PROCLAMATION NO. 11

DECLARING AS CIVIL RESERVATION FOR CULTURAL COMMUNITIES (BANWA-ON) A CERTAIN PARCEL OF LAND OF THE PUBLIC DOMAIN COVERING THREE THOUSAND ONE HUNDRED NINETY EIGHT AND 80/100 (3,198.80) HECTARES, SITUATED IN THE MUNICIPALITY OF ESPERANZA, PROVINCE OF AGUSAN DEL SUR.

Upon recommendation of the Minister of Natural Resources, I, CORAZON C. AQUINO, President of the Philippines, do hereby set aside as civil reservation for the cultural minorities (Banwa-on tribe) a certain parcel of land of the public domain located in Barangay Tagbalili, Municipality of Esperanza, Province of Agusan del Sur, as shown and described in Bureau of Forest Development Map No. C.R.-371, with the following technical description:

Beginning at a point designated as Corner “1”, an unidentified tree at the junction of Quiasi and Libang rivers;

thence, following Quiasi river upstream in a general northwest and southwest direction about 750 meters to corner 2;

thence, following the same river upstream in a general southwest direction about 730 meters to corner 3;

thence, following the same river upstream in a general southwest and southeast direction about 540 meters to corner 4;

thence, following the same river upstream in a general southwest direction about 580 meters to corner 5;

thence, following the same river upstream in a general southwest direction about 520 meters to corner 6;

Containing an area of THREE THOUSAND ONE HUNDRED NINETY EIGHT AND 80/100 (3,198.80) HECTARES, more or less, subject to private rights, if any there be, as well as to future survey and delimitation, and to the following conditions:

1. The administration and management of the area covered by the reservation shall be jointly under the Ministry of Natural Resources and the Office of Muslim Affairs of Cultural Communities (OMACC). For this purpose, said agencies are hereby authorized to call upon the assistance and support of other agencies in the execution of plans and programs for the development of the area, taking into consideration existing government development programs with respect to water, soil and forest conservation.

2. A development plan of the reservation shall be prepared and submitted not later than six (6) months from the promulgation hereof.

3. The disposition of the area with respect to land tenure shall be pursued under the stewardship concept, and the Ministry of Natural Resources, through the Bureau of Forest Development, is hereby directed to implement immediately the integrated social forestry program within the area such that only qualified members of the Manobo (Banwa-on) tribe, upon the recommendation of Muslim Affairs and Cultural Communities, may forthwith receive their certificates of stewardship.

4. All timber licenses, minor forest products licenses, pasture lease agreements as may be operating within the reservation are hereby cancelled, revoked, or amended accordingly.

5. The utilization of all timber and other minor forest products found therein shall be subject to the Forest and Internal Revenue laws, rules and regulations now or may hereafter be in force.

6. This Proclamation shall be deemed automatically revoked or cancelled in the event that the reservation no longer serves the purpose for which it was originally established and/or is abandon by the intended beneficiaries and the area covered thereby reverted to the mass of forest lands under the administration and management of the Ministry of Natural Resources through the Bureau of Forest Development.
