Amending O. Reg. 282/98

(GENERAL)

1. (1) Subsections 42.5 (2) and (3) of Ontario Regulation 282/98 are revoked and the following substituted:

(2) For the purposes of subsection 19 (2.1) of the Act, the current value of a wind turbine tower for a year is determined by multiplying the installed capacity in megawatts of the generator attached to the wind turbine tower by the dollar amount set out for that year in the Table to this section.

(3) For the purposes of clause 19.0.1 (1) (b) of the Act, the assessed value for a year of a generating station structure that is a wind turbine tower is determined by multiplying the installed capacity in megawatts of the generator attached to the wind turbine tower by the dollar amount set out for that year in the Table to this section.

(4) For the purposes of clause 19.0.1 (1) (b) and subsection 19.1 (4) of the Act, the current and assessed values for 2014, as determined under subsections (2) and (3), shall be adjusted to an amount equal to the installed capacity in megawatts of the generator attached to the wind turbine multiplied by $41,329. 

(5) For the purposes of clause 19.0.1 (1) (b) and subsection 19.1 (4) of the Act, the current and assessed values for 2015, as determined under subsections (2) and (3), shall be adjusted to an amount equal to the installed capacity in megawatts of the generator attached to the wind turbine multiplied by $42,657. 

(6) An increase to the value of a wind turbine tower that occurs by operation of subsection (2), (3), (4) or (5) shall not be included in determining the eligible increase with respect to the assessment of land under sections 48 to 48.3.

(2) Section 42.5 of the Regulation is amended by adding the following Table:
