Court of Appeal (Fees) Rules 1964

THE COURT OF APPEAL, in pursuance of Article 20 of the Court of Appeal (Jersey) Law 1961,[1] and of all other powers enabling it in this behalf, has made the following Rules –

Commencement [see endnotes]

Rule      1      ‬

The fees set out in column 2 of the Schedule to these Rules (hereinafter referred to as the “Schedule”) shall be taken in the Court of Appeal and by the Viscount and the Judicial Greffier in respect of the items set out in column 1 of the Schedule.[2]

Rule      2      ‬

The fees prescribed by these Rules shall be taken by means of stamps issued by the Treasurer of the States under the direction of the Minister for Treasury and Resources[3].

Rule3      ‬

The document to be stamped shall be the document indicated in column 3 of the Schedule.[4]

Rule      4      ‬

Every stamp used in pursuance of these Rules shall be cancelled by the officer designated in column 4 of the Schedule.[5]

Rule      5      ‬

(1)    Where a person has proceeded in the Court whose decision is appealed from under any enactment relating to proceedings by an indigent person, the fees which would otherwise have been payable by the person in the first instance in pursuance of these Rules shall not be taken.[6]

(2)    Every document presented by such a person shall, if it would otherwise have been required to have stamps affixed thereto, be marked “gratis” by the officer responsible for cancelling the stamps.

These Rules may be cited as the Court of Appeal (Fees) Rules 1964.
