FIREARMS

FIREARMS (FORMS AND FEES) RULES

(SECTION 45) [Commencement 17th July, 1969]

1. These Rules may be cited as the Firearms (Forms and Fees) Rules.

2. In these Rules, unless the context otherwise requires —

“the Act” means the Firearms Act; “Schedule” means one of the Schedules to these

Rules, and all other expressions shall have the same respective meanings as in the Act.

PART I REVOLVERS

3. An application for the issue of a special licence under section 5 of the Act shall be made to the Commissioner of Police and shall be made in respect of each revolver.

4. Every special licence issued by the Licensing Authority under section 5 of the Act shall be in the form of a book containing —

(a) the particulars specified in Form II in the First Schedule; and

(b) not less than four pages reserved for endorse- ments.

5. A record of every special licence issued under section 5 of the Act shall be entered in a book to be kept for that purpose by the Commissioner of Police or a police officer designated by him, which shall be in the Form III in the First Schedule and shall contain the particulars therein referred to.

PART II RIFLES AND OTHER FIREARMS AND

AMMUNITION 6. An application for the issue of a firearm certificate

under section 11 of the Act shall be made to the Commissioner of Police and shall contain all the relevant information specified in Form IV in the First Schedule. A separate application shall be made in respect of each firearm and of each quantity of ammunition.

7. Every firearm certificate issued by the Commis- sioner of Police under section 11 of the Act shall be in the form of a book containing —

(a) the particulars specified in Form V in the First Schedule; and

(b) not less than four pages reserved for endorse- ments.

8. A record of every firearm certificate issued under section 11 of the Act shall be entered in a book to be kept for that purpose by the Commissioner of Police or a police officer designated by him, which shall be in the Form VI in the First Schedule and shall contain the particulars therein referred to.

PART III GUNS

9. An application for the issue of a gun licence order section 17 of the Act shall be made

(a) in New Providence to the Commissioner of Police; and

(b) in any Out Island district to the commissioner of that district,

and shall contain all the relevant information specified in Form VII in the First Schedule. A separate application shall be made in respect of each gun.

10. Every gun licence issued or renewed under section 17 of the Act shall contain the particulars specified in Form VIII in the First Schedule.

11. (1) A record of every gun licence issued under section 17 of the Act shall be entered in a book to be kept for that purpose by every person authorised by or under that section to issue gun licences, which shall be in the Form IX in the First Schedule and shall contain the particulars therein referred to.

(2) Every person authorised to issue gun licences as aforesaid in any Out Island district shall submit a monthly return to the Commissioner of Police of all gun licences issued, renewed, or withdrawn in his district. Such return shall be as specified in Form X in the First Schedule.

(3) In addition to the book referred to in paragraph (1) of this rule, a record of every gun licence issued in The Bahamas shall be maintained by the Commissioner of Police or by a police offficer designated by him, containing all the particulars specified in Form IX in the First Schedule, together with particulars of the district in which every such licence has been issued.

PART IV FIREARMS DEALERS REGISTRATION

12. (1) An application for registration of any person as a firearms dealer shall be made to the Commissioner of Police in Form XI in the First Schedule and shall contain all the relevant information specified therein.

(2) A separate application which shall be made in respect of each Police District within which the applicant wishes to carry on business of a firearms dealer.

13. (1) The register of firearms dealers to be main- tained by the Commissioner of Police in accordance with section 24 of the Act shall be in Form XII in the First Schedule and shall contain the particulars specified therein.

(2) Removal of the name of a registered firearms dealer from the register shall be effected by striking out the name and particulars entered therein in respect of such dealer, but not so as to render such name or particulars illegible, and by initialling the deletion thereof.

14. Every certificate of registration of a firearms dealer shall be in Form XIII in the First Schedule.

PART V PERMITS

15. (1) An application for the issue of a permit for the purposes of section 13, 18 or 23 of the Act shall be made to the Commissioner of Police in Form XIV in the First Schedule and shall contain all the relevant information specified therein.

(2) Every such permit shall contain the particulars specified in Form XV in the First Schedule.

16. The declaration to be made by a person belonging to or on board of a foreign vessel in respect of a revolver under the provisions of section 7 (c) of the Act shall be in Form XVI in the First Schedule and shall be signed by the person making the same and by the master of the vessel.

PART VI FEES

17. There shall be payable in respect of each of the matters specified in the first column of the Second Schedule a fee of the amount specified in the second column of that Schedule opposite thereto. Such fees shall be payable in every case to the Public Treasury.
