amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex I to the Agreement was amended by Decision of the EEA Joint Committee No 31/2003 of 14 March 2003(1).

(2) Council Decision 2000/766/EC of 4 December 2000 concerning certain protection measures with regard to transmissible spongiform encephalopathies and the feeding of animal protein(2) is to be incorporated into the Agreement.

(3) Commission Decision 2001/9/EC of 29 December 2000 concerning control measures required for the implementation of Council Decision 2000/766/EC concerning certain protection measures with regard to transmissible spongiform encephalopathies and the feeding of animal protein(3) is to be incorporated into the Agreement.

(4) Commission Decision 2001/165/EC of 27 February 2001 amending as regards hydrolysed proteins Decision 2001/9/EC concerning control measures required for the implementation of Council Decision 2000/766/EC concerning certain protection measures with regard to transmissible spongiform encephalopathies and the feeding of animal protein(4) is to be incorporated into the Agreement.

(5) Commission Decision 2002/248/EC of 27 March 2002 amending Council Decision 2000/766/EC and Commission Decision 2001/9/EC with regard to transmissible spongiform encephalopathies and the feeding of animal proteins(5) is to be incorporated into the Agreement.

(6) This Decision is not to apply to Liechtenstein,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex I to the Agreement shall be amended as follows:

1. The following point shall be inserted after point 10 (Council Directive 90/167/EEC) in Part 7.1:

"11. 32000 D 0766: Council Decision 2000/766/EC of 4 December 2000 concerning certain protection measures with regard to transmissible spongiform encephalopathies and the feeding of animal protein (OJ L 306, 7.12.2000, p. 32), as amended by:

- 32002 D 0248: Commission Decision 2002/248/EC of 27 March 2002 (OJ L 84, 28.3.2002, p. 71).

This act applies also to Iceland for the areas covered by the specific acts to which reference is made in paragraph 2 of the introductory part."

2. The following point shall be inserted after point 15 (Commission Decision 2000/159/EC, deleted) in Part 7.2:

"16. 32001 D 0009: Commission Decision 2001/9/EC of 29 December 2000 concerning control measures required for the implementation of Council Decision 2000/766/EC concerning certain protection measures with regard to transmissible spongiform encephalopathies and the feeding of animal protein (OJ L 2, 5.1.2001, p. 32), as amended by:

- 32001 D 0165: Commission Decision 2001/165/EC of 27 February 2001 (OJ L 58, 28.2.2001, p. 43),

- 32002 D 0248: Commission Decision 2002/248/EC of 27 March 2002 (OJ L 84, 28.3.2002, p. 71).

This acts applies also to Iceland for the areas covered by the specific acts to which reference is made in paragraph 2 of the introductory part."

Article 2

The texts of Decisions 2000/766/EC, 2001/9/EC, 2001/165/EC and 2002/248/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 21 June 2003, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(6).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
