PROHIBITION OF THE IMPORTATION OF PLANTS (STATE OF CALIFORNIA) ORDER

(SECTION 5) [Commencement 7th April, 1982]

1. This Order may be cited as the Prohibition of the Importation of Plants (State of California) Order.

2. The importation into The Bahamas directly or indirectly from any port or place in the State of California in the United States of America of any plant (in which term is included trees, shrubs, herbs, or vegetables; and cuttings, bulbs, seeds, berries, buds and grafts; and the fruit or product of any plant and the root, trunk, stem, branch or leaf of any plant including emptied pods, husks or skins) or any package in which any plant (as hereinbefore defined), whether the same is intended for consumption as food or otherwise or any paper or any other article which has been packed with any plant as aforesaid is hereby prohibited unless there is produced at the time of such importation a certificate issued by the United States Department of Agriculture or by the Department of Agriculture of the State of California to the effect that the imported plant is free from any harmful or dangerous disease or insect.

LRO 1/2008 STATUTE LAW OF THE BAHAMAS

2. (1) No person shall import, into The Bahamas, from the State of Florida in the United States of America, any citrus fruit unless —

(a) the shipment of fruit is accompanied by a phytosanitary certificate issued by the United States Department of Agriculture or the Florida Department of Agriculture, certifying that the fruit was grown in an area designated canker free;

(b) the shipment of fruit is accompanied by certifica- tion that the fruit has been treated with a bactericide or fungicide such as Chlorine or Sopp approved by the Federal Drug Adminis- tration, of the United States of America;

(c) each carton in the shipment of fruit is affixed with a stamp certifying that the fruit was grown in an area designated canker free;

(2) No person shall import into The Bahamas, from the State of Florida in the United States of America any seed unless each packet is affixed with a certificate stating that the seeds had been treated in accordance with regulations for interstate shipment of citrus seeds from Florida and, in particular that —

(a) the fruit from which seeds were extracted have undergone a treatment described in subpara- graph (1)(b);

(b) the seeds, after cleaned of pulp were immersed in water at 125º F for 10 minutes; and

(c) following the hot water treatment, the seeds were immersed in a solution containing 200 parts per million active Chlorine for at least two minutes.

(3) No person shall import into The Bahamas, from the State of Florida in the United States of America, any citrus plants unless each container of potted plants and each package of bare root plants is affixed with a certificate indicating that such plants were grown in an area designated canker free.
