AN ACT TO MAKE SPECIAL PROVISION TO ENABLE CERTAIN PUBLIC OFFICERS WHO WERE EMPLOYED IN THE DEPARTMENT OF MARKETING AND EXPORT PROMOTION OF HANDICRAFTS AND IN THE RELEVANT SECTIONS OF THE DEPARTMENT OF SMALL INDUSTRIES AND WHO WERE SUBSEQUENTLY EMPLOYED BY THE SRI LANKA HANDICRAFTS BOARD, TO BE ELIGIBLE FOR THE GRANT OF A PENSION AND TO PROVIDE FOR MATTERS CONNECTED THEREWITH OR INCIDENTAL THERETO.








BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows :-

Short title.



1. This Act may be cited as the National Crafts Council and Allied Institutions (Special Provisions) Act No. 4 of 1996.



Grant of pension to certain Persons employed in the department of Marketing and Export Promotion of Handicraft and the relevant sections of the Department of Small Industries and subsequently employed by the Sri Lanka Handicrafts Board.



2. Every officer or servant of the Sri Lanka Handicrafts Board established by the National Crafts Council and Allied Institutions Act, No. 35 of 1982 (hereinafter referred to as "the Board") whose service in the Board when added to his period of service in the Department of Marketing and Export Promotion of Handicrafts or a relevant section of the Department of small Industries amounts to ten years or more, not being a person who was on the day preceding the date of commencement of this Act, in receipt of or eligible to the payment of, a pension under the National Crafts Council and Allied Institutions Act, No. 35 of 1982, and whose substantive post in the Department of Marketing and Export Promotion of Handicrafts or a relevant section of the Department of Small Industries is declared to be pensionable under the Minutes on Pensions, shall be deemed to have held such post for the relevant period of service and shall be eligible for the grant of a pension under the Minutes on Pensions at the end of such period.



"relevant period of service" in relation to a person to whom this section applies, means the period for which such person would have had to serve in the Department of Marketing and Export Promotion of Handicrafts or a relevant section of the Department of Small Industries as the case may be to complete ten years' pensionable service had be continued to remain in such Department or such relevant section, after the date of his appointment to a post in the Board.



Conditions to be satisfied before award is made.



3. Every person who becomes eligible for the grant of a pension under section 2 shall receive such subject to a refund-





(a) which shall be made by him or his heirs, to the Director of Pensions, of any gratuity paid to him upon his accepting permanent employment with the Board ;



(b) which shall be made to the Treasury, by the Commissioner of Labour, or where such person has received his contribution to the Employees' Provident Fund, by that person or his heirs, of all contributions to the Employees' Provident Fund made by the Board in respect of such person for the period commencing on the date on which such person was employed by the Board and ending on the date on which he became, or becomes, eligible for the grant of a pension under section 2 of this Act.



Sinhala text to prevail in case of inconsistency.



4. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.



Interpretation.



5. In this Act unless the context otherwise requires-



"Employees' Provident Fund" means the Employees' Provident Fund established by the Employees' Provident Fund Act, No. 15 of 1958 ;



"relevant section of the Department of Small Industries" has the same meaning as in Part III of the National Crafts Council and Allied Institutions Act, No. 35 of 1982.
