation to any public examination or vocational qualification)”.

(3) In paragraph (3) there shall be substituted for “ “School Achievements” ” the words “ “Achievements in Education” ” and there shall be omitted the words from “and the information” to the end of the paragraph.

(4) In paragraph (4) there shall be substituted for the words from “, and that part of the form” to the end of the paragraph, the words “and by a teacher who is familiar with the pupil and his achievements”.

4.  In paragraph 1(3) of Schedule 1 to the principal Regulations (information about individual pupils) there shall be substituted for “, “Writing” , “Spelling” and “Handwriting” ” the words “and “Writing” ” and for “such attainment targets” there shall be substituted the words “the attainment targets of “Reading” and “Writing””.

5.  There shall be substituted for paragraph 1(2) of Schedule 2 to the principal Regulations (information about pupils at the school) the following sub-paragraph—

“(2) The percentages of registered pupils in the final year of the first key stage at each level in—

(a)each of the attainment targets in English entitled “Reading” and “Writing” shown as determined by teacher assessment and by NC tests;

(b)mathematics shown as determined by teacher assessment and by NC tests;

(c)the attainment target in English entitled “Speaking and Listening” shown as determined by teacher assessment; and

(d)science shown as determined by teacher assessment.”.

6.—(1) Schedule 2A to the principal Regulations (information about pupils at schools in England)(4) shall be amended as follows.

(2) For paragraph 1(2) there shall be substituted the following sub-paragraph—

“(2) The percentages of such pupils who achieved each level of attainment in—

(a)each of the attainment targets in English entitled “Reading” , “Writing” , “Spelling” and “Handwriting” shown as determined by teacher assessment and by NC tests;

(b)mathematics shown as determined by teacher assessment and by NC tests;

(c)the attainment target in English entitled “Speaking and Listening” shown as determined by teacher assessment; and

(d)science shown as determined by teacher assessment.”.

(3) In the heading before paragraph 2 there shall be inserted before “THIRD” the words “SECOND OR” .

(4) In paragraph 2(1) there shall be substituted for “third key stage” the words “second or third key stage, as the case may be,” .

7.  For Schedule 3 there shall be substituted the Schedule set out in Schedule 1 to these Regulations.

Minor amendments to the principal Regulations

8.  The principal Regulations shall be amended in accordance with Schedule 2 to these Regulations.

Regulation 8
SCHEDULE 2

1.  In the definition of “attendance record” in regulation 3(1) (interpretation) and in paragraph 4(4) of Schedule 1 (information about individual pupils) there shall be substituted for the reference to “the Pupils' Registration Regulations 1956” a reference to “the Education (Pupil Registration) Regulations 1995”(5).

2.  In regulation 3(1)—

(a)for the definition of “the 1993 (Key Stage 1) Order” there shall be substituted the following definition “ “the 1995 (Key Stage 1) Order” means the Education (National Curriculum) (Assessment Arrangements for the Core Subjects) (Key Stage 1) (England) Order 1995;”(6);

(b)for the definition of “the 1994 (Key Stage 2) Order” there shall be substituted the following definition “ “the 1995 (Key Stage 2) Order” means the Education (National Curriculum) (Assessment Arrangements for the Core Subjects) (Key Stage 2) (England) Order 1995;”(7); and

(c)for the definition of “the 1995 (Key Stage 3) Order” there shall be substituted the following definition “ “the 1995 (Key Stage 3) Order” means the Education (National Curriculum) (Assessment Arrangements for the Core Subjects) (Key Stage 3) (England) Order 1995;”.(8).

3.  In regulation 3(2) there shall be substituted for the reference to “section 7 of the Education Act 1981” a reference to “section 168 of the Education Act 1993” .

4.  In paragraph 5(3) of Schedule 1 there shall be substituted for the words “in accordance” to the end of the paragraph the words set out below:

“on the following basis:

GCE ‘A’ level: grade A=10 points;

grade B=8 points; grade C=6 points;

grade D=4 points; and grade E=2 points.

GCE ‘AS’: grade A=5 points;

grade B=4 points; grade C=3 points;

grade D=2 points; and grade E=1 point.”.

5.  For references wherever they appear to the articles and orders referred to in column (1) of the table below there shall be substituted a reference to the article or order set out opposite thereto in column (2).

Explanatory Note

(This note is not part of the Regulations)
These Regulations amend the Education (Individual Pupil’s Achievements) (Information) Regulations 1993 (“the principal Regulations”) which apply in relation to pupils and former pupils at maintained schools in England.
The main amendment is to regulation 4 of the principal Regulations, which concerns the head teacher’s report (“the report”) to parents and adult pupils. The report is now additionally to include information about the educational achievements of all pupils at schools in England who were in the final year of the second key stage in the preceding school year (regulations 2 and 6).
Changes are made regarding the report relating to pupils in the final year of key stage one required by the principal Regulations in respect of the information concerning science and the attainment targets in English (regulations 4, 5 and 6).
The head teacher’s report on a school leaver, which is made available to him by the head teacher under regulation 6 of the principal Regulations, is no longer required to contain information relating to results of any public examination and vocational qualifications (regulations 3 and 7). It is though still required to include information as to the pupil’s progress and achievements in subjects and activities forming part of the school curriculum for the school year in which the pupil leaves the school.
Schedule 2 contains a number of minor amendments updating references in the principal Regulations.
