Construction Electrician Trade Regulations

made under Section 29 of the
Apprenticeship and Trades Qualifications Act

1 In these regulations

(a) "Act" means the Apprenticeship and Trades Qualifications Act;

(b) "Director" means the Director of Apprenticeship and Trades Qualifications;

(c) "construction electrician trade" or "trade" means the installation, repair, or alteration, whether temporary or permanent, in all types of construction, including dwellings, commercial and industrial establishments and public buildings of wires, conduits, apparatus, fixtures, or other appliances for the carrying or using of electricity for light, heat or power purposes;

(d) "engaged" means employed for hire or remuneration;

(e) "General Regulations" means regulations made by the Governor in Council under authority of the Apprenticeship and Trades Qualifications Act that apply generally to all designated trades;

(f) "Minister" means the Minister of Labour and Advanced Education.

2 No person shall enter into a contract of apprenticeship either as or with an apprentice in the trade unless the person being apprenticed has successfully completed grade twelve or its equivalent in the course skills required by the trade/occupation.

3 The term of apprenticeship for the trade is four (4) years.

4 The wage of an apprentice shall be no less than is prescribed in the following wage schedule and shall include health care and pension benefits paid by the employer on the employee's behalf along with the increases to which the apprentice is entitled on successful completion (both theory and practical, as required) of each six month period:

commencing the first six months at 45% of the journeyman's package rate;
commencing the second six months at 50% of the journeyman's package rate;
commencing the third six months at 55% of the journeyman's package rate;
commencing the fourth six months at 60% of the journeyman's package rate;
commencing the fifth six months at 65% of the journeyman's package rate;
commencing the sixth six months at 70% of the journeyman's package rate;
pcommencing the seventh six months at 75% of the journeyman's package rate;
commencing the eighth six months at 80% of the journeyman's package rate.

5 (a) An employer in the trade may employ one apprentice for each certified journeyman electrician employed.

(b) Notwithstanding subsection (a) the ratio of apprentices to journeymen employed by an employer in the trade may be varied from time to time, with the approval of the Minister, after consideration of the employment situation and the availability of certified journeymen in the trade.

6 The construction electrician trade is hereby designated as a certified trade.

7 A person who

(a) satisfies the requirements of Section 19 of the General Regulations; and

(b) produces evidence to prove five years of practical experience engaged in the trade or four years if the applicant has successfully completed a vocational training course approved by the Director

is eligible to be examined for a journeyman's certificate of qualification.

8 (a) Certificates of qualification, special certificates and restricted certificates shall be valid for a period of five years from the date of issue or renewal.

(b) Applications for renewal of certificates shall be made to the Director before the end of each five year period.
