amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2015/1274]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) No 686/2012 of 26 July 2012 allocating to Member States, for the purposes of the renewal procedure, the evaluation of the active substances whose approval expires by 31 December 2018 at the latest (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Regulation (EU) No 187/2013 of 5 March 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance ethylene (2) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Regulation (EU) No 190/2013 of 5 March 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance sodium hypochlorite (3) is to be incorporated into the EEA Agreement.

(4)

Commission Implementing Regulation (EU) No 365/2013 of 22 April 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance glufosinate (4) is to be incorporated into the EEA Agreement.

(5)

Commission Implementing Regulation (EU) No 369/2013 of 22 April 2013 approving the active substance potassium phosphonates, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (5) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) No 485/2013 of 24 May 2013 amending Implementing Regulation (EU) No 540/2011, as regards the conditions of approval of the active substances clothianidin, thiamethoxam and imidacloprid, and prohibiting the use and sale of seeds treated with plant protection products containing those active substances (6) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) No 532/2013 of 10 June 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance carbon dioxide (7) is to be incorporated into the EEA Agreement.

(8)

Commission Implementing Regulation (EU) No 781/2013 of 14 August 2013 amending Implementing Regulation (EU) No 540/2011, as regards the conditions of approval of the active substance fipronil, and prohibiting the use and sale of seeds treated with plant protection products containing this active substance (8) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) No 790/2013 of 19 August 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance acetic acid (9) is to be incorporated into the EEA Agreement.

(10)

Commission Implementing Regulation (EU) No 798/2013 of 21 August 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance pyrethrins (10) is to be incorporated into the EEA Agreement.

(11)

Commission Implementing Regulation (EU) No 1089/2013 of 4 November 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance kieselgur (diatomaceous earth) (11) is to be incorporated into the EEA Agreement.

(12)

Commission Implementing Regulation (EU) No 1124/2013 of 8 November 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance bifenox (12) is to be incorporated into the EEA Agreement.

(13)

Commission Implementing Regulation (EU) No 1150/2013 of 14 November 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance rape seed oil (13) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) No 1165/2013 of 18 November 2013 approving the active substance orange oil, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011 (14) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) No 1166/2013 of 18 November 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance dichlorprop-P (15) is to be incorporated into the EEA Agreement.

(16)

Commission Implementing Regulation (EU) No 1178/2013 of 20 November 2013 amending Implementing Regulation (EU) No 540/2011 as regards the conditions of approval of the active substance ethoprophos (16) is to be incorporated into the EEA Agreement.

(17)

Commission Implementing Decision 2012/191/EU of 10 April 2012 allowing Member States to extend provisional authorisations granted for the new active substances amisulbrom, chlorantraniliprole, meptyldinocap, pinoxaden, silver thiosulphate and tembotrione (17) is to be incorporated into the EEA Agreement.

Commission Implementing Decision 2012/363/EU of 4 July 2012 allowing Member States to extend provisional authorisations granted for the new active substances bixafen, Candida oleophila strain O, fluopyram, halosulfuron, potassium iodide, potassium thiocyanate and spirotetramat (18) is to be incorporated into the EEA Agreement.

Commission Implementing Decision 2013/38/EU of 18 January 2013 allowing Member States to extend provisional authorisations granted for the new active substances emamectin and maltodextrin (19) is to be incorporated into the EEA Agreement.

(20)

Commission Implementing Decision 2013/205/EU of 25 April 2013 allowing Member States to extend provisional authorisations granted for the new active substances acequinocyl, aminopyralid, ascorbic acid, flubendiamide, gamma-cyhalothrin, ipconazole, metaflumizone, orthosulfamuron, Pseudomonas sp. strain DSMZ 13134, pyridalil, pyroxsulam, spiromesifen, thiencarbazone and topramezone (20) is to be incorporated into the EEA Agreement.

(21)

Commission Implementing Decision 2013/431/EU of 12 August 2013 allowing Member States to extend provisional authorisations granted for the active substances benalaxyl-M and valifenalate (21) is to be incorporated into the EEA Agreement.

(22)

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement shall be amended as follows:

Article 2

The texts of Implementing Regulations (EU) No 686/2012, (EU) No 187/2013, (EU) No 190/2013, (EU) No 365/2013, (EU) No 369/2013, (EU) No 485/2013, (EU) No 532/2013, (EU) No 781/2013, (EU) No 790/2013, (EU) No 798/2013, (EU) No 1089/2013, (EU) No 1124/2013, (EU) No 1150/2013, (EU) No 1165/2013, (EU) No 1166/2013 and (EU) No 1178/2013 and Implementing Decisions 2012/191/EU, 2012/363/EU, 2013/38/EU, 2013/205/EU and 2013/431/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 1 October 2014, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (22), or on the day of the entry into force of Decision of the EEA Joint Committee No 203/2014 of 30 September 2014 (23), whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
