LAW

ON THE RATIFICATION OF THE Third Additional Protocol

to the European Convention on Extradition

Article 1. Ratification of the Protocol

The Seimas of the Republic of Lithuania, acting pursuant to point 16 of Article 67 and Article 138(1)(6) of the Constitution of the Republic of Lithuania, and having regard to Decree No 1K-482 of the President of the Republic of 24 November 2015, hereby ratifies with declarations and a reservation the Third Additional Protocol to the European Convention on Extradition (hereinafter: the Protocol’), done at Strasbourg on 10 November 2010.

 

Article 2. Reservation of the Republic of Lithuania

Under Article 17(2) of the Protocol, the Seimas of the Republic of Lithuania shall declare that the Republic of Lithuania avails itself of the right not to accept Article 2(1) of the Protocol.

 

Article 3. Declarations of the Republic of Lithuania

The Seimas of the Republic of Lithuania shall make the declarations that:

1) under Article 5 of the Protocol, the rules laid down in Article 14 of the European Convention on Extradition do not apply where the person extradited by the Republic of Lithuania, in accordance with Article 4 of the Protocol, consents to extradition;

2) under Article 4(5) of the Protocol, the consent to extradition under the simplified procedure may be revoked until the competent court of the Republic of Lithuania takes its final decision on extradition under the simplified procedure.

 

I promulgate this Law passed by the Seimas of the Republic of Lithuania.
