Animal Welfare (Temporary Licensing Exemptions) (Jersey) Order 2007
THE MINISTER FOR PLANNING AND ENVIRONMENT, in pursuance of Article 16 of the Animal Welfare (Jersey) Law 2004[1], orders as follows –

1 Interpretation
In this Order –
“commencement date” means 1st February 2007;
“principal Law” means the Animal Welfare (Jersey) Law 2004[2];
“transitional period” means the period of 6 months beginning on 1st February 2007.
2 Temporary exemption on commencement of principal Law
(1) A business that, on the commencement date, is being carried on shall be exempt for the purposes of Article 14(1) of the principal Law.
(2) Where no application for a licence is made in respect of the business before the expiry of the transitional period, the exemption shall cease to have effect upon the expiry of that period.
(3) Where an application for a licence is made in respect of the business before the expiry of the transitional period, the exemption shall cease to have effect upon whichever is the earliest of the following occurrences –
(a) the grant of a licence to carry on the activity;
(b) the expiry of any time limit for an appeal to the Royal Court against a refusal to grant a licence to carry on the activity, without an appeal being lodged;
(c) the dismissal by the Royal Court of an appeal against a refusal to grant a licence to carry on the activity.
3 Temporary exemption for animal sanctuaries on commencement of principal Law
(1) An animal sanctuary that, on the commencement date, is being kept shall be exempt for the purposes of Article 15(1) of the principal Law.
(2) Where no application for a licence is made in respect of the animal sanctuary before the expiry of the transitional period, the exemption shall cease to have effect upon the expiry of that period.
(3) Where an application for a licence is made in respect of the animal sanctuary before the expiry of the transitional period, the exemption shall cease to have effect upon whichever is the earliest of the following occurrences –
(a) the grant of a licence to keep the animal sanctuary;
(b) the expiry of any time limit for an appeal to the Royal Court against a refusal to grant a licence to keep the animal sanctuary, without an appeal being lodged;
(c) the dismissal by the Royal Court of an appeal against a refusal to grant a licence to keep the animal sanctuary.
4 Citation
This Order may be cited as the Animal Welfare (Temporary Licensing Exemptions) (Jersey) Order 2007.
