MEMORANDUM CIRCULAR NO. 1139

DEFERRING THE IMPLEMENTATION OF MEMORANDUM CIRCULAR NO. 1059 DATED MAY 8, 1978 ON COTTAGE INDUSTRY EXPORT

In a series of Memoranda for the President, the private sector through the Philippine Export Council recommended the immediate suspension of the implementation of Memorandum Circular No. 1059 issued by this Office on May 8, 1978, regarding cottage industry export, requiring the accreditation of NACIDA before an export license can be issued to an applicant cottage industry producer, on the following grounds:

1) The implementation of the aforesaid Memorandum Circular is in conflict with the government’s expressed policy to simplify export procedures as embodied in Presidential Decree No. 930.

2) The objectionable provisions of PD 817 and its implementing rules and regulations, upon which the aforementioned Memorandum Circular is based, are still under the process of review and reconsideration by the NEDA and other concerned agencies. Among ethers, the Accreditation rules are being objected to on account of the need to divulge informations such as data on raw materials used, sources of materials, equipment or machinery used, etc. which are normally considered as trade secrets.

The NEDA adopted the same position.

In view of the above recommendations, the President, on April 12, 1979, approved the deferment of the implementation of Memorandum Circular No. 1059 pending the further review by the NEDA Board and other appropriate agencies of the NACIDA Accreditation Scheme.

Immediate compliance herewith is enjoined.
