MEMORANDUM ORDER NO. 76
CONCURRENCE OF THE PRESIDENT IN THE DEPUTATION OF THE ARMED FORCES OF THE PHILIPPINES AND THE PHILIPPINE NATIONAL POLICE, AND OTHER LAW ENFORCEMENT AGENCIES FOR THE 21 FEBRUARY 2015 SPECIAL SANGGUNIANG KABATAAN ELECTIONS
WHEREAS, pursuant to Section 2(4), Article IX-C of the 1987 Constitution, the Commission on Elections (COMELEC) is empowered to deputize, with the concurrence of the President, law enforcement agencies and instrumentalities of the Government, including the Armed Forces of the Philippines (AFP), for the exclusive purposes of ensuring free, orderly, honest, peaceful, and credible elections;
WHEREAS, Republic Act (RA) No. 10632 postponed the conduct of the 28 October 2013 Sangguniang Kabataan (SK) Elections to a date to be determined by the COMELEC between 28 October 2014 and 23 February 2015; and
WHEREAS, the COMELEC, through its Resolution No. 9905 (s. 2014), set the date of the Special SK Elections on 21 February 2015 and adopted its Resolution No. 9731 (s. 2013), which resolved to request the concurrence of the President in the deputation of the AFP, the Philippine National Police (PNP), and other law enforcement agencies in connection with the 28 October 2013 Synchronized Barangay and SK Elections, with no specific modifications.
NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby concur with COMELEC Resolution No. 9905 (s. 2014), deputizing the AFP, PNP and other law enforcement agencies, to assist the COMELEC in ensuring the free, orderly, honest, peaceful, and credible conduct of the 21 February 2015 Special SK Elections.
The foregoing law enforcement and other concerned agencies are hereby directed to coordinate and cooperate with the COMELEC in the performance of their duties and functions.
This Memorandum Order shall take effect immediately.
