HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:
In this Act,
"arts" means the arts of the theatre, literature, music, painting, sculpture, architecture or the graphic arts, and includes any other similar creative or interpretative activity; (« arts »)
"council" means Manitoba Arts Council established under this Act; (« Conseil »)
"member" means a member of the council. (« membre »)
The council known as The Manitoba Arts Council is hereby continued.
The council shall consist of no more than nine members to be appointed by the Lieutenant Governor in Council.
A member of the council shall hold office for a term fixed by the Lieutenant Governor in Council and thereafter until his successor is appointed.
The Lieutenant Governor in Council shall designate one member as chairman of the council and one member as vice-chairman of the council.
The persons who are, from time to time, members of the council are constituted a body corporate under the name "Manitoba Arts Council".
The members may be paid reasonable travelling and out-of-pocket expenses incurred by them in the business of the council while away from their ordinary places of residence.
A majority of the members of the council constitute a quorum thereof, and a vacancy on the council does not impair the authority of the remaining members to act for the council.
The aims and objects of the council are to promote the study, enjoyment, production, and performance of works in the arts; and for that purpose the council may
(a) make grants to, assist, co-operate with, and enlist the aid of, organizations whose objects are similar to the objects of the council, and co-operate with the Canada Council;
(b) provide through appropriate organizations or otherwise for grants, scholarships, or loans, to citizens of Manitoba for study or research in the arts; and
(c) make awards to citizens of Manitoba for outstanding accomplishments in the arts.
The council may pass by-laws regulating its proceedings and generally providing for the conduct and management of its activities.
The council shall meet at least four times in each year on such dates and at such places and times as may be fixed by the council.
The Minister of Finance, with the approval of the Lieutenant Governor in Council, may make grants to the council from and out of the Consolidated Fund with moneys authorized by an Act of the Legislature to be so paid and applied.
The council may acquire money, securities, or other property, real or personal, by gift, devise, bequest, or otherwise, and may expend, administer, act as trustee in respect of, or dispose of, any such money, securities, or other property, in the promotion of its objects, subject to any terms upon which the money, securities, or other property were given, devised, or bequeathed to, or otherwise acquired by, the council.
The Lieutenant Governor in Council may establish an investment committee for the council composed of the chairman of the council, a member of the council designated by the council, and a person appointed by the Lieutenant Governor in Council.
Duties of investment committee
The investment committee shall aid and advise the council with respect to the investment of any of its moneys or assets.
The accounts of the council shall, at least once in each year, be audited and reported on by the Auditor General, or by an auditor appointed by the Minister of Finance, and the costs thereof shall be paid by the council.

The council shall annually prepare and submit to the President of the Executive Council a report of its affairs and activities; and upon receiving the report, the President of the Executive Council shall submit it to the Lieutenant Governor and
(a) if the Legislature is then in session, lay the report before the assembly within 15 days; and
(b) if the Legislature is not then in session, lay the report before the assembly within 15 days of the beginning of the next ensuing session.
