OIREACHTAS (ALLOWANCES TO MEMBERS) AND MINISTERIAL AND PARLIAMENTARY OFFICES (AMENDMENT) ACT, 1992 (ALLOWANCES) (AMENDMENT) REGULATIONS, 1998.
I, CHARLIE McCREEVY, Minister for Finance, in exercise of the powers conferred on me by sections 3 (4) (as amended by section 19 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary, Judicial and Court Offices (Amendment) Act, 1998 (No. 5 of 1998)) and 5A (inserted by section 20 of the Act aforesaid) of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (No. 3 of 1992), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (Allowances) (Amendment) Regulations, 1998.
(2) These Regulations shall be deemed to have come into operation on the 6th day of June, 1997.

2. The Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (Allowances) (No. 2) Regulations, 1992 ( S.I. No. 397 of 1992 ), are hereby amended—
(a) in Regulation 3—
(i) in paragraph (a), by the substitution of "£4,000" for "£2,310", and
(ii) in paragraph (b), by the substitution—
(I) in subparagraph (i), of "£2,000" for "£750",
(II) in subparagraph (ii), of "£4,000" for "£2,500", and
(III) in subparagraph (iii), of "£6,400" for "£4,000",
(b) in paragraph (b) of Regulation 4, by the substitution—
(i) in subparagraph (i), of "£10,650" for "£6,150",
(ii) in subparagraph (ii), of "£9,770" for "£5,640", and
(iii) in subparagraph (iii), of "£8,880" for "£5,130",
(c) in Regulation 5, by the substitution of "£3,000" for "£1,540",
(d) in Regulation 6, by the substitution of "£6,660" for "£2,560",
(e) in Regulation 7 (inserted by the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1992 (Allowances) (Amendment) Regulations, 1996 ( S.I. No. 315 of 1996 )), by the substitution—
(i) in paragraph (1)(b), of "£5,000" for "£2,600", and
(ii) in paragraph (2), of "£2,500" for "£1,300",
and
(f) by the insertion of the following Regulation after Regulation 9:
"9A. (1) Where, in relation to a member of either House of the Oireachtas, in any year—
(a) there is an excess referred to in Regulation 4(2)(d) of the Oireachtas (Allowances to Members) (Telephone and Postal Facilities) Regulations, 1998 ( S.I. No. 99 of 1998 ), or
(b) after effect has been given to the said Regulation 4(2)(d) in relation to such an excess, part of the excess remains,
the amount of the allowance payable to the member in that year under these Regulations shall, subject to paragraph (2) of this Regulation, be reduced by the amount of the excess or part, as the case may be.
(2) Where, in a case in which paragraph (1) of this Regulation applies, the member concerned has paid any of the amount of the excess referred to in subparagraph (a) of that paragraph or of the part referred to in subparagraph (b) of that paragraph, the amount of the reduction provided for by that paragraph shall be adjusted accordingly.".

EXPLANATORY NOTE.
These Regulations increase the amount of certain expense allowances payable to Members of the Houses of the Oireachtas and Parliamentary Office holders.
