SEGREGATING CERTAIN AREA FROM THE PARCEL OF LAND COVERED BY TRANSFER CERTIFICATE OF TITLE NO. 6735 UNDER THE ADMINISTRATION OF MANILA INTERNATIONAL AIRPORT AUTHORITY BY VIRTUE OF EXECUTIVE ORDER NO. 903 s. 1983 SITUATED IN BARRIO BALAGBAG, SAN ROQUE AND MARICABAN, CITY OF PASAY AND DECLARING THE SAME OPEN TO DISPOSITION TO QUALIFIED APPLICANTS IN ACCORDANCE WITH ACT NO. 3038, IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT, COMMONWEALTH ACT NO. 141, AS AMENDED

Upon the recommendation of the Secretary of the Department of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL ARROYO, President of the Philippines, do hereby segregate certain areas from the parcel of land covered by Transfer Certificate of Title No. 6735 now under the administration of Manila International Airport Authority by virtue of Executive Order No. 903 promulgated on July 21, 1983 and declaring the same open to disposition to qualified applicants in accordance with Act No. 3038, in relation to the provision of the Public Land Act, Commonwealth Act No. 141, as amended. The specific portions herein segregated subject to final actual survey, are described as follows:

TECHNICAL DESCRIPTIONS

(BALAGBAG AREA)

A parcel of land (Lot 3270-B-3-A-2-1 of the subd. Plan Swo-00-001755, being a portion of Lot 3270-B-A-2, Psd-13-007193), situated in Barangay 201, Balagbag, Pasay City, Metro Manila, Island of Luzon. Bounded on the SW and NW, along lines 1-2-3-4 by Lot 3270-B-3-B, Psd-04-000-980; on the NE, along lines 4-5-6-7 by Lot 3270-B-3-A2-D (Road); on the SE, along lines 7-8-9-10 by Lot 3270-B-3-A-2-F (Road), both of the Subd. Plan.

Plan Swo-00-001754, being a portion of Lot 3271-B-2, Psd-04-003729), situated in Don Carlos Village Barangay San Roque, Pasay City, Metro Manila, Island of Luzon. Bounded on the SE., along line 1-2 by Cad 259 Pasay Cadastre; along line 2-3 by Lot 3271-B-2-E; along line 3-4 by Lot 3271-B-2-BB (Road)’; along 4-5 by Lot 3271-B-2-D; on the SW., along line 5-6 by Lot 3271-B-2-A, all of the subdivision plan;-on the NW., along line 6-7 by Parañaque river and on the NE., along lines 7-28 and 28-1 by Lot 3271-B-1, Psd-04-003729 xxxx containing an area of FORTY SIX THOUSAND NINETY FIVE (46,095) SQUARE METERS.

A parcel of land (Lot 3271-B-2-E of the subd. Plan Swo-00-001754, being a portion of Lot 3271-B-2, Pad-04-003729), situated in Don Carlos Village Barangay San Roque, Pasay City, Metro Manila, Island of Luzon. Bounded on the NW., along line 1-2 by Lot 3271-B-2-B of the subdivision plan; on the NE., along lines 2-3-4 by Cad 259, Pasay Cadastre; on the SE., along lines 4-11 by Lot 3271-B-2-N (River), and the SW., along lines 11-14-1 by Lot 3271-B-2-BB (Road), all of the subdivision plan xxxx containing an area of TWENTY THREE THOUSAND FIVE HUNDRED NINETY FOUR (23,594) SQUARE METERS.

(MARICABAN III)

A parcel of land being a portion of Lot 3270-B-3 of the subd. Plan Psd-04003252, otherwise known as PAL TRANSMITTING AREA situated in Barrio Maricaban, City of Pasay, Metro Manila. Bounded on the North by Mulawin St., on the East by an alley (Matulungin); on the South by an alley (Rosal) and Block 41, Bsd-04000890 and on the West by Lot 3270-A, Psd-04-002483 (St. Peter St.) containing an approximate area of THIRTEEN THOUSAND THREE HUNDRED (13,300) SQUARE METERS.

(BO. PILIPINO PUTOL)

A parcel of land being a portion of Lot 3271-B-2-H of the subdivision plan Swo-00-001754 situated in Barangay 186, Bo. Pilipino Putol, Barangay San Roque, Pasay City, Metro Manila, Island of Luzon. Bounded on NE. by Philippine National Railways (Tramo), Philippine National Red Cross, Girls Scout and Boy Scout of the Philippines; on the SE. by Leisure Garment Factory; on the SW. by LRT Depot and on the NW. by portion of Lot 3271-B-2-H of the subdivision plan Swo-00-001754 xxxx containing an approximate area of ONE THOUSAND (1,000) SQUARE METERS.

Such part or parts of the area herein declared open for disposition under Act 3038, in relation to the provisions of the Public Land Act, as amended, which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition except in favor of the government or any of each branches or agencies. All lands disposed of under this proclamation shall not be subject to alienation and encumbrances for a term of ten (10) years from the issuance of the title in case of sale, or execution of contract in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period; but the improvements on the land may be mortgaged to qualified persons, associations or corporations.

Existing roads or proposed roads within the area shall conform with the provisions of Executive Order No. 113, series of 1995.

The Department of Environment and Natural Resources, National Capital Region shall conduct or supervise the actual boundary survey and subdivision survey of the proclaimed area. In the execution of the subdivision survey of the proclaimed area, open spaces for parks, playgrounds, barangay hall, school site and sufficient roads and alleys for the convenience of the residents thereat shall be strictly provided.
