Amending O. Reg. 136/12
(GRANTS FOR STUDENT NEEDS — LEGISLATIVE GRANTS FOR THE 2012-2013 SCHOOL BOARD FISCAL YEAR)
1. (1) Subsection 3 (9) of Ontario Regulation 136/12 is amended by adding “subsection 43 (1.1) and” after “referred to in”.
(2) Subsection 3 (10) of the Regulation is amended by striking out ““List of Schools Eligible for School Foundation Allocation”, revised May 2012” and substituting ““List of Schools Eligible for School Foundation Allocation for the 2012-2013 school year”, revised March 2013”.
2. Section 8 of the Regulation is amended by adding the following subsection:
(3) Despite subsection (1), the amount determined under paragraph 4 of section 59.1 is payable in accordance with the following rules:
1. The amount is payable to the board in the fiscal year in which the board incurs costs in respect of sick leave credits used by employees in accordance with subsection 3 (5) of Ontario Regulation 1/13 (Sick Leave Credits and Sick Leave Credit Gratuities).
2. The amount of the deferred payment during a fiscal year may be paid on an estimated basis and may be adjusted as described in subsection (1).
3. Subsection 12 (1) of the Regulation is amended by adding the following paragraph:
3.1 Add the amount determined for the board for the variable “G” under section 14.
4. (1) Section 14 of the Regulation is amended by striking out the formula and substituting the following:
(A + B) – (C + D + E) + F + G
(2) Section 14 of the Regulation is amended by striking out “and” at the end of the definition of the variable “E”, by adding “and” at the end of the definition of the variable “F” and by adding the following definition:
“G” is the amount of the board’s adjustment for labour related enhancements for the fiscal year.
5. (1) The definition of “School Foundation Allocation Table” in subsection 17 (2) of the Regulation is amended by striking out ““List of Schools Eligible for School Foundation Allocation”, revised May 2012” and substituting ““List of Schools Eligible for School Foundation Allocation for the 2012-2013 school year”, revised March 2013”.
(2) Subparagraph 1 ii of subsection 17 (3) of the Regulation is amended by striking out “one or more” at the end and substituting “more than zero”.
6. Subparagraph 7 i of subsection 31 (2) of the Regulation is amended by striking out “1 or more” and substituting “more than zero”.
7. (1) Subparagraph 1 i of subsection 33 (1) of the Regulation is amended by striking out “1 or more” in the portion before the formula and substituting “more than zero”.
(2) Subparagraph 3 i of subsection 33 (1) of the Regulation is amended by striking out “1 or more” in the portion before the formula and substituting “more than zero”.
8. (1) Paragraphs 6, 12 and 13 of subsection 41 (2) of the Regulation are revoked and the following substituted:
6. Multiply the number obtained under paragraph 5 by 98.
6.1 Divide the number determined under paragraph 6 by 194.

12.1 Divide the number determined under paragraph 12 by 194.
13. Add the numbers obtained under paragraphs 6.1 and 12.1.
(2) Paragraphs 6, 12 and 13 of subsection 41 (3) of the Regulation are revoked and the following substituted:

9. (1) Subsection 43 (1) of the Regulation is amended by adding the following paragraphs:
8.1 Take the total of the following amounts:
i. The amount determined for the board under section 43 of the 2011-2012 grant regulation.
ii. The amount determined for the board under subsection 36 (3) of the 2011-2012 grant regulation.
iii. The amount determined for the board under paragraph 3 of subsection 36 (4) of the 2011-2012 grant regulation.
8.2 Determine the board’s transportation expenses for the 2011-2012 school board fiscal year.
8.3 Determine the amount of the board’s revenue from other sources, within the meaning of the 2011-2012 grant regulation, that was applied in the 2011-2012 school board fiscal year against the board’s transportation expenses.
8.4 Subtract the amount determined under paragraph 8.3 from the amount determined under paragraph 8.2.
8.5 Subtract the amount determined under paragraph 8.1 from the amount determined under paragraph 8.4. If the result is negative, it is deemed to be zero.
8.6 Determine an amount using the following formula:
A × B
in which,
“A” is the amount determined under paragraph 8.5, and
“B” is the product determined by multiplying the site participation factor set out in Column 2 of Table 15.1 opposite the name of the board by the effectiveness and efficiency rating set out in Column 3 of the Table opposite the site participation factor.
(2) Paragraph 13 of subsection 43 (1) of the Regulation is amended by striking out “8 and 12” and substituting “8, 8.6 and 12”.
(3) Section 43 of the Regulation is amended by adding the following subsection:
(1.1) For the purposes of subsection (1), an expense by a board is a transportation expense if it is categorized as a transportation expense in the Ministry’s Uniform Code of Accounts, revised April 2012, which is available as described in subsection 3 (9).
10. Subparagraph 3 viii of subsection 46 (1) of the Regulation is revoked.
11. (1) Paragraph 2 of subsection 50 (1) of the Regulation is amended by striking out “seven” and substituting “eight”.
(2) Paragraph 4 of subsection 50 (1) of the Regulation is amended by striking out “six” and substituting “seven”.
(3) Paragraph 6 of subsection 50 (1) of the Regulation is amended by striking out “five” and substituting “six”.
(4) Paragraph 8 of subsection 50 (1) of the Regulation is amended by striking out “four” and substituting “five”.
12. Section 51.1 of the Regulation is revoked and the following substituted:
Amount for retrofitting school space for child care
51.1 The amount for the board for the fiscal year for retrofitting school space for child care is the amount set out in Column 2 of Table 25.1 opposite the name of the board.
13. Sections 55 and 56 of the Regulation are revoked and the following substituted:
Amount for capital priority projects
55. The amount for the board for the fiscal year for capital priority projects is determined as follows:
1. Take the amount determined under paragraph 2 of section 55.1 of the 2011-2012 grant regulation.
2. Take the amount determined under section 55.1 of the 2011-2012 grant regulation.
3. Subtract the amount determined under paragraph 2 from the amount determined under paragraph 1.
4. Add the amount determined under paragraph 3 to the amount set out in Column 5 of Table 25.2 opposite the name of the board.
5. Determine the total construction costs incurred by the board in the fiscal year, and reported by August 31, 2013, for the capital priority projects listed in Column 3 of Table 27.1 of the 2011-2012 grant regulation opposite the name of the board.
6. Determine the total construction costs incurred by the board in the fiscal year, and reported by August 31, 2013, for the capital priority projects listed in Column 3 of Table 25.2 opposite the name of the board.
7. Total the amounts determined under paragraphs 5 and 6.
8. Take the lesser of the amounts determined under paragraphs 4 and 7.
Amount for capital priority land purchases
56. The amount for the board for the fiscal year for capital priority land purchases is determined as follows:
1. Take the amount determined under paragraph 2 of section 55.2 of the 2011-2012 grant regulation.
2. Take the amount determined under section 55.2 of the 2011-2012 grant regulation.
3. Subtract the amount determined under paragraph 2 from the amount determined under paragraph 1.
4. Add the amount determined under paragraph 3 to the amount set out in Column 5 of Table 25.3 opposite the name of the board.
5. Determine the total land purchase costs incurred by the board in the fiscal year, and reported by August 31, 2013, for the capital priority projects listed in Column 3 of Table 27.2 of the 2011-2012 grant regulation opposite the name of the board.
6. Determine the total land purchase costs incurred by the board in the fiscal year, and reported by August 31, 2013, for the capital priority projects listed in Column 3 of Table 25.3 opposite the name of the board.
7. Total the amounts determined under paragraphs 5 and 6.
8. Take the lesser of the amounts determined under paragraphs 4 and 7.
14. The Regulation is amended by adding the following section:
Adjustment for labour related enhancements
59.1 The amount of a district school board’s adjustment for labour related enhancements for the fiscal year for the purposes of section 14 is the sum of the following amounts:
1. The amount for the board’s incremental supply teacher adjustment set out in Column 2 of Table 30 opposite the name of the board.
2. The total amount payable by the board in respect of sick leave credit gratuity wind-up under subsection 4 (4) of Ontario Regulation 1/13 (Sick Leave Credits and Sick Leave Credit Gratuities).
3. The amount payable by the board, as of September 1, 2012, in respect of sick leave credit gratuities provided for under subsection 4 (5) of Ontario Regulation 1/13 that, in the absence of that subsection, would not be payable.
4. The amount payable by the board, as of August 31, 2013, in respect of unused sick leave credits that an employee may use in the 2013-2014 school board fiscal year pursuant to subsection 3 (5) of Ontario Regulation 1/13.
15. Subparagraph 1 v of subsection 62 (2) of the Regulation is amended by striking out “$43.13” and substituting “$20.06”.
16. Item 22 of Table 9 of the Regulation is amended by striking out “$276,175” in Column 5 and substituting “$250,755”.
17. The Regulation is amended by adding the following Table:
