62/2011 Coll. DECREE of 7 March 2011 on the conditions of connection to the gas system and amending Decree of the Ministry of Industry and Trade no. 251/2001 Coll., Laying down the rules of operation of transmission and distribution system operators in the gas sector, the Energy Regulatory Office pursuant to § 98a paragraph. 2 point. g) of the Act no. 458/2000 Coll., on business conditions and public administration in energy sectors and amending certain acts (the Energy Act), as amended by Act no. 158/2009 Coll .: FIRST PART conditions attached to the gas system § 1 Subject This Decree lays down conditions for the connection of gas distribution networks, underground gas storage and supply points of customers to the gas system and method for determining the proportion of costs associated with connecting and securing gas supplies. § 2 Definitions For the purposes of this Decree a) the applicant is a natural or legal person who requests a connection to the superior system and who is authorized to use the device on the basis of ownership or other rights; for the applicant shall be considered a natural or legal person in the territory intends to proceed with the construction of facilities, b) superior system transmission system, distribution system, underground gas storage or production pipeline, for which the applicant applies for connecting devices. § 3 Conditions for connecting devices applicant's Terms connecting gas production plant, distribution system, gas consuming equipment or underground gas storage facility ("the facility") are a) filing an application for connection, b) the fact that due to the connection of devices does not endanger safe and reliable operation of superior systems, c) the projected minimum output device corresponding to the total annual consumption equipment in the amount of 10 000 MWh, if desired device is connected to the transmission system, d) conclusion of a connection between the applicant and the operator of the superior system. § 4 Application for connection (1) The applicant submits an application to join the system and superior) before connecting new devices, b) secured before changing the overall minimum and maximum hourly capacity of an existing connected device, c) before connecting to a different pressure level. (2) If a change in the customer's existing supply point, there is no change of technical conditions for connection, the applicant merely submitted an application for a contract or a connection request to amend an existing connection agreements. (3) An application for connection shall be submitted for each supply or delivery point, or the sum of delivery points, where each of them separately specified in the request. (4) The particulars of the application for connection to the transmission system are given in Annex no. 1 hereto. (5) The particulars of the application for connection of the plant to the gas distribution system, gas or mining underground gas storage are given in Annex no. 2 hereto. (6) The requirements of the request for grid connection to another distribution system are shown in Annex no. 3 hereto. (7) Requirements for connection requests to the gas consuming equipment to the distribution system are shown in Annex no. 4 hereto. (8) The particulars of the application for connection of underground gas storage grid are shown in Annex no. 5 hereto. § 5 Examination of the connection (1) The superior system assesses the connection request with respect to a) the desired location, method and date of access, b) the technical feasibility of the desired connection, c) the size of the overall minimum and maximum hourly capacity indicated by the applicant in the connection request for the handover point sum of delivery points, or supply point (hereinafter referred to as "required capacity"), d) the extent and timing of supply or consumption of gas, e) the order of applications received f) compliance pressure conditions at the facilities of the applicant and superior service system, g) the effect of the connected device security and reliability superior operating system, h) qualitative characteristics of the gas to be supplied to the superior system of the connected device, and i) the planned development of the superior system. (2) If it is necessary for a proper assessment of the request for access, the superior system prompts the operator to connect the applicant within 14 days of receiving a request to supplement the information provided to the extent needed and shall fix a reasonable time limit. Simultaneously notifies the applicant that if underfill data to the extent required by the deadline will be assessed a request. (3) If a superior system, with the exception of the transmission system operator, based on the assessment of the connection request in accordance with paragraph 1, that connect devices does not endanger the safe and reliable operation of superior system to the applicant a draft contract for connection within 60 calendar days, the applicant from the category household customers or small customer within 30 calendar days of receiving a complete application for connection. Draft agreement on access is binding for a period of 12 calendar months from the date of receipt of the applicant. (5) Along with the draft contract to join the superior system operator shall submit to the customer a written instruction on his right to free choice or change their gas supplier. If the contract on gas distribution was not concluded within 36 months from the date of connection stipulated in the connection agreement, to ensure the required capacity for connection point expires. § 7 The share of applicants to join the justifiable costs associated with connecting and securing gas supplies (1) Manufacturer of gas distribution system operator, or storage system operator pays eligible cost to the superior system associated with connecting the device to the superior system in full, Except in the case pursuant to paragraph 3 (2) Payment of share of eligible costs DSOs associated with connections do not apply when connecting gas consuming customer equipment to the grid. (3) The proportion of applicants to join the justifiable costs associated with connecting the device to the transmission system shall be determined in accordance with Annex no. 6 hereto. Reimbursement share of eligible costs Connection does not apply in the case of grid connection to the transmission system. (4) Eligible costs include only the necessary expenses corresponding to the amount of the secured amount of capacity, location and method of connecting devices applicant related to the acquisition, construction or reconstruction of superior systems that were caused by the requirement of the applicant in connection with the connection of its facilities, including the cost of acquisition of project documentation , geodetic surveying and easements. Eligible costs do not include the costs of installing gas connections. (5) If the customer is limited or interrupted gas supply points due to illegal consumption, transportation or distribution of gas paid by the customer is entitled to a cost to the superior system associated with the provision of gas supplies in full. Eligible costs associated with providing gas supply to include only the necessary costs associated with reconnecting client device corresponding to the amount of the secured amount of capacity, location and method of connecting devices. § 8 Transitional provisions (1) If the applicant filed an application for connection to the superior system and superior system operator did not issue a written opinion on the request before the effective date of this Decree, the procedure under this decree. (2) If the applicant filed an application for connection to the superior system, operator superior system issued to request a written opinion, but did not provide the applicant a draft contract for the connection before the effective date of this Order, submit to the applicant operator superior system draft contract for connection within 30 days of the effective date of this decree.
