Amending O. Reg. 245/97

(EXPLORATION, DRILLING AND PRODUCTION)

1. Section 5 of Ontario Regulation 245/97 is revoked and the following substituted:

5. (1) For the purposes of subsection 16 (4) of the Act, the amount that the holder of a well licence is required to pay to the Oil, Gas and Salt Resources Trust shall be determined in accordance with subsection (2) or (3) and shall be paid on or before February 15 of each year.

(2) The holder of a well licence who is licensed to operate a well described in Column 1 of the Table to this subsection shall pay to the Trust, for each well that he or she is licensed to operate, an amount that is equal to the amount set out in Column 2 of the Table opposite the type of well.

(3) The holder of a well licence who is licensed to operate one or more wells of a type described in Column 1 of the Table to this subsection shall pay to the Trust, in respect of all the wells of that type that he or she is licensed to operate, an amount that is equal to the greater of $100.00 or the amount determined in the manner described in Column 2 of the Table opposite the type of well.

Natural gas producing well


$0.15 for each 1000 cubic metres of natural gas produced from the wells operated during the previous calendar year

Oil producing well


$0.50 for each cubic metre of oil produced from the wells operated during the previous calendar year




(4) Despite subsection (3), if a natural gas producing well operated by the holder of a well licence produces natural gas that is not sold commercially but is produced for the licence holder’s sole use, the volume of natural gas produced from that well shall not be included in the calculations to determine the amount payable to the Trust under subsection (3).

2. Clause 16 (1.1) (g) of the Regulation is amended by striking out “Public Accountancy Act” and substituting “Public Accounting Act, 2004”.

3. This Regulation comes into force on the later of July 1, 2014 and the day it is filed.
