Diseases of Animals (Approved Disinfectants) (Jersey) Order 1958

THE ECONOMIC DEVELOPMENT COMMITTEE, in pursuance of Articles 3 and 42 of the Diseases of Animals (Jersey) Law 1956,[1] orders as follows –

1      Interpretation[2]

(1)    In this Order –

“approved disinfectant” means a disinfectant approved from time to time in the United Kingdom for the purposes of, and listed as an approved disinfectant in the Diseases of Animals (Approved Disinfectants) Order 1978 of the United Kingdom;

“Law” means the Diseases of Animals (Jersey) Law 1956.[3]

(2)    A reference in this Order to an enactment is a reference to an enactment as amended from time to time by any other enactment or to any enactment revoking and re-enacting that enactment with or without further amendment.

(3)    For the purposes of paragraph (2) “enactment” includes an enactment of the United Kingdom.

2      Prescribed use of approved disinfectants

Where, in accordance with the provisions of any Order made under the Law, the use of an approved disinfectant is required, the disinfectant to be used shall, unless otherwise expressly stated in that Order, be an approved disinfectant within the meaning of this Order.

3      Labels to be affixed to containers of approved disinfectants[4]

Every vessel, container or package containing an approved disinfectant shall, before being sold or offered for sale for use in connection with the provisions of any Order made under the Law, bear a label which complies with the requirements of the Diseases of Animals (Approved Disinfectants) Order 1978 of the United Kingdom.

4      Provision for sampling of approved disinfectants

Where, in accordance with the provisions of any Order made under the Law, the use of an approved disinfectant is required, the person using that disinfectant shall, if so required by an inspector, furnish the inspector with a sample of the disinfectant used, or permit the inspector to take a sample, and shall furnish the inspector with all such particulars as the inspector may reasonably require as to the name and composition of the disinfectant used.

5      Offences

If any person –

(a)     sells or offers for sale an approved disinfectant in relation to which there has been a failure to comply with the requirements of Article 3;

(b)     marks any vessel, container or package containing a disinfectant which is not an approved disinfectant with any label, statement or indication that it is an approved disinfectant; or

(c)     sells or offers for sale a disinfectant in relation to which an offence under sub-paragraph (b) has been committed,

the person shall be guilty of an offence against this Order.

6      Citation

This Order may be cited as the Diseases of Animals (Approved Disinfectants) (Jersey) Order 1958.
