AN ACT TO AMEND THE LAWS OF GIBRALTAR FOLLOWING THE COMING INTO EFFECT OF THE GIBRALTAR CONSTITUTION ORDER 2006. Title and commencement. 1. This Act may be cited as the Gibraltar Laws (General Amendment) (No.1) Act 2007 and shall come into operation on the day of publication. Amendments relating to references to “Ordinance”. 2. In accordance with section 33(5) of Annex 1 to the Gibraltar Constitution Order 2006 all Acts and other statutory instruments in which the word “Ordinance” appears shall be amended by substituting for the word “Ordinance” the word “Act”. Amendments relating to references to “House of Assembly”. 3. In accordance with section 25(1) of Annex 1 to the Gibraltar Constitution Order 2006 all Acts or other statutory instruments in which the words “House of Assembly” appear are amended by substituting for the words “House of Assembly” the word “Parliament”. Amendments relating to references to “Financial & Development Secretary”. 4. Acts and other statutory instruments listed in the first column of the table in Schedule 1 are amended by substituting for the reference therein to the words “Financial and Development Secretary” in the sections or parts specified in the second column, such words as are set out adjacent thereto in the third column. Amendments relating to references to “Attorney General”. 5. Acts and other statutory instruments listed in the first column of Schedule 2 are amended by substituting for the references to the words “Attorney General” in the sections or parts specified in the second column such words as are set out adjacent thereto in the third column. Amendments relating to references to “Gibraltar Council”. 6.(1) Acts and other statutory instruments listed in Schedule 3 are amended with regard to references to the Gibraltar Council in accordance with the provisions of that Schedule. (2) Schedule 3 has effect in relation to all amendments and repeals set out in that Schedule.

Acts and other statutory instruments listed in the first column of Schedule 4 are amended by substituting for the words “Deputy Governor” in the sections or parts specified in the second column such words as are set out adjacent thereto in the third column. Amendments relating to references to “Governor”. 8. Acts and other statutory instruments listed in the first column of Schedule 5 are amended by substituting for the references to the word “Governor” in the sections or parts specified in the second column such words as are set out adjacent thereto in the third column. Other Amendments, Repeals and Interpretation. 9. Schedule 6 shall have effect. 10. In this Act “statutory instruments” means any Regulation, Rule, Order, Notice or other law or instrument having the effect of law. 11. All headings and titles in any Act or statutory instrument amended by this Act shall be amended or deleted to reflect the amendments effected by this Act. 12.(1) In this section the phrase “any person” means the Governor, the Deputy Governor, the Financial and Development Secretary or the Attorney General. (2) Where, in any Act or statutory instrument to which this Act refers the word or words referring to any person are replaced by the word “Government” then−
(a) any phrase using the personal pronoun referring back or
forward to any person is replaced by the impersonal pronoun referring back or forward to the government. Thus, and by way of example, “he shall” becomes “it shall” and “he considers” becomes “it considers”; and
(b) the phrase “under his hand” referring back to the Governor is
deleted.

1. Oaths Act.
(1) Section 4 is repealed. (2) Section 10(2) is repealed.
2. Public Health Act. Section 242 and 243 are amended by deleting the words “after consultation with the Gibraltar Council”.
3. Interpretation and General Clauses Act. Section 2 is amended by deleting the words “Gibraltar Council means the Gibraltar Council of Gibraltar”.
4. Public Services Ombudsman Act 1998.
(1) Section 18(2)(a)(iii) and (3) are amended by deleting the words “Gibraltar Council”.

MISCELLANEOUS AMENDMENTS
1. Amendment of the Interpretation and General Clauses Act. Section 70 of the Interpretation and General Clauses Act is repealed. 2. Financial Year Act. The Financial Year Act is repealed. 3. Births and Deaths Registration Act. (1) The Births and Deaths Registration Act is amended as follows−
(a) any reference to “minister” in the Act as it stands prior to the coming into operation of this Act is amended by substituting the word “minister” for the words “minister of religion”;
(b) in section 2 in the appropriate place insert the following
definition−
“ “Minister” means the Minister responsible for personal status;”.
(2) Section 5(4) of the Births and Deaths Registration Act is amended by deleting the words “for the information of the Governor”. 4. Oaths Act. Section 4 of the Oaths Act is repealed. 5. Clubs Act. (1) Section 2 is amended in the definition of “club” by deleting the words “under the permission of the Governor”. (2) Sections 12 and 13 of the Clubs Act are repealed. 6. Telegraph (Censorship and Control) Act. The Telegraph (Censorship and Control) Act is repealed. 7. Cemetery Act.

(1) The Cemetery Act is amended in section 1A by inserting in the appropriate place the following definition−
“ “Minister” means the Minister responsible for the environment;”. (2) The Cemetery Act is amended in section 5(4) by deleting the words “for the information of the Governor”. 8. Administrator General Act. The Administrator General Act is amended in section 2 by inserting in the appropriate place the following definition−
“ “Minister” means the Minister responsible for justice”. 9. Education and Training Act. The Education and Training Act is amended−
(a) in section 2 by substituting for the definition of “Minister” the following definition−
“ “Minister” means the Minister with responsibility for education;”; and
(b) in section 86(1)(c) by deleting the words “by the Governor”.
10. Imports and Exports Act 1986. The Imports and Exports Act 1986 is amended in the heading to Part XI by deleting the words “the Governor”. 11. Commissions of Inquiry Act. The Commissions of Inquiry Act is amended in the Long Title by substituting for “Governor”, “Government”. 12. Currency Notes. Rule 18(5) of the Currency Notes Rules is amended by deleting the words “for the information of the Governor and the Deputy Governor shall furnish copies of the report to the Principal Auditor and the Commissioner”. 13. Pensions Regulations. The Pensions Regulations are amended in regulation 26(2)(b) by deleting the words “either to the Secretary of State or to the Deputy Governor” and substituting therefor the words “to the Chief Secretary”.

14. Companies Act. Section 17(2)(e) of the Companies Act is deleted and replaced with:
“(e) includes any word or expression for the time being specified in regulations made under subsection (4) of this section:
Provided that the Minister shall not consent under subsection
(2)(a) to the use of the words “Royal” or “Windsor” or “Crown” or to any name which suggests or is calculated to suggest the patronage of Her Majesty or of any member of the Royal Family or connection with Her Majesty’s Government in the United Kingdom without the prior written consent of the Governor.”.
15. Medical (Gibraltar Health Authority) Act. Section 6(2)(i) of the Medical (Gibraltar Health Authority) Act is amended by deleting the words “by the Governor”. 16. Marriage Act. In section 2(a) of the Marriage Act, after the word “Governor” insert “in his capacity as Commander in Chief”. 17. Education and Training Act. Section 4(1) of the Education and Training Act is amended by deleting the words “, other than such provisions as the Governor may by order in the Gazette specify”.
