2008 and the provisions of the Road Traffic Ordinance 1960,
I, TUI ATUA TUPUA TAMASESE EFI, Head of State,
acting on the advice of Cabinet, MAKE the following
Regulations:

(Familiarisation Programme) Regulations 2009

REGULATIONS
1. Citation and commencement-(1) These Regulations
may be cited as the Road Transport Reform (Familiarisation
Programme) Regulations 2009.
(2) These Regulations commence on 2 March 2009.
2. Interpretation - In these Regulations, unless the context
otherwise requires:
“Act” means the Road Transport Reform Act 2008;
“designated area” means the roads inside the Tuanaimato
Sports Complex excluding both Fuesina Road and the
ring road (which comprises Malili Road, Talimatau
Road, Siusega Road and Falelauniu Road) and shown in
the map in Schedule 1.
3. Driving practice-(1) Any person driving in the
designated area shall comply with the items set out in
Schedule 2.
(2) All the current road rules made under the Road Traffic
Ordinance 1960 apply to a driver driving in a designated area
under subregulation (1) except:
(a) regulations 69, 70, 71(2), 72, 73(a), (b) and (c),
74(3) and 82(1)(a) of the Road Traffic
Regulations 1961; and
(b) clause 16(2) of the Road Traffic Order 1994.
4. Speed limit - The prescribed speed limit in the designated
area is 15 miles per hour.
5. Non-liability of Government – The Government shall
not be liable by reason of any provision of these regulations for
any injury, damage, or loss (including any claim for the
diminution of value of any vehicle) which may occur to any
person or property.
6. Expiry – These regulations expire on a date nominated
by the Minister, or the date of commencement of sections 4 to 7
(inclusive) of the Act, whichever comes first.

Item Heading Description
1 Keeping to left Every driver of a motor vehicle
or other vehicle, shall keep the
vehicle as close as practicable to
the left of that part of the road
used or reasonably usable for the
time being for vehicular traffic in
general, and shall reduce speed at
corners, bends, or turnings
sufficiently to enable him to
comply strictly with this rule.
2 Passing on right when
overtaking
Save where otherwise directed by
a member of the Police Service at
controlled intersections, every
driver of a motor or other vehicle
shall, when overtaking another
vehicle, pass on his or her right
or near side of the overtaken
vehicle, and shall not move into
the line of passage of the other
vehicle until clear from it by a
reasonable distance, in the case
of a motor vehicle being not less
than 18 feet.
3 Overtaking Subject to the provisions of item
2 and if the driver has a clear
view of the road and the traffic
thereon for a distance of at least
300 feet in the direction in which
the driver is travelling, every
driver of a motor vehicle shall,
when overtaking another vehicle,
signal by means of his or her
warning device the desire to pass

the vehicle being overtaken, and
thereupon it shall be the duty of
the driver of the latter to move as
far as practicable to his or her left
so as to allow the overtaking
vehicle a reasonable space in
which to pass. After such a
signal has been given, the driver
of the vehicle being overtaken
shall not increase speed until the
overtaking vehicle has had an
opportunity to pass and draw
clear.
4 Turning at intersection Subject to the provisions of item
5, every driver of a motor vehicle
or other vehicle intending to turn
at an intersection from any
roadway into another roadway to
the driver’s right shall, when
approaching and turning give the
appropriate driver’s signal to
warn other drivers and bicycle
riders. The driver shall then
maintain his or her position to the
left of the roadway out of which
he or she is turning until the
driver enters the intersection, and
shall then turn into the roadway
into which he or she is entering
as directly and quickly as he or
she can with safety.
5 Giving way at
intersection
Every driver of a motor vehicle
or other vehicle when
approaching or crossing any
intersection which is not for the
time being controlled by a police
officer and which any other
vehicle is approaching or
crossing shall give way to such
other vehicle and allow the same
to pass before him or her, and, if

necessary for that purpose, stop
his or her vehicle in the
following circumstances:
(a) if such other vehicle is approaching from his or her
right unless he or she is on a
road declared to be a main
road under Part XV of the
Road Traffic Regulations
1961 or unless such other
vehicle is abut to turn or is
turning to its right and the
driver is not him or herself
about to turn or tuning to his
right; or
(b) if such driver is about to turn or is turning to his or her
right (thus being under an
obligation to give the
appropriate signal); or
(c) if such driver is about to turn
or is turning to his or her left
and the width of the road is
not sufficient to allow
vehicles approaching on his
or her left to pass his vehicle
while it is turning.
6 Giving way Where for any reason any vehicle
is proceeding at a slow rate of
speed which is causing
obstruction to other traffic, the
driver of such vehicle shall keep
close to his or her left side of the
road or stop so as to enable other
vehicles to pass.
7 Stopping and parking No person or driver in charge
of a vehicle, not being a
bicycle, shall stop, stand, or park
such vehicle, whether attended
or unattended, otherwise than

parallel with the direction of the
road, and with the left side of the
vehicle as near as practicable to the
edge of the kerb or road:
Provided that a vehicle may be
parked with its right side as near as
practicable to the edge of the kerb or
road while it is being used for fire
brigade purposes in attendance at a
fire.
8 Left Turn Against Red
Light at T-Intersection
Only
However at a T-Intersection
controlled by traffic lights vehicles
turning left are hereafter permitted a
“Free Turn” against the red light but
only in strict compliance with the
following rules:
1. left turning vehicles must use the outside lane;
2. left turning vehicles must first stop at the red light and
check to see whether the
road is clear before
executing a left turn. If
there is oncoming traffic
using their green light the
left turning vehicle must
give way to such traffic.
Execute your left turn only
if the road is clear, and it is
safe to do so;
3. left turn vehicles must give way to pedestrians at all
times.
