(AMENDMENT) REGULATIONS 2012
RETIREMENT FUND ACT 1998
IN EXERCISE of the powers conferred by section 12 of the Retirement Fund
Act 1998, the Prime Minister with the consent of Cabinet makes the following
regulations:
1 Short Title
(1) This Regulations may be cited as the Retirement Fund (Administration)
(Amendment) Regulations 2012.
(2) The Retirement Fund (Administration) Regulations 1999 are in these
Regulations referred to as the Principal Regulations.
2 Regulation 5(2) amended
Regulation 5(2) of the Principal Regulations is amended by deleting the following
words and comma “subject to sub-regulation 5(3),”.
3 Regulation 5(3) amended
Regulation 5(3) of the Principal Regulations is amended by repealing it and
replacing it with the following –

“(3) Every Member shall have the full balance of the Employer Account included
in the Leaving Service Benefit.”
4 Regulation 5(6) amended
Regulation 5(6) of the Principal Regulations is amended by repealing it and
replacing it with the following:
“Police Officers
(6) Subject to these Regulations, the Fund Board shall pay the preserved portion
to a Member who is a police officer upon his retirement on reaching the
compulsory retirement age prescribed by section 72 of the Tonga Police Act
2010. PROVIDED that a Member who is a police officer shall be paid the
preserved portion upon his voluntary retirement after reaching the minimum
voluntary retirement age prescribed by section 71 of the Tonga Police Act
2010.”
