1. These Regulations may be cited as the Phannacy Regulations. 1975.

2. In these Regulations, ~mless the context otherwise requires-

"approved" means approved by the Council:
"generic drug" means any unpatented drug and includes a drug whose

patent has expired or one hat has never been patented:
"generic name" nleans the official name or international non-

proprietary nomenclature.
"registered medical practitioner" nleans a person registered under the

Medical Act:
"terti'ary institution" means the University of Technology, Jamaica, or

any other institution approved by the Council for the training of
plmnacists;

"vocational training" means training in an approved hospital or an
approved pharmacy for the calling of a pharmacist for a period of
twelve months.

Registration:
3.-(1) Any person wishing to be registered as a pharmaceutical student

shall apply to the Council in the form set out as Form A in the First ,,
Schedule, and shall satisfy the Council that he has been admitted to an i;:,"
approved college for the purpose of pursuing a course in pharmacy.

(2) The Registrar shall cause to be entered in the Register of
Pharmaceutical Students, in respect of every person registered as a
pharmaceutical student, pursuant to subsection (1) or subsection (2) of
section 12 of the Act, in addition to his name, the following particulars-

(a) his address;
(b) his age;
(c) his qualifications and the tertiary institution in which he has

been admitted as a pharmaceutical student; and
(d) the date of his registration.

!+st 4.-(1) Subject to paragraph (2) any person wishing to be registered as a

pharniacist shall apply to the Council in the form set out as Form B in
the First Schedule. and shall satisfy the Council that he has-

(a) completed a coursc of study in pharmacy at an approved tcrtiary
institution and passed the final examination in respect of that
course: and

(h) undergone vocational training.

( 1 ~ ) A person shall be deemed to have undergone vocational
training if-

(a) prior to the 5th day of August. 1975. he was undergoing
vocational training pursuant to the Drugs and Poisons
Rcgulations. 1953 (now revoket9: and

(h) he successfully completes the period of training prescribed by
those Regulations.

(2) Notwithstanding the provisions of paragraph (1). any person who
possesses any qualification which entitles him to practise as a pliannacist in
any country other than Jamaica, may apply to the Council for registration as a

satisfy the Council-

(a) that hc posscsses such qualification;

(h) that his qualification in pharmacy is equivalent to or higher than
that required in respect of a person applying for registration under
paragraph (1); and

(c) that he has undergone practical [raining in phannacy equivalent to
the vocational training required in respect of a person applying
for registration under paragrapli (1).

( 2 ~ ) There shall be paid in respect of every person registered under
paragraph (2) as a volunteer pharmacist from overseas, a fee of fifty dollars
in United States currency or the equivalent in Jamaican currency.

( 2 ~ ) A certificate of registration issued to a volunteer pharmacist,
shall be valid for a period of three months from the date of issue
thereof.

(3) In order to satisfy the Council in accordance with sub-paragraph
(6) of paragraph (2) that his qualification is equivalent to or higher
than that required in respect of a person applying for registration under
paragraph (I), an applicant for registration under paragraph (2) may be
required to pass an examination set by the Council in one or more of the
subjects which a pharmaceutical student in an approved college would be
required to pass.

(4) There shall be paid in respect of any person registered as a
pharmacist pursuant to subsection (2) of section 11 of the Act, a registration
fee of two thousand five hundred dollars, payable upon the applicant
being notified that his application has been successful and thereafter in each
year a fee of two thousand five hundred dollars.

(5) The Registrar shall issue to every person registered pursuant to
subsection (2) of section 11 of the Act and to every person deemed to be
registered pursuant to subsection (1) of section 11 of the Act, as the case may
be, as a pharmacist, a certificate of registration in the form set out as Form :::he,
C in the First Schedule. Form C.

(5A) The validity of a certificate of registration referred to in
paragraph (5) shall expire on the 3 1st day of March each year.

(5B) The certificate of registration issued under paragraph (5) shall be
renewed on an application to the Council in the form set out as Form H in the

First Schedule upon satisfying the Council that- Schedule.

Form H.

(a) the requisite number of continuing education credits have been
attained;

(b) the applicant is capable of performing the functions of a
pharmacist;

(c) the requisite fees have been paid.

(6) The Registrar shall cause to be entered in the Register of
Pharmacists in respect of every person registered as a pharmacist pursuant
to subsection (1) or subsection (2) of section 11 of the Act, in addition to his
name, the following-

( a ) his address;

(b) his age;

(c) his qualifications and the institutions at which he has received his
training;

(d ) the date of his registration.

(7) A copy of the Register of Pharmacists shall be published in the
Gazette pursuant to subsection (2) of section 9 of the Act as soon as may
be after the 5th day of August, 1975, and once in each calendar year,
thereafter.

4~.-(1) Every person who, immediately before the 1st day of April,
2003 who is registered as a pharmacist pursuant to subsection (1) or
subsection (2) of section 11 of the Act shall apply to the Council for renewal
of registration.

(2) An application for renewal of registration in respect of a
pharmacist shall be made to the Pharmacy Council, in the form specified

FormCI. as Form C1 in the First Schedule, not later than thirty days before the
date of expiration of the certificate of registration issued in respect of that
person.

(3) The Council shall, on receipt of an application under paragraph
(2) hereof, satisfy itself that the applicant-

(a) has acquired the requisite number of Continuing Education
Credits or Continuing Professional Development Units;

(b) is otherwise capable of performing the functions of a pharmacist;
and

(c) has paid the fee for re-registration.

(4) The Council shall, subject to paragraph (3), issue to each person
registered pursuant to subsection (1) or subsection (2) of section 11 of the

FLSI Act, a certificate of registration in the form specified as Form C in the First
Schedule.

(5) A certificate of registration issued pursuant to paragraph (4) shall,
unless sooner cancelled, be valid for a period of twelve months from the date
of issue thereof.

5.-(1) Every person wishing to register the shop in which his business
is carried on as a commerciallretail pharmacy, or a manufacturing pharmacy,
or a distributiordwholesale pharmacy, or a professional pharmacy and to
register himself as the owner of that business or to renew any such
registration, as the case may be, shall apply to the Council in the form set out

application, two copies of a recent photograph of himself duly certified by a
Justice of the Peace to be a true photograph.

(2) The Council may in its discretion register any shop as a pharmacy
and the applicant as the owner of the business, pursuant to an application
made under paragraph (1) or may from time to time renew any such
registration, and upon any such registration or renewal, as the case may be,
issue to the owner of the business carried on in the pharmacy, a certificate of

(3) There shall be paid in respect of every registration (or renewal
thereof) of a shop-

(a) as a commerciallretail pharmacy, a fee of seven thousand five
hundred dollars;

(b) as a manufacturing pharmacy, a fee of ten thousand dollars;
(c) as a distributiordwholesale pharmacy, a fee of fifteen thousand

dollars; and
(d) as a professional pharmacy, a fee of six thousand dollars,

payable upon the applicant being notified that his application has been
successful.

(4) An application for the registration of a pharmacy shall be
accompanied by an inspection fee of two thousand five hundred dollars.

(5) There shall be paid in respect of every registration of a person as
the owner of a pharmacy, or the renewal of such registration, a fee of fifteen
thousand dollars.

(6) Where-

(a) a certificate of registration has expired; and

(b) an application for renewal is made after the expiration of the
month of grace,

there shall be paid, in respect of such renewal, a fee of five hundred
dollars in respect of each month or part thereof during the late
registration period.

(7) In paragraph 6-

"late registration period" means the period commencing on the day
next after the expiration of the month of grace and ending on the
date of renewal of registration;

"month of grace", in relation to any certificate of registration, means
the period of one month after the date of expiration of that
certificate.

6. The Registrar shall pursuant to subsection (4) of section 13 of the Act,
enter-

(a) in the Register of Pharmacies, in respect of any shop registered or
deemed to be registered, as the case may be, as a pharmacy-

the name and address of the business;
the name and address of the registered owner;
the name and address of the registered pharmacist in
control of, managing, or supervising the pharmacy;
the registration number;
the date of registration or renewal of registration, as the
case may be;

the date of expiry of registration; and

(6) in the Register of Owners in respect of the owner of any business
registered as a pharmacy-

(i) his name and address;

(ii) his age;

(iii) the name and address of the business in respect of which
he is registered as owner;

(iv) the date of registration;

(v) if the business is operated by a company or partnership,
the name and address of every shareholder or officer of
that company or of every partner, as the case may
require; and

(vi) a notation of the fact that he is of good character and has
no criminal record which, in the opinion of the Council,
could impinge on the practice of the profession of
Pharmacy;

(vii) a notation of the fact that the registration fee has been
paid;

(viii) the names of two character references from among the
following-

(A) Registered Pharmacist;

(B) Justice of the Peace;

(C) Police Officer above the rank of Inspector;

(D) Resident Magistrate or Notary Public;
(ix) a notation of the fact that the Council is satisfied that the

applicant is a fit and proper person to be registered as the
owner of a pharmacy.

Disciplinary Proceedings andAppeals:

7.-(1) Where an allegation is made to the Council that any registered
pharmacist or pharmaceutical student (in these Regulations referred to as
"respondent") has been convicted of a criminal offence or is guilty of
professional misconduct, the Council shall direct the Registrar to make such
further investigations in relation to the allegation as he thinks necessary, and
the Registrar shall report thereon to the Council, stating whether or not the
allegation made against the respondent has been substantiated.

(2) The Registrar may, at any stage of his investigations into any
allegation as aforesaid, take advice from any attorney-at-law appointed by
the Council, and may obtain proof of evidence in support of the allegations
made against the respondent, and may, in such cases as he thinks fit, decline
to proceed with the investigation, unless the evidence in support of the
allegations (other than evidence of a conviction) is verified by statutory
declaration.

(3) Where it is proved by a certificate of the competent officer of
the Court in which the proceedings took place, that the respondent has
been convicted of a criminal offence and that such conviction has not
been subsequently quashed on appeal, the Registrar shall so inform the
Council and the Council may forthwith and without further enquiry,
direct the Registrar to remove the name of the respondent from the
register.

(4) The Registrar shall invite the respondent to furnish any written
statement or explanation which he may wish to submit in relation to any
allegation that he is investigating, and shall consider such statement or
explanation before taking a decision on the matter.

(5) For the purposes of this regulation, the following shall be
considered to be professional misconduct-

theft or u n l a h l possession of drugs or poisons;
conspiring to procure a miscarriage;

unlawfdly procuring or attempting to procure a miscarriage;

being under the influence of alcohol or drug which renders lum
incoherent, while performing his duties as a pharmacist or
pharmaceutical student, as the case may be;
altering or causing to be altered in any way the prescription of a
registered medical practitioner or a registered dentist, a registered
veterinary surgeon or vetcrinary practitioner without the
knowledge and consent of such practitioner, dentist or veterinary
surgeon or veterinary practitioner;

publishing and distributing material of a pornographic or other-
wise objectionable nature;

dividmg with a registered medical practitioner, profits derived
from the filling of prescriptions issued by that medical
practitioner;

errors in dispensing due to negligence: and

any breach committed under section 26 of the Act.

8.-(1) Where the Council, upon examination of the report of the
Registrar made to them on his investigations pursuant to regulation 10.
decide that disciplinary proceedings should be held in respect of the
allegation, they may fix a date for hearing the matter and may direct the
attorney-at-law appointed by them to take all necessary steps for verifying
the evidence to be submitted to them, for obtaining the necessary documents
and for ensuring the attendance of witnesses at the hearing.

(2) The Registrar shall send to the respondent a notice in writing,
specifying the nature and particulars of the allegation against him and
informing him of the time and place of the meeting of the Council at which
the matter will be heard.

(3) A notice under paragraph (2) shall be sent to the respondent by
registered post to his address entered in the register or if the Registrar has
reason to believe that that address is not his present address, then to any other
address which may be known to the Registrar. and shall be posted so as to
allow at least twenty-one days to elapse between the date of posting and the
date fixed for the hearing.

(4) Where there is a complainpt in any matter fixed for hearing
before the Council, the Registrar shall send him a copy of the notice sent to
the respondent under paragraph (2).

(5) Any party to any proceedings being held under the provisions of
this regulation may be represented at the hearing by an attorney-at-law or
other person so. however. that if any such p'arty intends to be so represented
at the hearing, he shall give not less than seven days' notice of the intenti011
to the Registrar.

9.-(1) At the hearing of any matter the attorney-at-law, Registrar or
other person appointed by the Council for that purpose, shall state to the
Council the allegation against the respondent, the facts of the case, and
submit evidence in support of the allegation, and the respondent or his
representative shall be entitled to cross-examine any witness appearing in
support of the allegation against hm.

(2) At the conclusion of the statement of the allegation against the
respondent and the evidence in support thereof, the respondent or his
representative shall be invited by the chairman to address the Council
and to tender evidence in answer to the charge, and the attorney-at-
law, Registrar or other person appointed by the Council for the purpose
shall be entitled to cross-examine the respondent or any witness giving
evidence on his behalf, and to reply on the whole matter after the
respondent or his representative has replied.

10. If the respondent, after proper notice, does not attend either
personally or by a representative at a proposed hearing of allegations
against him, the Council may proceed to hear and determine the matter
in his absence.

tion 16 are understood by the person receiving the poison, and shall cause
the person receiving such poison to sign his name beside the relevant entry in
a book in which shall be recorded the following-

date of transaction;

name, address and occupation of the person to whom the poison
is being sold, dispensed or delivered;

name and quantity of poison sold, dispensed or delivered, or
where the poison is an ingredient of a preparation, the proportion,
of poison;

the purpose for which the poison is required;

where the person to whom the poison is being delivered is not
known to the person selling, dispensing or delivering same,
the name and address of a witness to the transaction, and where
there is no witness to the transaction, the name and address
of the person giving a recommendation in respect of the
transaction;

signature of the person receiving the poison; and

signature of the person selling, dispensing or delivering the
poison.

17.-(1) No person shall sell, dispense or deliver any liniment, em-
brocation, lotion or similar caustic substance containing poison unless such
substance is in a container-

(a) which is so constructed as to prevent leakage arising from the
ordinary risks of handling, and which is impervious to poison;
and

(b) to which is affixed a label giving notice that the contents shall not
be taken orally.

(2) Where a person sells, dispenses or delivers any substance
mentioned in paragraph (1) in a bottle of a capacity of not more than 120
fluid ounces, the outer surface of that bottle shall be flubed vertically with
ribs or grooves easily discernable by touch.

18. No person shall transport any poison unless-

(a) it is adequately packed to avoid leakage arising from the ordinary
risks of handling;

(b) the outside of the package containing the poison is labelled
conspicuously with the name and description of the poison and
with a notice indicating that it is to be kept separate from food
and food containers; and

(c) adequate precautions are taken to prevent the risk of con-
taminating food.

19.-(1) No person shall sell arsenic unless before such sale, the arsenic
is mixed with soot or indigo in the proportion of at least one ounce of soot or
half an ounce of indigo to one pound of arsenic, so, however, that this
provision shall not apply-

(a) when such arsenic is an ingredient of any medicine required to
be made up or compounded in accordance with the prescription
of a registered medical practitioner, a registered dentist or a
registered veterinary surgeon or veterinary practitioner; or

(b) to wholesale dealers supplying arsenic upon order in writing in
the ordinary course of wholesale dealing; or

(c) where such arsenic is stated by the person receiving same to be
required for some purpose other than use in agriculture, and it is
established that such mixture would render the arsenic unfit for
the purpose for which it is being obtained and the arsenic is
delivered in quantities of not less than ten pounds on each
occasion.

Miscellaneous:
20.-(1) Every prescription for a poison shall be in writing and shall

incude the following-

(a) the date;

(b) the name and address of the person for whom the prescription is
issued;

(c) the name and quantity of the substance to be supplied;

(d) adequate directions for the use of the substance prescribed;

(e) the usual legible signature of the prescriber; and

u> where the prescription is given by a registered dentist or
registered veterinary surgeon or veterinary practitioner, the words
"for dental treatment only" or "for treatment of animals only", as
the case may require.

(2) A prescription for a drug may-

(a) be in writing;

(b) be communicated verbally by a registered medical practitioner,
which verbal communication shall be validated pursuant to
paragraph (4);

(c) be transmitted by facsimile, or other electronic means to a
pharmacist by a registered medical practitioner.

(3) A person selling a drug pursuant to a written prescription
shall retain such prescription for at least two years from the date of filling
thereof.

(4) A person to whom a prescription for a drug has been com-
municated verbally by a practitioner shall forthwith reduce the pre-
scription to writing (which shall be validated by the practitioner within
thirty-six hours) and shall, upon the filling thereof, retain that validated
prescription for a period of not less than two years from the date of the filling
thereof.

(5) Every prescription for a drug shall include the following-

(a) the date;

(b) the name, age and address of the person for whom the pre-
scription is issued;

(c) the name, the generic name, and the quantity of the substance to
be supplied;

(d) adequate directions for the use of the substance prescribed;

(e) the usual signature of the prescriber and his name in legible print
form;

u> the address, telephone number and registration number of the
prescriber;

(g) where the prescription is given by a registered dentist or registered
veterinary surgeon or veterinary practitioner, the words "for
dental treatment only" or "for treatment of animals only", as the
case may require.

21.-(1) Any person who hspenses, compounds, retails or supplies any
drug other than in accordance wilh the prescriplion of a registered medical
practioner, registered dentist or registered veterinary surgeon or veterinary
practitioner shall delivcr such drug in a container labellcd with-

(a) the name of the drug;

(b) adequate directions for use;

(c) words of caution respecting the drug, if necessary.

(2) A pcrson who dispenses, retails or supplies any drug whether
over the counter or in accordance with the prescription of a registered
medical practitioner, registered dentist or registered veterinary surgcon or
veterinary practitioner shall, where therc is available a bioequivalent generic
drug which is interchangeable with the na~ncd drug and which is less costly.
infonn the person requesting the drug of those facts, and shall supply the
generic equivalent instead of the named drug, except where the person
objects or declines to accept the generic form.

(3) Every person who dispenses or, as the casc may be, retails or
supplies over the counter any drug which caries a brand name shall erect and
maintain a prominent sign informing persons of the availability of the
generic drug which is the bioequivalent of the drug carrying the brand
name.

22.-(1) No prescription shall be dispensed inore than once unless it
is dispensed in accordance with the directions of the prescriber included in
the prescription to the effect that it may be dispensed at stated intervals, a
stated number of times or whenever necessary.

(2) Where a prescription-

(a) includes a direction that it may be dispensed a stated number of
times but does not include any direction as to the intervals at
which it may be dispensed, such prescription shall not be
dispensed more often than once in three days; or

(h ) includes a direction that it may be dispensed a1 slated intervals
but does not include any direction as to the number of times it
may be dispensed, such prescription shall not be dispensed more
than three times:

(c) where a prescription specifies that there should be multiple
repeats, that prescription shall be valid for twelve months froin
the date of original issue.

(3) Every person filling a prescription shall, at the time of
dispensing. note on the prescription-

( a ) the date on which it is dispensed:

(b) the strength and quantity of the drug dtspensed:

(c) the name of the manufacturer of the drug dtspensed;

(LO the name of any generic substitution made, together with the
name of the manufacturer of that drug;

(e) his signature and registration number in a legible manner.

(4) Every pharmacist shall be entitled to practise his profession
in Jamaica and to demand and recover any reasonable charges for his
services.

23. No person shall transmit by post any drug or poison unless the
package containing such drug or poison is transmitted by registered
post.

24. Every antibiotic and other drug or poison which requires special
storage arrangements shall be stored in accordance with the temperature and
other storage requirements specified by the manufacturer in respect of that
antibiotic, drug or poison.

General:
26.-(1) Where a certificate of registration or authorization issued

pursuant to the Act is lost, destroyed or defaced, the person to whom that
certificate was originally issued may apply to the Council for a duplicate
certificate.

(2) Every application for a duplicate certificate pursuant to para-
graph (1 ) shall be made in the relevant application form set out in the F,t
First Schedule in respect of an application for registration or authorization, S"ule.
as the case may require, and shall be accompanied by-

(a) an explanation as to why the duplicate certificate is required; and

(b ) the same number o i photographs (if any) required in the case
of an application for an original certificate.

(3) The Registrar may issue to any person applying for a duplicate
certificate pursuant to paragraph (I), a certificate in the relevant fonn set out

in the First Schedule, clearly marked in bold lettering with the word
"DUPLICATE?'.

(4) There shall be paid in respect of any duplicate certificate issued
under this regulation a fee of two thousand five hundred dollars.

(5) The holder of a certificate of registration shall, w h e r e

(a) he has relocated the pharmacy;

(h) there is a new pharmacist working at the pharmacy: or

(c) there is a change in the ownership of the pharmacy,

apply for an amendment to that certificate of registration and pay a fee of five
hundred dollars.

27. All records and books required by these regulations to be kept by
any person, shall be open to inspection by 'my inspector or other officer
appointed under the Act, at all reasonable times, and it shall be lawful
for any such inspector or officer to make a copy or extract from any such
records or books.

28. Any person who contravenes any provision of these Regulations
shall be guilty of an offence and shall be liable, on summary conviction
in a Resident Magistrate's Court, to a fine not exceeding fifty thousand
dollars or to imprisonment with or without hard labour for a term not
exceeding six months.
