Diseases of Animals (Miscellaneous Provisions) (Jersey) Order 1958[1]

THE ECONOMIC DEVELOPMENT COMMITTEE, in pursuance of Articles 3 and 42 of the Diseases of Animals (Jersey) Law 1956,[2] orders as follows –

1      Interpretation

For the purposes of Article 3 of the Diseases of Animals (Jersey) Law 1956[3] (hereinafter referred to as the “Law”) and of this Order, “animals”, “disease” and “poultry” are not restricted by their respective definitions in the Law.

2      Power to restrict movement

(1)    Where in pursuance of an Order made under the Law, the Minister causes any animal or poultry on any premises to be examined by the Veterinary Officer, the Minister may cause to be served on the occupier of those premises a notice prohibiting the movement of any animal or any poultry, as the case may be, into or out of those premises, and it shall be the duty of the occupier to comply with the terms of the notice.

(2)    A notice served in pursuance of this Article shall remain in force until such time as it is withdrawn by or on behalf of the Minister or until there has been served on the occupier a notice that the premises have been declared to be an infected place.

3      Cesser of occupation of premises

Where, in pursuance of the Law or any Order, a notice has been served on the occupier of any premises and the occupier has reason to believe that he or she will cease to occupy those premises during the continuance in force of the notice, the occupier shall immediately notify the Minister of that fact.

4      Power to dig up

Where the Minister is satisfied that it is necessary so to do for the purpose of establishing the existence, or preventing the spreading, of disease, the Minister may cause the carcase of any animal or poultry to be dug up, and it shall be the duty of the occupier of the premises on which the carcase has been buried, and the persons in the employment of the occupier, to render to any person authorized by or on behalf of the Minister all such reasonable assistance, and furnish the person authorized with such information, as he or she may require.

5      Prohibition on digging-up

Except under and in accordance with a permit in writing granted by or on behalf of the Minister, no person shall dig up, or cause to be dug up, the carcase of any animal or poultry which has died of disease, or which has been slaughtered by reason of disease:

Provided that this prohibition shall not apply in any case to which Article 4 applies.

6      Disposal and burial of carcases

The provisions of Article 9(2) and (4) of the Law shall apply to any carcase which has been dug up by virtue of Article 4 of this Order as they apply to the carcase of an animal slaughtered at the direction of the Minister.

7      Citation

This Order may be cited as the Diseases of Animals (Miscellaneous Provisions) (Jersey) Order 1958.

This Order has been amended by the States of Jersey (Amendments and Construction Provisions No. 3) (Jersey) Regulations 2005. The amendments replace all references to a Committee of the States of Jersey with a reference to a Minister of the States of Jersey, and remove and add defined terms appropriately, consequentially upon the move from a committee system of government to a ministerial system of government
