I, JOAN BURTON, Minister for Social Protection in exercise of the powers conferred on me by section 4 (amended by section 96 of the Ministers and Secretaries (Amendment) Act 2011 (No. 10 of 2011)) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), and by section 198 (amended by section 7 of the Social Welfare and Pensions Act 2010 (No. 37 of 2010)) of the Social Welfare Consolidation Act 2005 , with the consent of the Minister for Public Expenditure and Reform, hereby make the following Regulations:
Citation and construction.
1. (1) These Regulations may be cited as the Social Welfare (Consolidated Supplementary Welfare Allowance) (Amendment) (No. 2) (Rent Supplement) Regulations 2013.
(2) These Regulations and the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 to 2013 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 to 2013.
Definition.
2. In these Regulations—
“Principal Regulations” means the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 2007 ( S.I. No. 412 of 2007 );
“Regulations of 2011” means the Social Welfare (Supplementary Welfare Allowance) (Amendment) (No. 5) Regulations 2011 ( S.I. No. 729 of 2011 ).
Commencement.
3. These Regulations come into operation on 17 June 2013.
Entitlement to rent supplement.
4. Article 9(2) of the Principal Regulations is amended by substituting the following paragraph for paragraph (i) (amended by article 5 of the Regulations of 2011):
“(i) a designated person is satisfied that—
(i) the claimant is in need of accommodation and is unable to provide for it from his or her own resources,
(ii) the residence is reasonably suited to the residential and other needs of the claimant, and
(iii) the rent payable by the claimant is just and proper having regard to the nature, character and location of the residence,
and for this purpose, the appropriate maximum amount of rent in respect of which a supplement is payable for the period commencing on 17 June 2013 and ending on 31 December 2014 shall be—
(I) the monthly amount set out in Schedule 1 in respect of such class of claimant referred to in columns (2) to (8) of the said Schedule, and
(II) the monthly amount as determined by the Minister in respect of any other class of claimant,
having regard to the circumstances and location of the residence of such claimant,
and”.
Maximum rent limits.
5. The Principal Regulations are amended by substituting the following Schedule for Schedule 1 (amended by article 7 of the Regulations of 2011):

EXPLANATORY NOTE
(This note is not part of the Instrument and does not purport to be a legal interpretation.)
These regulations provide for new maximum monthly rent limits for the purposes of the payment of the Rent Supplement under the Supplementary Welfare Allowance scheme. These new limits come into operation on 17 June 2013 and will be effective until 31 December 2014.
