AN ACT TO AMEND THE FISHERIES AND AQUATIC RESOURCES ACT. NO. 2 OF 1996

BE it enacted by the Parliament of the Democratic Socialist Republic of Sri Lanka as follows ;-

Short title.

1. This Act may be cited as the Fisheries and Aquatic Resources (Amendment) Act. No. 4 of 2000.

Amendment of section 2 of Act No. 2 of 1996.

2. Section 2 of the Fisheries and Aquatic Resources Act, No. 2 of 1996 (hereinafter referred to as the "principal enactment") is hereby amended as follows :-

(1) by the repeal of subsections (1), (2) and (3) of that section and the substitution therefor of the following subsections :"

"(1) There shall be appointed-

(a) a person, by name or by office, to be or to act as the Director-General of Fisheries and Aquatic Resources (hereinafter referred to as the "Director-General") ;

(b) one or more persons, by name or office, to be or to act as Director of Fisheries and Aquatic Resources: and

(c) such other officers as may from time to time be required for the purposes of this Act.

(2) The Director-General shall be responsible for the administration and giving effect to the provisions of this Act.

(3) Any person appointed under subsection (1) to be or to act as a Director of Fisheries and Aquatic Resources may, subject to the control of the Director-General, exercise ail or any of the powers conferred upon the Director-General by or under this Act." ; and

(2) by the substitution for the marginal note to that section, of the following marginal note :-

"Appointment of Director-General and other officers.".

Reference to the Director General.

3. Every reference to the " Director of Fisheries and Aquatic Resources " or to the " Director " denoting the Director of Fisheries and Aquatic Resources in the principal enactment or in any written law, notice, notification, communication or other document shall be read and construed as a reference respectively to the '' Director-General of Fisheries and Aquatic Resources and the "Director-General".

Sinhala text to prevail in case of inconsistency.

4. In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the text shall prevail.
