GOVERNMENT REGULATION of 26 September 2012 amending Government Regulation no. 112/2008 Coll., Laying down certain conditions for the provision of national complementary payments to direct aid, as amended Government directs pursuant to § 2b par. 2 Act no. 252 / 1997 Coll., on agriculture, as amended by Act no. 128/2003 Coll., Act no. 441/2005 Coll. and Act no. 291/2009 Coll., § 1 par. 3 of Law no. 256/2000 Coll., on the State Agricultural Intervention Fund and amending certain other laws (the State Agricultural Intervention Fund), as amended by Act no. 441/2005 Coll. and Act no. 291/2009 Coll .: Article. I Decree no. 112/2008 Coll., Laying down certain conditions for the provision of national complementary payments to direct aid, as amended Government Regulation no. 480/2009 Coll., And Government Regulation no. 86/2010 Coll. and Government Regulation no. 107/2012 Coll., is amended as follows: 1. In § 1 and § 13 para. 4, the words "European Communities" is replaced by "European Union". 2. In § 2 para. 2 "15. May "is replaced by" 1. November ". 3. In § 2 paragraph 3 is deleted. 4. In footnote no. 5, the words "Art. 124 paragraph. 1 "is replaced by" Article. 122 paragraph. 1 ". 5. In § 5 para. 2, the word "list" is replaced by "overall assessment" and the words "including placing their acreage," shall be deleted. 6. § 6 par. 3 and par. 4 point. a) after the word "birth" the words "or data registration in the central register". 7. In § 7 para. 1 and § 8 par. 1, "July 1 to 31" is replaced by "Dec. 1 to 31". 8. In § 7 para. 1 and § 8 par. 1, "led by the Breeding Act" are deleted. 9. In § 7, paragraph 2 reads: "(2) The applicant shall demonstrate the Fund by 28 February of the following calendar year, the central document of evidence proving the status of sheep or goats kept by the applicant for at least 1 to 31 December of the calendar year, including identification numbers and dates of birth or registration data in a central register, according to data from the central records, and the calculation of livestock units. ". 10. In § 8 paragraph 2 reads: "(2) The applicant shall demonstrate the Fund by 28 February of the following calendar year, the central document of evidence proving the status cow suckler bred by the applicant for a minimum period December 1 to 31 of the calendar year, including identification numbers and dates of birth or registration data in a central register, according to data from the central records, and the calculation of livestock units. ". 11th Footnote. 20 reads: "20) Decree no. 60/2012 Coll., Laying down certain conditions for granting special aid to farmers.". 12. § 9 including the title reads: "§ 9 Payment to agricultural land (1) An applicant for payment for agricultural land may be a natural or legal person who, in the calendar year filed an application for single area payment under § 3 of Government Regulation no. 47/2007 Coll., laying down certain conditions for providing single area payment farmland and some conditions for the provision of information about the processing of agricultural products originating aside land. (2) The Fund shall give the applicant a payment to agricultural land, on which the applicant in the calendar year requested and fulfilled the conditions for granting the single payment scheme agricultural land under § 4 of the Government Regulation no. 47/2007 Coll., Laying down certain conditions for the provision of the single payment on the surface of agricultural land and certain conditions for the provision of information about the processing of agricultural products originating aside land. ". 13. In § 10 paragraph. 1 and 2, the words "2007/2008 marketing year" are replaced by "the marketing year 2011/2012." 14. In § 10 paragraph. 1, "31 March 2007" is replaced by "31 March 2011". 15. In § 10 paragraph. 2, the word "copy" is replaced by "copy". 16. In § 11, the words "30 November of the" replaced "by 30 April of the following" and the words "provisions of the European Community" is replaced by "directly applicable regulation of the European Union". 17. In § 12 paragraph 3-5 deleted. Former paragraphs 6-10 shall be renumbered 3 to 7 18. In § 12 para. 3 and 4, the words "31 July" is replaced by "at least December 1 to 31". 19. In § 12 paragraph 8, which including footnote no. 21 reads as follows: "(8) If the total amount of payments under § 5-10, which is to be based on the applicant's request is granted after reduction by the regulations of the European Union-21) is less than CZK 500 fund payment to the applicant does not provide this. 21) Art. 7, 10, paragraph 132. 2 point. a) and. 5 of Council Regulation (EC) no. 73/2009, as amended.
