LYNDEN PINDLING INTERNATIONAL AIRPORT (PARKING) RULES

(SECTION 13) [Commencement 1st April, 1972]

PART I PRELIMINARY

1. These Rules may be cited as the Lynden Pindling International Airport (Parking) Rules.

2. (1) In these Rules, unless the context otherwise requires —

“the Airport” means those parts of the Lynden Pindling International Airport in the possession or occupation of the Minister;

“attendant” means a person appointed by the Minister under rule 4 of these Rules as an attendant at a pay car park;

“Director” means the Director of Civil Aviation; “dispenser” means an automatic ticket dispenser

provided by the Minister in a pay car park for the purpose of dispensing tickets;

“Long Term Parking Lot” has the meaning assigned to that expression by rule 4(1)(a);

“motor vehicle” means any vehicle which is wholly or partially propelled by mechanical means and which is designed or adapted for use on roads;

“parking meter” means apparatus of such type or design as may be approved by the Minister, being apparatus designed to indicate whether any charge has been paid and whether the period for which it has been paid or any further period has elapsed;

“parking meter area” means any area within the Airport appointed by the Minister under rule 12 as a place where persons may park motor vehicles;

“parking spot” means a spot, whether in a pay car park, a parking meter area or a free parking area, marked off by lines and reserved for the parking of one motor vehicle;

“pay car park” means any area within the Airport appointed by the Minister under rule 4 as a place where persons may park motor vehicles;

“permit” means a permit provided for in rule 6; and “Short Term Parking Lot” has the meaning assigned

to that expression by rule 4(1)(b). (2) References in these Rules to a rule shall be

construed as references to one of these Rules. 3. Any person in charge of a motor vehicle who

complies with these Rules shall be entitled to park his motor vehicle within the Airport.

PART II PAY CAR PARKS

4. (1) The Minister may appoint such areas of the Airport as he may think fit as pay car parks, and the Minister may appoint within such pay car parks —

(a) any area for use for the parking of motor vehicles for a period of four hours or more (in these Rules referred to as a “Long Term Parking Lot”);

(b) any area for use for the parking of motor vehicles for any period of less than four hours (in these Rules referred to as a “Short Term Parking Lot”); and

(c) any other area for such purposes as the Minister sees fit.

(2) The Minister shall appoint such number of attendants as he may consider necessary to supervise such pay car parks.

(3) An attendant — (a) shall be furnished with a certificate of appoint-

ment in such form as the Minister may think fit; and

(b) in the exercise of his functions under these Rules, shall, if required to do so by any person, produce the certificate to him.

5. (1) Subject to rules 6 and 7 every person desiring to park a motor vehicle in a pay car park shall obtain a ticket from a dispenser and, upon receipt of the ticket, may park the vehicle on a parking spot.

(2) Any person desiring to remove from a pay car park a vehicle parked therein pursuant to paragraph (1) of this rule shall produce his ticket to the attendant at the exit of the pay car park and pay to him the appropriate fee specified in the Schedule.

(3) An attendant shall not permit a person to remove from a pay car park a vehicle parked therein pursuant to paragraph (1) of this rule unless —

(a) that person produces a ticket as required by paragraph (2) thereof and pays the appropriate fee; or

(b) otherwise satisfies the attendant of the right of that person so to remove the vehicle and pays a fee of five dollars or the amount due and owing for the time during which the vehicle remained within the pay car park, whichever is the greater; or

(c) the Director so directs. 6. (1) Any public officer attached to the

Department of Civil Aviation and any person employed at the Airport desiring to park a motor vehicle in a pay car park on an annual basis shall make application for a permit for the purpose to the Director, enclosing in his application the appropriate fee specified in the Schedule; and the Director shall have power to grant and issue such permits subject to the following provisions of this rule.

(2) Where the Director decides to grant a permit he shall issue to the applicant a permit-card and windscreen- sticker each of which shall be in such form as the Director may determine and shall be valid for the period specified therein.

(3) Every windscreen-sticker issued under paragraph (2) of this rule shall be affixed to the bottom left side of the windscreen of the motor vehicle to which the sticker relates and shall be kept so affixed.

7. (1) Every holder of a permit desiring to park his motor vehicle in a pay car park under the permit shall obtain a ticket from a dispenser by inserting his permit- card therein and, subject to paragraph (2) of this rule, the possession of such a ticket shall entitle him to park the motor vehicle on a parking spot and remove it from the pay car park free of charge, provided —

(a) he produces and surrenders his ticket to the attendant; and

(b) the windscreen-sticker required by paragraph (3) of rule 6 is affixed to the vehicle, at all times.

(2) Where the holder of a permit fails or refuses to fulfil the requirements of paragraph (1) of this rule, the provisions of paragraph (3) of rule 5 (except subparagraph (a) thereof) shall apply as these provisions apply in relation to a person parking a vehicle in a pay car park pursuant to paragraph (1) of that rule.

8. A permit may be renewed by the Director on or before the date of expiry shown thereon upon the application of the holder of the permit and on the payment of the appropriate fee specified in the Schedule.

9. Where the Director is satisfied that a permit-card or windscreen-sticker issued under these Rules has been lost, destroyed or mutilated or is for some other good reason not available, he may issue to the holder thereof a substitute permit-card or sticker upon the application of the holder of the permit and on the payment of the appropriate fee specified in the Schedule.

10. A notice placed at or near an area of the Airport indicating that that area has been appointed as a pay car park, a Long Term Parking Lot or a Short Term Parking Lot, as the case may be, for the purposes of these Rules shall, if purporting to have been so placed by or under the authority of the Minister, be conclusive evidence for all purposes of appointment as such by the Minister under those Rules.

11. (1) The fees payable for the parking of motor vehicles in pay car parks shall be the appropriate fees specified in the Schedule.

(2) The Minister or any public officer authorised in writing by him in that behalf may remit to any person or class of persons, on particular occasions or for particular periods, to such extent as he may think fit, any fees payable under these Rules but for such remission, and accordingly, where any such remission is in force, the provisions of rules 5 to 7 inclusive respecting fees shall have effect subject to such remission.

PART III PARKING METER AREAS

12. The Minister may appoint such areas of the Airport as he may think fit as parking meter areas.

13. (1) The Minister may cause to be erected, in any parking meter area, parking meters for the purpose of charging fees for the parking of motor vehicles in the parking meter area.

(2) Every parking meter shall bear a plate or other device showing —

(a) the period during which a charge is made for the use of the parking meter area; and

(b) the appropriate fee specified in the Schedule which is payable, under rule 15, for the use of a parking spot in the parking meter area, the period of time to which such fee relates and the denomination of coin to be used for the payment of such fee.

(3) The Minister shall take such steps as appear to him to be appropriate for the periodical inspection of the parking meters and for dealing with any found to be out of order, for securing the testing of the parking meters, both before they are put into operation and afterwards, and for recording the date on which, and the person by whom, a parking meter has been tested.

(4) All monies collected from parking meters shall be paid into the Consolidated Fund.

14. A notice placed at or near an area of the Airport indicating that that area has been appointed as a parking meter area for the purposes of these Rules shall, if purporting to have been so placed by or under the

authority of the Minister, be conclusive evidence for all purposes of appointment as such by the Minister under these Rules.

15. The fee payable for parking a motor vehicle in a parking spot in a parking meter area shall be the appropriate fee specified in the Schedule.

16. A person desiring to park a motor vehicle in a parking meter area may park the motor vehicle on a parking spot in the parking meter area and shall, immediately after so parking the motor vehicle —

(a) pay the appropriate fee specified in the Schedule, by inserting the appropriate coins into the parking meter relating to the parking spot; and

(b) operate the parking meter, but the maximum time for a single period of parking shall be twenty minutes.

PART IV FREE PARKING AREAS

17. (1) The Minister may by order designate as a free parking area any area of the Airport not appointed by him as a pay car park or parking meter area.

(2) Subject as otherwise expressly provided in these Rules, any member of the public shall be entitled to park any motor vehicle in a free parking area free of charge and without any restriction.

PART V MISCELLANEOUS

18. Any person who — (a) being in charge of a motor vehicle fails to obey

the directions of any traffic sign placed, erected or displayed at the Airport by lawful authority; or

(b) interferes or tampers with or injures any dispenser or any entrance or exit barrier installed at the Airport by the Minister; or

(c) parks a motor vehicle within a pay car park, a parking meter area or a free parking area elsewhere than on a parking spot; or

(d) being in charge of a motor vehicle fails to obey any sign or direction lawfully given by an attendant relating to the operation of a pay car park; or

(e) drives a motor vehicle into or out of a pay car park otherwise than through the entrance or exit respectively for the time being provided for that purpose; or

(f) parks any thing, other than a motor vehicle, in a parking spot in respect of which there is a parking meter; or

(g) unlawfully interferes with a parking meter or operates or attempts to operate a parking meter by the insertion of any object other than an appropriate coin; or

(h) without lawful authority, removes or attempts to remove any money from a parking meter; or

(i) being the driver of a motor vehicle, fails duly to pay any fee payable under rule 15; or

(j) being the driver of a motor vehicle, contravenes the requirement of rule 16 in respect of the parking of a motor vehicle in a parking meter area; or

(k) otherwise parks a motor vehicle contrary to the provisions of these Rules,

shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding sixty dollars or to imprisonment for a term not exceeding three months.

(2) In subparagraphs (i) and (j) of paragraph (1), the reference to the driver of a motor vehicle shall be construed as a reference to the person driving the motor vehicle at the time when it was left in the relevant parking spot.

(3) In any proceedings under these Rules, every parking meter erected pursuant to rule 13 shall be deemed at the relevant time, to have been of such type and design as shall have been approved by the Minister and to have been maintained to his satisfaction until the contrary is proved.

(4) Nothing in subparagraph (f), (i), or (j) of paragraph (1) shall apply —

(a) (i) to vehicles owned by the Royal Bahamas Police Force or the Royal Bahamas Defence Force;

(ii) to vehicles owned, operated and maintained by the Department of Civil Aviation, and used by that Department to render assis- tance in cases of accident, fire or rescue or in other emergencies;

(iii) to fire brigade vehicles; (iv) to ambulances; or (v) to vehicles used for the conveyance of

public mail, when any such vehicles are parked as a matter of urgent necessity in any parking meter area; or

(b) to anything done with the permission of the Director, or a police officer acting in the execution of his duty.

19. (1) Any motor vehicle found parked within the Airport —

(a) elsewhere than in a pay car park, a parking meter area or a free parking area; or

(b) in a pay car park or a parking meter area in contravention of these Rules,

may be removed therefrom by a police officer or an attendant or any person authorised by the Director for the purpose, at the expense and risk of the owner thereof.

(2) Any motor vehicle removed in accordance with the provisions of paragraph (1) of this rule may be taken to and deposited at such place as the Minister may direct, and the Minister shall have a lien on any such vehicle for any expenses incurred by any such police officer, attendant or person as aforesaid by virtue of the said provisions.

20. No action shall lie against the Crown, the Minister, the Director, a police officer, an attendant or any person acting under the authority of the Minister, or the Director for any act or omission bona fide done or omitted to be done in the administration of these Rules.

21. The Minister shall not be liable in respect of the loss of or damage to any motor vehicle or the fittings or contents of any motor vehicle parked in a pay car park, in a parking meter area or in a free parking area.

22. The Director shall keep posted at all times in a conspicuous place in every pay car park and in every parking meter area a copy of the Schedule.

23. Nothing in these Rules shall operate to prejudice anything contained in rule 14 of the Windsor Field Airport Rules.

WINDSOR FIELD AIRPORT RULES

(SECTION 13) [Commencement 20th March, 1965]

1. These Rules may be cited as the Windsor Field Airport Rules.

2. The purpose of these Rules is to provide for the safety of life and property on the Windsor Field Airport and to provide for the protection of public and private property within the boundaries of the airport and for the general administration of the airport.

3. In these Rules, unless the context otherwise requires —

“airport” means the Windsor Field Airport, New Providence under the control of the Minister;

“authority” means the Minister or a person duly appointed by him;

“Minister” means the Minister appointed under section 3 of the Civil Aviation Act, or any public officer authorised by him to discharge any of the functions of the Minister under the provisions of these Rules.

4. (1) These Rules shall apply to all persons on any part of the airport.

(2) It shall be unlawful for any person to enter upon any restricted area of the airport except with the written permission of the Minister or his duly authorised
