370/2001 Coll. DECREE of the Ministry of Health dated 12 October 2001 on the test of professional competence to perform professional supervision over the use and protection of natural medicinal resources and sources of natural mineral waters Department of Health determined in accordance with § 46 para. 1 point. i) of the Act no. 164/2001 Coll., on natural healing sources, sources of natural mineral water, natural spas and spa locations and amending certain related acts (Spa Act), (hereinafter the "Act") § 1 (1) a certificate of professional competence of a natural person to perform professional supervision over the use and protection of natural medicinal resources and sources of natural mineral waters (hereinafter referred to as "supervision") is obtained by verifying professional knowledge exam on the professional competence of natural persons for professional supervision (hereinafter referred to as "professional competence '). (2) An application for a test of professional competence (hereinafter referred to as "application") made by the natural person who intends to carry out supervision, (hereinafter referred to as the "applicant"), the Ministry of Health (hereinafter the "Ministry"), no later than 30 calendar days before the deadline for passing the exam (§ 2 para. 1). In the application the applicant shall: a) name, surname, title, personal identification number or identity card number ^ 1) and permanent address, telephone number, or fax number or electronic communication, b) educational attainment, type and length of experience and specialization in which was done. (3) To request the applicant accompanied by documents certifying the facts referred to in paragraph 2. b) or an officially certified copies of these documents. § 2 (1) The test of professional competence (hereinafter referred to as "test") takes place before an examination board (§ 4) in terms specified by the Ministry. Dates of exams ministry published in the Bulletin of the Ministry of Health and on its website no later than March 1 of each calendar year, so that the first examination date has been set for the first 60 calendar days from the date of publication. (2) The exam is oral. Examination verifies the knowledge a) legislation relating to the use and protection of natural medicinal resources and sources of natural mineral water, b) hydrogeology of mineral water, c) the foundations pelologie d) krenotechniky e) storage, treatment and manner of utilization of mineral water, f ) production, storage, treatment pelloids and preparation for use, g) of natural medicinal gas, h) basic indicators of the quality of natural medicinal resources, their determination, assessment and collection of samples for inspection i) dealing with emergency situations, j) keeping records related performance of professional supervision. (3) The examination is evaluated as "passed" or "failed". The test result decided by the examination committee by a majority vote of the members present. In case of equality of votes the vote of the Chairman of the Commission. The test result shall notify the applicant chairman of the examination committee on the day of the meeting. In the event that the bidder did not comply, the chairman of the examination committee acquaint applicants with the reasons for this assessment. The test shall be drawn record in which the date and venue of the examination, questions, answers and evaluation of test results. The record shall be signed by the chairman of the examination committee. (2) The Ministry shall appoint and remove the chairman of the examination committee, vice-chairperson chairman of the examination committee in his absence, and the other board members and an alternate, and experts in the field of use and protection of natural healing sources and natural mineral water from among its employees and practitioners. Members of the board may be appointed only natural person that this appointment has been approved. (3) The examination board which has three members, a quorum if attended by all its members; in other cases has a quorum if at least two thirds of the members. An expert from the practice must always be present. (4) The membership of the Examining Board in accordance with paragraph 2 shall cease withdrawal, resignation or death. § 5 This Decree shall take effect on the date of publication. Minister: prof.
