Regulations Respecting the Control and Regulation of the Sale of Feeds
P.C. 1983-2124 1983-07-14His Excellency the Governor General in Council, on the recommendation of the Minister of Agriculture, pursuant to sections 3Footnote *, 4Footnote * and 5 and subsection 8(4) of the Feeds Act, is pleased hereby to revoke the Feeds Regulations, C.R.C., c. 665, and to make the annexed Regulations respecting the control and regulation of the sale of feeds in substitution therefor.

1 These Regulations may be cited as the Feeds Regulations, 1983.
Interpretation

2 (1) In these Regulations,
Act
Act means the Feeds Act; (Loi)
Agency
Agency means the Canadian Food Inspection Agency established by section 3 of the Canadian Food Inspection Agency Act; (Agence)
applicant
applicant means a person who applies to register a feed; (demandeur)
assessed or evaluated
assessed or evaluated means assessed or evaluated by the Director; (évalué)
biotechnology
biotechnology means the application of science and engineering to the direct or indirect use of living organisms or parts or products of living organisms in their natural or modified forms; (biotechnologie)
brand
brand means any distinctive mark or trade name, apart from the name of the feed required to be applied by these Regulations, applied by the manufacturer, registrant or vendor to a feed to distinguish it from another feed; (marque)
cattle
cattle means animals of the species Bos taurus or Bos indicus; (bœuf)
caution statement
caution statement means a statement relating to animal health hazards or to safe product handling or storage that is required to be included on the label of a feed by these Regulations; (précaution)
chop feed
chop feed means the feed obtained by grinding, chopping or crushing
(a) wheat, rye, barley, oats, corn, buckwheat, flax, field peas, field beans, triticale, milo, rapeseed seeds or soybeans either alone or in combination with one another, or
(b) oats wild-oats-cereals grain (Mixed Feed Oats) referred to in the Off Grades of Grain and Grades of Screenings Order, cereals grain screenings grade 1 as described in Schedule IV or cereals grain screenings grade 2 as described in that Schedule; (aliment broyé)
Compendium of Medicating Ingredients Brochures
Compendium of Medicating Ingredients Brochures means the Compendium of Medicating Ingredient Brochures, 8th edition, prepared by the Agency, published in 1998; ((Recueil des notices sur les substances médicatrices))
complete feed
complete feed means a feed that, when used for the kind of livestock and for the purposes stated on the label, will provide all of the nutritional requirements necessary for the maintenance of life or for promoting production except
(a) water, in the case of monogastric animals other than horses, and
(b) water or roughage, in the case of ruminant animals and horses; (aliment complet)
consultant formula feed
consultant formula feed means a feed that is formulated and manufactured by a seller to meet the requirements of a specific purchaser and that is not intended for resale by that purchaser or, where that purchaser is a feed manufacturer, that is not intended for use by that purchaser in the manufacture of a customer formula feed for sale; (aliment préparé selon une formule-conseil)
converter feed
converter feed means a feed that is mixed with a specified feed to convert that feed from a feed for one class of livestock to a feed for another class of the same livestock having different nutritional requirements; (aliment modificateur)
crude protein
crude protein means percentage nitrogen multiplied by 6.25; (protéines brutes)
customer formula feed
customer formula feed means
(a) a feed that is manufactured by a manufacturer for feeding to his own livestock,
(b) a feed that is manufactured by a manufacturer pursuant to a written order that is signed by a purchaser and that states the kind and amount of each single ingredient feed to be used in the manufacture of that feed, or
(c) a feed that is manufactured by a manufacturer pursuant to a written order that is signed by a purchaser and that states the kind and amount of each single ingredient feed to be added to other mixed feeds that would be acceptable for registration, as a service to the purchaser,
and, in the case of a feed referred to in paragrah (b) or (c), that is not intended for resale by that purchaser or, where that purchaser is a feed manufacturer, that is not intended for use by that purchaser in the manufacture of a feed referred to in paragraph (b) or (c); (aliment préparé selon la formule du client)
Director
Director means the Director designated by the President of the Agency; (directeur)
environment
environment means the components of the Earth and includes
(a) air, land and water,
(b) all layers of the atmosphere,
(c) all organic and inorganic matter and living organisms, and
(d) the interacting natural systems that include components referred to in paragraphs (a) to (c); (environnement)
facilitating agent
facilitating agent means a substance or mixture of substances that is added to a mixed feed or a single ingredient feed for the purpose of improving or conserving some or all of the nutrient content of that feed or of aiding and improving the manufacturing or handling properties of that feed and that may or may not have a nutritional value of its own; (substance auxiliaire)
feed
feed includes a feed derived through biotechnology; (aliment)
Feed and Fertilizer Division

identification code
identification code means any combination of letters or figures or letters and figures by which a lot of feed can be traced in manufacture and distribution; (code d’identification)
macro-minerals
macro-minerals means calcium, phosphorus, magnesium, sulphur, sodium and potassium; (macro-éléments)
macro-premix
macro-premix means a feed that is used with another feed to improve the nutritive balance of the total and that is intended to be further diluted and mixed to produce a supplement or complete feed that conforms to the standards prescribed in these Regulations; (macro-prémélange)
medicated feed
medicated feed means a mixed feed that contains a medicating ingredient; (aliment médicamenté)
medicating ingredient
medicating ingredient means
(a) a substance that is intended for use in the prevention or treatment of disease in livestock, or
(b) a substance, other than a feed, that is intended to affect the structure or any function of the body of the livestock,
and that has assigned to it a drug identification number pursuant to the Food and Drugs Act; (substance médicatrice)
micro-premix
micro-premix means a feed that is a mixture of ingredients that supply only trace minerals, vitamins, medicating ingredients that are listed in the Compendium of Medicating Ingredient Brochures, amino acids or other material that is used in minute quantities for feeding to livestock; (micro-prémélange)
mineral feed
mineral feed means a mixed feed that contains minerals for the nutrition of livestock and may contain vitamins, facilitating agents, flavouring agents or medicating ingredients that are listed in the Compendium of Medicating Ingredient Brochures; (aliment minéral)
mixed feed
mixed feed means a feed that contains two or more single ingredient feeds; (aliment mélangé)
novel feed
novel feed means a feed, comprising an organism or organisms, or parts or products thereof, that
(a) is not set out in Schedule IV or V, or
(b) has a novel trait; (aliment nouveau)
novel trait
novel trait, in respect of a feed, means a characteristic of the feed that
(a) has been intentionally selected, created or introduced into the feed through a specific genetic change, and
(b) based on valid scientific rationale, is not substantially equivalent, in terms of its specific use and safety both for the environment and for human and animal health, to any characteristic of a similar feed that is set out in Schedule IV or V; (caractère nouveau)
per cent
per cent, with respect to any article, means per cent by mass of the article; (pourcentage)

poultry
poultry means chickens, turkeys, ducks and geese; (volaille)
registrant
registrant means an applicant who has been issued a feed registration certificate under subsection 9(1); (titulaire de l’enregistrement)
release
release means any discharge or emission into the environment of a feed or livestock product produced from the feed or exposure of a feed or livestock product produced from the feed to the environment; (dissémination)
ruminant
ruminant means an animal of the suborder Ruminatiae and includes an animal of the family Camelidae; (ruminant)
significant change
significant change, in respect of a feed, means any change in
(a) the brand of the feed,
(b) the name of the feed,
(c) the type or level of medicating ingredient in the feed,
(d) the guaranteed level of a nutrient, unless the nutrient is listed in Table 4 of Schedule I for the species of livestock for which the feed is intended and both the former and revised guaranteed levels are within the limits set out in that Table for that nutrient,
(e) any statement, phrase or claim appearing on the label that relates to the purpose or function of the feed in general or to any medicating ingredient, nutrient or other ingredient present in the feed,
(f) the directions for the use of the feed, or
(g) the ingredients present in the feed, if it is a feed required to be labelled with the name of each ingredient therein pursuant to paragraph 26(1)(j); (modification importante)
single ingredient feed
single ingredient feed means any substance or mixture of substances that is assessed or evaluated as being acceptable for use in feeds and that is described in an item of Schedule IV or V; (aliment à ingrédient unique)
specified risk material
specified risk material means the skull, brain, trigeminal ganglia, eyes, tonsils, spinal cord and dorsal root ganglia of cattle aged 30 months or older, and the distal ileum of cattle of all ages, but does not include material from a country of origin as defined in section 2 of the Health of Animals Regulations, or a part of a country of origin, that is designated under section 7 of those Regulations as posing a negligible risk for Bovine Spongiform Encephalopathy; (matériel à risque spécifié)
supplement
supplement means a feed that is used with another feed to improve the nutritive balance of the total and that is intended to be
(a) fed undiluted as a supplement to other feeds,
(b) offered free choice with other parts of the ration separately available, or
(c) further diluted and mixed to produce a complete feed that is acceptable for registration; (supplément)
tonic
tonic or conditioner means a mineral feed that is formulated and represented for the correction of a specified nutrient deficiency or to aid recovery from a specific nutrient deficiency and is for use only while the condition persists; (tonique or fortifiant)
trace mineral salt feed
trace mineral salt feed means a mineral feed that contains only ingredients incorporated to supply trace minerals and salt (NaCl) and may contain medicating ingredients that are listed in the Compendium of Medicating Ingredient Brochures or facilitating agents; (complément d’oligo-éléments et de sel)
veterinary prescription
veterinary prescription means an order prescribing a medicated feed made in writing by a veterinarian licensed to practise in the province in which the feed is to be fed to livestock; (ordonnance)
veterinary prescription feed
veterinary prescription feed means a feed manufactured pursuant to a veterinary prescription; (aliment prescrit par ordonnance)
warning statement
warning statement means a statement relating to human health hazards that is required to be included on the label of a feed by these Regulations. (mise en garde)
(2) For the purposes of sections 4.1 to 4.4, a novel feed is toxic if it is entering or may enter the environment in a quantity or concentration or under conditions
(a) having or that may have an immediate or long-term harmful effect on the environment;
(b) constituting or that may constitute a danger to the environment on which human or animal life depends; or
(c) constituting or that may constitute a danger in Canada to human or animal life or health.

Exemptions
3 The following feeds are exempt from the operation of the Act and these Regulations:
(a) a feed for export from Canada and so labelled;
(b) a feed for mink or foxes containing only uncooked tissues of animals, poultry or fish unless such feed contains any material in quantities prohibited by paragraph 19(1)(k);
(c) a feed, other than a novel feed, that is manufactured for experimental purposes at or for a governmental, academic or private research establishment and that is fed to livestock owned by or under the direct supervision of that establishment, if that establishment accepts responsibility for the safe disposal of all livestock products produced from the feed;
(c.1) a feed, other than a novel feed, that is imported into Canada by a governmental, academic or private research establishment for testing for experimental purposes, provided that the importer of the feed
(i) has submitted to the President of the Agency in writing, before the importation, information pertaining to the location of the test, a complete description of the ingredients in the feed to be tested, the total quantity of feed required to conduct the test and the quantity of each shipment, and the date and port of entry through which the feed is to be imported, and
(ii) has received the approval of the President of the Agency for the importation and accepts responsibility for the safe disposal of all livestock produced from the feed;
(d) a feed that contains a medicating ingredient manufactured pursuant to section C.08.005 of the Food and Drug Regulations for the purposes of conducting new drug clinical testing; and
(e) a complete feed that is
(i) packaged in containers containing not more than 5 kg net mass, and
(ii) intended for feeding to livestock not intended to be used for the production of food for human consumption.

Deleterious Substances
4 The following substances are hereby prescribed as deleterious substances for the purposes of sections 3 and 4 of the Act:
(a) aldrin;
(b) carbaryl;
(c) carbathiin;
(d) D.D.T.;
(e) dieldrin;
(f) heptachlor;
(g) heptachlor epoxide;
(h) lindane;
(i) malathion;
(j) mercury compounds;
(k) methoxychlor; and
(l) toxaphene.
Notification and Authorization of the Release of Novel Feeds
4.1 (1) Subject to subsections (2) and (3), no person shall release a novel feed unless the person
(a) provides notification of the proposed release in writing to the Minister, accompanied by the information set out in section 4.2;
(b) provides an undertaking in writing to the Minister to take responsibility for and assume the costs of the safe disposal of the novel feed and all livestock products produced from the novel feed; and
(c) receives authorization from the Minister for the release pursuant to section 4.3.
(2) Subsection (1) does not apply in respect of a feed that is registered or a feed that is exempt from registration.
(3) Where the accompanying information that is required to be provided to the Minister by paragraph (1)(a) in respect of the proposed release of a novel feed is the same as information that has already been provided to the Minister before the coming into force of this section and sections 4.2 to 4.4, or that is provided on or after the coming into force of this section and sections 4.2 to 4.4 in relation to another notification or authorization, the information is not required to be provided again.

Information Requirements
4.2 (1) Subject to subsection (2), the accompanying information that is required to be provided by a person to the Minister pursuant to paragraph 4.1(1)(a) is the following:
(a) the name of the person or body responsible for the proposed release and the name of the person who will be in charge of carrying out the release;
(b) the purpose and objectives of the proposed release;
(c) the proposed starting date, time period and site of the release;
(d) the proposed release protocol, including
(i) any confinement measures intended to mitigate the establishment and spread, in the environment, of the novel feed and the interaction of the novel feed with the environment,
(ii) the monitoring plan and procedures to be followed both during and after the release,
(iii) the method to be used for the safe disposal of the novel feed and all livestock products produced from the novel feed, and
(iv) the contingency plan to be followed to minimize any adverse effect of an accidental release of the novel feed on the environment, including any adverse effect on human or animal health;
(e) in the case of a novel feed with a novel trait, the identification and characterization of the novel feed, including
(i) the identification and characterization of the novel trait expressed by the novel feed and, where the novel trait is introduced from another species, details of the host and donor organism and of the methods of incorporation of the novel trait into the novel feed, where applicable, and
(ii) the identification and characterization of the novel feed resulting from the introduction of the novel trait, including details relating to expression of the novel trait and the stability of the incorporation of the novel trait into the novel feed, and a comparison of the characteristics of the novel feed with those of the unmodified feed;
(f) all other information and test data in respect of the novel feed that are relevant to identifying risks to the environment, including risks to human or animal health, and that are in the person’s possession or to which the person ought reasonably to have access;
(g) other Canadian or foreign government agencies that have been provided with information in respect of the novel feed and the purpose for which the information was provided; and
(h) a description of the analytical methodologies followed in generating any submitted data, including quality control and quality assurance procedures.
(2) The information required by subparagraph (1)(e)(ii) or paragraph (1)(f) or (h) or any part of that information may be omitted if the Minister determines, on the basis of a written scientific rationale provided by the person referred to in subsection (1), that the information or part is not relevant or cannot practicably be obtained and is not required for the Minister’s decision under section 4.3, and notifies the person of that determination.

Decision of the Minister
4.3 (1) On receiving the notification provided pursuant to paragraph 4.1(1)(a), the Minister shall, after considering all relevant matters, including the information provided pursuant to that paragraph, and after evaluating the potential impact on and risk to the environment, including the potential impact on and risk to human and animal health, posed by the proposed release
(a) authorize the release where there is minimal risk to the environment, and may, where necessary in order to minimize the risk, impose conditions for the management of the risk; or
(b) refuse to authorize the release where the proposed release poses an unacceptable risk to the environment.
(2) In evaluating the risk to the environment for the purposes of subsection (1), the Minister shall
(a) consider such matters as
(i) the effects of the proposed release on the environment, and
(ii) the magnitude of the exposure to the environment of the novel feed involved in the proposed release; and
(b) assess whether the novel feed is toxic.

New Information Requirements
4.4 (1) Where, at any time after providing notification pursuant to paragraph 4.1(1)(a) or receiving authorization pursuant to paragraph 4.3(1)(a), a person becomes aware of any new information regarding risk to the environment, including risk to human or animal health, that could result from the release of the novel feed, the person shall immediately provide the new information to the Minister.
(2) Where the Minister, on the basis of the new information provided by a person pursuant to subsection (1), re-evaluates the potential impact on and risk to the environment, including the potential impact on and risk to human and animal health, posed by the release and determines that there is
(a) a risk that is less than was apparent at the time of the original notification or at the time of any subsequent provision of new information since the original notification, the Minister may
(i) where the release has already been authorized, maintain the existing conditions respecting the release,
(ii) change the conditions respecting the release, or
(iii) remove any of the conditions respecting the release;
(b) a risk that is greater than was apparent at the time of the original notification or at the time of any subsequent provision of new information since the original notification, the Minister may
(i) impose additional conditions respecting the release, or
(ii) change the conditions respecting the release; or
(c) an unacceptable risk, the Minister shall
(i) refuse to authorize the release, or
(ii) where the release has already been authorized, cancel the authorization and require the person to stop the release of the novel feed and take any appropriate action necessary to eliminate or minimize the risk.
(3) In re-evaluating the risk to the environment on the basis of new information for the purposes of subsection (2), the Minister shall consider the matters referred to in paragraph 4.3(2)(a) and make the assessment referred to in paragraph 4.3(2)(b).

Registration
5 (1) Subject to subsection (2), all feeds shall be registered.
(2) The following feeds are not required to be registered:
(a) chop feeds;
(b) single ingredient feeds other than single ingredient feeds described or referred to in Part II of Schedule IV or Part II of Schedule V;
(c) any brand of feed medicating ingredient premix listed in the Compendium of Medicating Ingredient Brochures;
(d) any complete feed, supplement or macro-premix manufactured in Canada that is designed to be fed to beef cattle, dairy cattle, sheep, swine, chickens, turkeys, horses, goats, ducks, geese, salmonid fish, mink or rabbits where
(i) the feed is not designed to replace whole milk in the ration of the livestock,
(ii) in the case of a complete feed, the nutrient level guaranteed for those nutrients listed in Table 4 of Schedule I is within the range of nutrient levels listed in that Table for that type of feed,
(iii) in the case of a feed whose sodium content is designed to limit or regulate the intake of that feed by beef cattle or sheep and whose sodium level exceeds the maximum listed in Table 4 of Schedule I, the directions for use indicated on the label include a statement to the effect that adequate water must be provided,
(iv) in the case of a supplement or macro-premix, the nutrient level guaranteed for those nutrients listed in Table 4 of Schedule I is such that when the supplement or macro-premix is used according to the directions for use it will not supply the complete feed with any nutrient at a level higher than the maximum listed in that Table for that nutrient but will supply the complete feed, in conjunction with the other ingredients, with a level of nutrient that meets or exceeds the minimum listed in that Table for that nutrient, and
(v) the manufacture and sale of the feed is in compliance with sections 14 and 15;
(vi) [Repealed, SOR/88-473, s. 2]
(e) any consultant formula feed manufactured in Canada if
(i) in the case of a complete feed, the nutrient level guaranteed for those nutrients listed in Table 4 of Schedule I is within the range of nutrient levels listed in that Table for that type of feed,
(ii) in the case of a feed whose sodium content is designed to limit or regulate the intake of that feed by beef cattle or sheep and whose sodium level exceeds the maximum listed in Table 4 of Schedule I, the directions for use indicated on the label include a statement to the effect that adequate water must be provided,
(iii) in the case of a supplement, macro-premix or micro-premix, the nutrient level guaranteed for those nutrients listed in Table 4 of Schedule I is such that when the supplement, macro-premix or micro-premix is used according to the directions for use it will not supply the complete feed with any nutrient at a level higher than the maximum listed in that Table for that nutrient but will supply the complete feed, in conjunction with that supplied by the other ingredients, with a level of nutrient that meets or exceeds the minimum listed in that Table for that nutrient, and
(iv) the manufacture and sale of such a feed is in compliance with sections 14 and 15,
(v) and (vi) [Repealed, SOR/88-473, s. 2]
(f) any customer formula feed manufactured in Canada if the manufacture and sale of the feed is in compliance with sections 14 and 15; and
(g) any veterinary prescription feed manufactured in Canada if
(i) the sale of such feed is authorized under section C.08.012 of the Food and Drug Regulations,
(ii) the amount of feed manufactured does not exceed the amount that would be normally consumed by the number of animals prescribed to receive the feed during the prescribed period of medication,
(iii) the veterinary prescription pursuant to which the feed is manufactured is signed by the veterinarian who issued it and the prescription contains the following information:
(A) the date on which the prescription is written,
(B) the name and address of the person for whom the feed is to be manufactured and by whom it is intended to be used,
(C) the name and level of inclusion in the feed of the medicating ingredient prescribed by the veterinarian,
(D) the type and amount of feed to be manufactured,
(E) the number, kind, class and age or weight of the livestock intended to be fed the feed,
(F) special manufacturing instructions including necessary mill clean-up warnings, if any,
(G) feeding instructions or directions for use of the feed including the period of medication during which the feed is to be fed to the livestock, and
(H) warning statements and caution statements, where applicable,
(iv) the veterinary prescription pursuant to which the feed is manufactured contains a statement, signed by the person for whom the prescription was issued, indicating that he has read and understands the feeding instructions or directions for use and the warning statements and caution statements set out on the prescription, except that no such statement is necessary in those cases where, for practical reasons, the veterinarian who issued the prescription issued it directly to the manufacturer of the feed and is satisfied that the person for whom the prescription was issued was adequately aware of the information set out on the prescription,
(v) a copy of the veterinary prescription is in the possession of the manufacturer of the feed prior to the delivery of the feed, and

(vii) the feed is labelled in accordance with subsection 26(7).
(3) A feed that is exempt from registration pursuant to paragraph (2)(a), (b), (d), (e), (f) or (g) shall conform to the standards prescribed in these Regulations for that feed and shall be packaged and labelled as prescribed in these Regulations.

6 (1) Every application to register a feed shall be made to the Director on Form I of Schedule III.
(2) Every application referred to in subsection (1) shall be accompanied by
(a) five copies of a proposed label to be used with the feed or, in the case of a feed that is being re-registered without any changes, five copies of the label used with the feed; and
(b) [Repealed, SOR/96-422, s. 1]
(c) where copies of a proposed label accompany the application, an undertaking by the applicant to submit five copies of the actual label or a facsimile thereof to the Director within three months from the date of registration.
(3) Each set of labels accompanying an application shall be identified by an attachment number and such attachment number shall be indicated on the application.

7 Where an application to register a feed is made by an applicant who is not resident in Canada, the feed is not eligible for registration unless the application is signed by an agent of the applicant who is permanently resident in Canada and to whom any notice or correspondence under the Act may be sent and such agent gives an undertaking to the Director on Form II of Schedule III.

Satisfactory Evidence
8 (1) In addition to the requirements set out in section 6, an applicant shall provide the Director with satisfactory evidence to permit an assessment or evaluation of the safety and efficacy of the feed in respect of livestock and its potential effect on humans and on the environment.
(2) The evidence referred to in subsection (1) shall, where appropriate, include the following information, descriptions and reports:
(a) the results of scientific investigations respecting
(i) the conditions and the prevalence of such conditions under which the feed would be efficacious for its intended purposes,
(ii) the safety of the feed in respect of the species of livestock for which it is intended and in respect of other species of livestock and humans who may be exposed to it,
(iii) suitable methodology for the detection of significant amounts of any ingredient, compound, substance or organism that is intentionally incorporated into the feed or that occurs as a contaminant of the feed,
(iv) harmful residues, if any,
(v) significant changes in the chemical or physical composition of livestock products produced when the feed is used, and
(vi) the stability of the feed under practical conditions of storage;
(b) a description of production methods including
(i) information with respect to actual formulas to be used in the manufacture of the feed,
(ii) information with respect to the type and capacity of the equipment to be used in the manufacture of the feed, and
(iii) information with respect to quality control procedures to assure uniformity of the mix and the lack of contamination of subsequent lots of feed manufactured in the same place; and
(c) reports of analysis for any specified nutrient or medicating ingredient that is required to be guaranteed in the feed conducted on at least three samples, each drawn from a different one-third of a single mix or batch of the feed.
(3) Where any investigation has been performed for the purpose of providing the evidence referred to in subsection (1), the applicant shall establish that
(a) the investigation was conducted or supervised by qualified research personnel;
(b) the investigation was designed to facilitate statistical analysis and the results of the investigation were analysed by appropriate statistical methods; and
(c) the investigation was conducted under conditions similar to those that may be expected to occur in Canada.

Registration and Renewal of Registrations
9 (1) Where an application for registration of a feed is assessed or evaluated and the feed is found to meet the requirements of the Act and these Regulations, a registration number shall be assigned to that feed and a feed registration certificate shall be issued to the applicant.
(2) A feed registration certificate may be issued in respect of one or more feeds.
(3) A registrant may surrender a feed registration certificate by submitting to the Director Form III of Schedule III, duly completed, that the registrant shall be provided with by the Director and that shall contain a list of the feeds for which the registrant has a registration certificate.
(4) Every feed registration certificate with an expiry date of March 31, 1986 shall, notwithstanding the expiry date, continue in effect on the same terms and conditions as a certificate referred to in subsection (3).
(5) Where all requirements for the registration of a feed, except those pertaining to efficacy, are met, the Director may, if the Director is satisfied that no safety hazard is likely to arise for livestock and that potential benefits for livestock may be derived from the registration of the feed, issue a temporary registration certificate for a limited period during which tests to determine the efficacy of the feed will be carried out.
(6) Every feed registration certificate shall expire
(a) on September 30, 1996, if issued before January 1, 1985;
(b) on March 31, 1997, if issued during the period beginning on January 1, 1985 and ending on December 31, 1986;
(c) on March 31, 1998, if issued during the period beginning on January 1, 1987 and ending on March 31, 1996;
(d) on March 31 of the third year that follows the year of registration or the year of the latest renewal, as the case may be, if issued after March 31, 1996;
(e) on the date the Director receives from the registrant Form III of Schedule III indicating that the registrant agrees to surrender the feed registration certificate; or
(f) on the date the certificate of registration is cancelled by the Minister in accordance with section 12.
(7) Any application to renew or amend a registration shall be made to the Minister in the same manner as an application for registration, and is considered to be an application for registration for the purposes of these Regulations.

10 Where a feed that is required to be registered is to be marketed in more than one physical form, one application for registration of that feed may be made, one registration fee paid and one registration number assigned to it.
Refusal to Register and Cancellation of Registration
11 The Director shall refuse to register a feed if, after an assessment or evaluation of the application for registration, there are reasonable grounds to believe that
(a) its brand or name would tend to deceive or mislead a purchaser with respect to its composition or usefulness;
(b) its brand would likely be confused with a brand already applied to a registered feed;
(c) it is deleterious or injurious to livestock or humans when used according to directions;
(d) it is unsuited for the purpose for which it is to be sold or represented;
(e) it does not meet the standards prescribed by these Regulations for that feed;
(e.1) it does not conform to the requirements of the Health of Animals Act, or any regulations made under that Act, respecting animal by-products, animal food or animal products; or
(f) the labelling information or guarantees do not fully describe the usefulness of the feed.

12 (1) Subject to subsections (2) to (4), the Minister shall cancel a certificate of registration in respect of any feed if there are reasonable grounds to believe that, with respect to that feed, there has been a contravention of the Act, these Regulations, the Health of Animals Act or any regulations made under that Act.
(2) A certificate of registration shall be cancelled only if the Minister has sent a notice to the registrant by registered mail that
(a) identifies the provision of the Act or these Regulations that has not been complied with;
(b) sets out a time limit for the registrant to comply with those provisions in order to avoid the proposed cancellation; and
(c) specifies that the registration will be cancelled unless the registrant, within 30 days after the date of mailing the notice, notifies the Minister, in writing, that the registrant wishes to have an opportunity to be heard respecting the proposed cancellation.
(3) Within 30 days after the date of receipt of the written notification referred to in paragraph (2)(c), the Minister shall notify the registrant by registered mail of the time and place of the hearing to determine whether the certificate of registration will be cancelled.
(4) The Minister shall cancel the certificate of registration where
(a) the registrant has failed to notify the Minister pursuant to paragraph (2)(c);
(b) the registrant has failed to comply with, or has failed to bring the feed for which the certificate of registration was issued into compliance with, the provisions of the Act or these Regulations referred to in paragraph 2(a) within the period specified in the notice or continues, after that period has expired, to contravene or fail to comply with those provisions; and
(c) a notice of cancellation of registration has been sent by registered mail to the registrant.

Standards and General Requirements
14 A mixed feed shall not contain
(a) ingredients other than those listed in Schedule IV or V;
(b) medicating ingredients of a brand, at a level or for a purpose or species other than as set out in the Compendium of Medicating Ingredient Brochures unless the feed is a veterinary prescription feed.

15 (1) Every person who manufactures or sells a customer formula feed, a consultant formula feed, a feed described in paragraph 5(2)(d) or a veterinary prescription feed shall keep a copy of each mixing formula used in the manufacture of that feed and retain it
(a) in the case of a customer formula feed, a consultant formula feed or a feed described in paragraph 5(2)(d), for a period of six months from the last date of manufacture of that feed; or
(b) in the case of a veterinary prescription feed, for a period of one year from the last date of manufacture of that feed.
(2) Every consultant formula feed and feed described in paragraph 5(2)(d) shall be
(a) labelled in accordance with sections 26 to 33; and
(b) packaged in accordance with section 34.
(3) Every customer formula feed shall be
(a) manufactured in accordance with a signed customer formula; and
(b) labelled in accordance with section 26.
(4) Every manufacturer of a customer formula feed or a veterinary prescription feed shall keep a copy of the customer formula or the veterinary prescription under which the feed is manufactured in the manufacturer’s possession during the manufacture of that feed and shall keep that copy, together with a list of each date on which the feed was manufactured,
(a) in the case of a customer formula feed, for a period of at least six months from the last date of manufacture of that feed; or
(b) in the case of a veterinary prescription feed, for a period of at least one year from the last date of manufacture of that feed.

16 No significant change shall be made by a registrant to a feed registered under these Regulations unless an application for registration of the feed with the significant change is assessed or evaluated by the Director and the feed is found to comply with these Regulations.

17 Every feed registered under these Regulations that contains a pest control product as defined in the Pest Control Products Act is deemed to be registered under the Pest Control Products Act.
18 (1) A converter feed is not eligible for registration unless the mixing directions in respect of the feed specify
(a) that it must be further mixed prior to feeding;
(b) the name of the feed being converted and the name of the resulting feed; and
(c) the materials and the amount of the feed with which it is to be mixed to make a complete feed.
(2) A micro-premix is not eligible for registration unless its mixing directions specify
(a) that it must be further mixed prior to feeding;
(b) in the case of a micro-premix that does not contain any medicating ingredient and is to be used for mixing with other feed ingredients, that its use be limited to a rate of not less than 5 kg per tonne to make another feed unless labelled with the following statement, namely, “For use only by feed manufacturers who are feed registrants under the Feeds Act.” or “À l’usage exclusif des fabricants d’aliments du bétail titulaires d’un certificat d’enregistrement en vertu de la Loi relative aux aliments du bétail.”.
(c) in the case of micro-premix that contains any medicating ingredient and is to be used for mixing with other feed ingredients, that its use be limited to a rate of not less than 10 kg per tonne to make another feed; and
(d) in the case of a micro-premix that is to be used for mixing with water, that its use be limited to the mixing of the micro-premix in a sufficient proportion to supply, in the daily water requirement, at least the minimum daily requirement of the guaranteed nutrient.
(3) No converter feed, macro-premix or micro-premix shall be labelled with instructions that indicate that the feed can be used for free choice feeding or as a top-dressing on other parts of a diet.
(4) No mineral feed shall contain an ingredient that functions to supply a nutritionally significant amount of carbohydrates.
(5) A trace mineral salt feed is not eligible for registration if it contains ingredients incorporated to supply macro-minerals.

19 (1) Subject to subsections (2) and (3), a feed shall not contain
(a) more than one-half of one per cent of the seeds of weeds listed in Table I of Schedule II except when screenings are sold or offered for sale singly, in which case the screenings may contain any amount not exceeding one per cent of such materials and an additional one per cent of wild mustard and hare’s ear mustard seed;
(b) fluorine in an amount likely to be deleterious to livestock or exceeding the following proportions:
(i) 0.2 per cent (2 000 mg/kg) in any mineral feed for cattle, sheep or horses containing nine per cent or less of phosphorus,
(ii) 0.3 per cent (3 000 mg/kg) in any mineral feed for cattle, sheep or horses containing greater than nine per cent of phosphorus,
(iii) 0.6 per cent (6 000 mg/kg) in a mineral feed for swine, and
(iv) in a complete or balanced feed
(A) 0.004 per cent (40 mg/kg) for horses and rabbits,
(B) 0.005 per cent (50 mg/kg) for cattle and sheep,
(C) 0.015 per cent (150 mg/kg) for swine and turkeys, and
(D) 0.020 per cent (200 mg/kg) for chickens;
(c) must, mould or damage from heat or any other cause that would
(i) render it unfit for feed, or
(ii) make it unsafe for feeding in proportions commonly used;
(d) any product of animal, fish or bird origin that is not fresh or sound or that has not been properly processed in accordance with good manufacturing practice;
(d.1) proteins in any form derived in Canada
(i) except in accordance with a permit issued under section 160 of the Health of Animals Regulations for the purpose of section 6.4 of those Regulations, from specified risk material, or
(ii) from the carcasses of any ruminants, other than cattle, that died or were condemned before they otherwise would have been slaughtered for human consumption as food;
(d.2) proteins in any form derived from the carcass of an animal other than
(i) a fish, or
(ii) a food animal, as defined in subsection 2(1) of the Meat Inspection Regulations, 1990, that was slaughtered for human consumption as food or was raised for slaughter for human consumption as food;
(d.3) a fat that is or may contain a fat derived from a ruminant and containing more than 0.15% insoluble impurities;
(e) more than 0.2 per cent feathers or sawdust or more than 0.3 per cent of feathers and sawdust combined;
(f) any extraneous material except in such amounts as are unavoidable in good manufacturing practice;
(g) any chaff, dust, knuckles or like material, except as a declared ingredient or as a recognized tolerance in a declared ingredient;
(h) in the case of a feed that is chopped, crushed or ground, more than 15 viable seeds per 30 g of the weeds listed in Table 2 of Schedule II;
(i) aflatoxins in an amount exceeding 20 parts per billion;
(j) any material in quantities that could, when fed in proportions commonly used or as specified in the feeding directions, result in the production of an article of food that is prohibited from sale by virtue of section 4 of the Food and Drugs Act; or
(k) any material, other than those referred to in paragraphs (a) to (j), in quantities likely to be deleterious to livestock, when fed in proportions commonly used or as specified in the feeding directions.
(2) A feed labelled with instructions for feeding only to beef cattle three months of age or over and with a caution to discontinue the feeding of it at least 48 hours before marketing or slaughter may contain up to 15 per cent in the aggregate of the materials listed in Table 1 of Schedule II, except darnel and purple cockle.
(3) Paragraph (1)(a) does not apply to unground screenings when labelled or invoiced as cereals grain screenings uncleaned (uncleaned screenings) or cereals grain screenings refuse (refuse screenings).

20 Every feed shall have the uniformity of mix, the chemical composition and the physical composition necessary for it to be efficacious for the purpose for which it is manufactured, sold or represented.
21 (1) Chopped, crushed or ground grain sold as a feed or as an ingredient or constituent of a feed shall meet the minimum standards of quality allowed under the Canada Grain Act and Canada Grain Regulations for the lowest Class I (Statutory) or Class II (Special Grades) grade of that kind of grain, except that, when a numerical grade is claimed for such grain, the grain shall meet the standards of quality of that grade under the Canada Grain Act or Canada Grain Regulations.
(2) Where oats wild-oats-cereals grain (Mixed Feed Oats), commercial grades of grain or off-grades of grain are ground, crushed or chopped, they shall be labelled in a manner satisfactory to describe their quality, using the terminology applied to such kind and quality of grain under the Canada Grain Act if such terminology is consistent with feed terminology and these Regulations.
22 (1) Every mixed feed that is sold or imported under a name set out in Column I of Table 3 of Schedule I shall conform to any definition of that feed in section 2 and to the standards prescribed in these Regulations for that feed and shall be packaged and labelled as prescribed in these Regulations.
(2) Every single ingredient feed sold or imported under a name set out in italics in an item of Schedule IV shall conform to the description of that feed set out in that item and to the standards prescribed in these Regulations for that feed and shall be packaged and labelled as prescribed in these Regulations.

Guaranteed Analysis
24 (1) Subject to subsections (2) and (3), the guaranteed analysis required by these Regulations for the purposes of the labelling of a feed shall include the appropriate particulars set out in Column II of an item of Table 3 of Schedule I for the feed described in Column I of that item.
(2) Where a feed is in an individual feeding form, the guaranteed analysis referred to in subsection (1) may include a statement of the amount per individual feeding form of each nutrient set out in column II of an item of Table 3 of Schedule I for the feed set out in column I of that item.
(3) The guaranteed analysis required by these Regulations for the purposes of the registration or labelling of a single ingredient feed shall include the appropriate particulars set out in Schedule IV.

Tolerances
25 (1) The tolerances set out in Column III of an item of Table 1 of Schedule I shall be applied to the analysts’ results for the purpose of determining the accuracy of the nutrient guarantees for the nutrients set out in Column I of that item.
(2) The tolerances set out in Column II of an item of Table 2 of Schedule I shall be applied to the analysts’ results for the purpose of determining the accuracy of the guarantee for a medicating ingredient of a feed.
Labelling
26 (1) Subject to subsections (2) to (6), every feed that is manufactured, sold or imported shall have attached to it or to a package containing it or, if the feed is shipped in bulk, to or on the invoice, shipping bill or statement delivered to the purchaser with the shipment, a label containing the following information:
(a) in the case of a feed not required to be registered, the name and address of the person who manufactured the feed or caused it to be manufactured;
(b) in the case of a feed required to be registered, the name and address of the registrant;
(c) the name of the feed in accordance with section 32;
(d) the brand of the feed, if any;
(e) the registration number, where applicable;
(f) the net amount
(i) expressed as the number of units in a package, in the case of a package of feed containing individual feeding forms, or
(ii) expressed as the mass or volume in the package or shipment, in the case of any other package or bulk shipment of feed;
(g) an accurate statement of the guaranteed analysis in respect of the feed;
(h) subject to subsection 27(3), directions for use in sufficient detail to permit the safe and effective use of the feed for its intended purpose by users with no special knowledge of the purpose and use of the feed;
(i) if the feed is or contains prohibited material, as defined in subsection 162(1) of the Health of Animals Regulations, the following statement written legibly, indelibly and conspicuously:
“Feeding this product to cattle, sheep, deer or other ruminants is illegal and is subject to fines or other punishment under the Health of Animals Act./Il est interdit d’en nourrir les bœufs, moutons, cerfs et autres ruminants et des amendes ou autres peines sont prévues à cet égard par la Loi sur la santé des animaux.”;
(j) in the case of a feed that is required to comply with the guarantees set out in item 7 of Table 3 of Schedule I, the name of each ingredient in the feed;
(j.1) in the case of a feed, other than a feed referred to in paragraph (j), the name of each ingredient in the feed or the statement “A list of the ingredients used in this feed may be obtained from the manufacturer or registrant./La liste des ingrédients de cet aliment peut être obtenue du fabricant ou du titulaire de l’enregistrement.”;
(k) if the feed contains a medicating ingredient and is in a form other than a mash, the particular form of the feed;
(l) an identification code, in the case of a micro-premix feed or a feed designed to replace whole milk in the ration of the livestock;
(m) if the feed is a medicated feed, other than a veterinary prescription feed,
(i) the name and actual amount of the medicating ingredient present in the feed, in accordance with the Compendium of Medicating Ingredient Brochures, in direct association with the feed name,
(ii) the claim or claims applicable to the kind of medicating ingredient present in the feed, the level of medicating ingredient present in the feed and the type of livestock for which the feed is intended, as set out in the Compendium of Medicating Ingredient Brochures,
(iii) every caution statement in respect of the medicating ingredient present in the feed that is set out in the Compendium of Medicating Ingredient Brochures under or next to the heading, in bold print, “Caution” or “Précaution”, and
(iv) every warning statement in respect of the medicating ingredient present in the feed that is set out in the Compendium of Medicating Ingredient Brochures under or next to the heading, in bold print, “Warning” or “Mise en garde”;
(n) [Repealed, SOR/93-157, s. 1]
(o) in the case of a consultant formula feed, the name and address of the specific purchaser for whom the feed was manufactured; and
(p) any other information, notes, caution statements or warning statements necessary to convey useful information to the purchaser of the feed.
(2) For the purposes of subparagraph (1)(m)(iii), the caution statements required to be shown on a label shall be preceded by the word “Caution” or “Précaution” in bold print and each caution statement shall be clearly separated from any other caution statement and any other information shown on the label.
(3) For the purposes of subparagraph (1)(m)(iv), the warning statements required to be shown on a label shall be preceded by the words “Warning” or “Mise en garde”, in bold print, and each warning statement shall be clearly separated from any other warning statement and any other information shown on the label.
(4) Subsection (1) does not apply to a customer formula feed that does not contain a medicating ingredient but such customer formula feed shall
(a) when in packages, have on at least one package in each lot a label showing the name of the supplier of the formula, the name of the feed in accordance with section 32, the net mass of individual packages of the feed and the number of packages in the lot; and
(b) when in bulk, have on the shipping bill or statement acompanying the shipment, the name and address of the supplier of the formula, the name of the feed in accordance with section 32 and the net mass of the feed in the shipment.
(5) A customer formula feed that contains a medicating ingredient shall have on each package, on the shipping bill or on a statement accompanying the shipment
(a) the name and address of the supplier of the feed; and
(b) all the information required by subsection (1), other than the information contained in paragraphs (1)(g), (i) and (j).
(6) Subsection (1) does not apply to a customer formula feed if the feed is manufactured by a livestock feeder and is used for feeding to his own livestock.
(7) In addition to the labelling requirements prescribed in subsection (1), a veterinary prescription feed shall have on each package or, if the feed is shipped in bulk, on the shipping bill, or on a statement accompanying the shipment
(a) the name and address of the manufacturer;
(b) the name of the person for whom the feed was manufactured;
(c) the name of the veterinarian who issued the veterinary prescription;
(d) the name of the feed including the name and amount of the medicating ingredient present in the feed;
(e) the directions for use including the duration of feeding, as indicated on the veterinary prescription;
(f) any caution statement or warning statement indicated on the veterinary prescription and in the format indicated in subsections (2) and (3); and
(g) the net mass of the feed.
(8) In addition to the labelling requirements prescribed in subsection (1), a single ingredient feed shall be labelled in accordance with the labelling requirements set out for that feed in Schedule IV.
(9) Where any reference, direct or indirect, is made on a label or container to the place of manufacture of the label or container and not to the place of manufacture of the feed, the reference shall be accompanied by an additional statement indicating that the place of manufacture refers only to the label or container.
(10) Where a feed that is manufactured or produced and labelled in a country other than Canada has applied to it a label that shows the identity and principal place of business of the person in Canada for whom the feed was manufactured or produced for resale, the identity and principal place of business of that person shall be preceded by the words “imported by” or “importé par” or by the words “imported for” or “importé pour”, unless the geographic origin of the product is stated on the label.
(11) No statement shall be made on the label of a feed indicating that such feed has been biologically tested unless
(a) the feed has been biologically tested using scientifically acceptable test methodology;
(b) the results of such tests support any claim contained in the statement or any claim implied by the statement; and
(c) evidence that such tests have been made and the results of such tests have been supplied to the Director for assessment or evaluation.

27 (1) Any information required to be shown on the label of a feed shall be printed conspicuously, legibly and indelibly in English or French or both languages.
(2) Subject to subsection (3) and unless otherwise authorized by the Director, any information that is required to be shown on a label shall appear on the main panel of the package label or, where the package contains less than 5 kg, on the surface of the package.
(3) Any directions for use required to be shown on a label may refer to an insert containing detailed directions for use if such an insert is enclosed within the package that bears the label.

28 A label shall not contain
(a) any variation in the character, size, colour or placing of the printing that obscures or emphasizes any part of the information required to be shown on that label unless such variation is to draw attention to the caution statements or warning statements required to be shown on the label;
(b) any incorrect or misleading information or mark;
(c) any claim for a mixed feed or any ingredient in the feed unless evidence has been assessed or evaluated and has been found to support the claim; or
(d) any claim for a single ingredient feed unless evidence has been assessed or evaluated and has been found to support the claim.

30 The label for a feed shall not show a guarantee for a nutrient that is not required to be guaranteed unless
(a) the amount of the nutrient guaranteed is such that, when used as directed, the complete diet including the feed will supply at least the minimum generally accepted requirements for that nutrient for the intended class of livestock; and
(b) the guarantee is approved in writing by the Director as conveying useful information to the feed purchaser.
Naming Feeds
31 The name of a feed shall be appropriate for the intended use of the feed and shall not be misleading.
32 (1) Subject to subsections (2) to (6), every mixed feed designed for a unique species or class of livestock shall have as part of the name or in direct association with it the name of the species or class of livestock and the purpose for which it is intended.
(2) Micro-premixes, facilitating agents, feed preservatives and other feeds that are not designed for unique species or classes of livestock shall have as part of the name or in direct association with it a general nutritive classification such as “Vitamin A, D, E Premix” or “prémélange de vitamines A, D et E” or a general functional classification such as “Antioxidant” or “antioxydant” acceptable to the Director.
(3) Where the word “growing” or “croissance”, “laying” or “ponte”, “breeder” or “reproduction” or other similar word is used as part of the name of a feed and the feed is intended for chickens, the name is not required to have as part of its name the kind of livestock for which it is intended.
(4) Where the word “dairy” or “laitier” is used as part of the name of a feed and the feed is intended for lactating dairy cows, the name is not required to have as part of its name the kind of livestock for which it is intended.
(5) Where a feed is a premix or supplement formulated for a unique species but may be used for more than one purpose, the feed name shall indicate each purpose for which the feed is intended or the feed name shall include the word “Multipurpose” or the words “à usages multiples” and the directions for use of the feed shall indicate each purpose for which the feed is promoted or intended to be used.
(6) Where a feed is a mineral feed, the feed shall have as part of its name or in direct association with it the name of each kind of livestock for which it is intended.
(7) Where a feed is identical as to kind with another feed of the same manufacturer but is guaranteed to contain a different level of protein from the other feed, the brand of the feed shall be different from the brand of the other feed or the percentage of protein content of the feed shall form part of the name of the feed.
(8) Where a feed is a micro-premix or a macro-premix, the word “premix” or “prémélange” shall form part of the name of the feed and, where a feed is a supplement, the word “supplement” or “supplément” shall form part of the name of the feed.
Units of Measurements Shown on Labels
33 (1) All units of measurement shown on a label of a feed shall be expressed in metric measure only in accordance with the Weights and Measures Act.

Packaging
34 (1) Subject to subsection (2) every package of feed that contains from 5 kg to 50 kg of feed shall contain either 5 kg, 10 kg, 20 kg, 25 kg, 40 kg or 50 kg of such feed.
(2) Subsection (1) does not apply to
(a) packages of feed shipped to a manufacturer of feed if the feed is not to be resold in those packages;
(b) packages that contain a net quantity of 36 kg of crushed or crimped unhulled oats, brewers dried grains, oyster shell, clam shell or any feed material purported or commonly considered to be a source of calcium, calcium and grit, phosphorus or phosphorus and calcium;
(c) packages used by a retailer for containing feed to be sold in bulk;
(d) packages that contain a macro-premix or micro-premix; or
(e) packages of feed authorized by the Director to be of a size different from those referred to in subsection (1) in order to facilitate
(i) the availability of feed in cases of emergency,
(ii) the test marketing of a feed in such package sizes as the manufacturer customarily manufactures and sells,
(iii) unit sizing of a package in which the directions for use indicate that the entire contents of the package are to be used to serve as an individual dose or portion or to prepare a lot or batch of feed, or
(iv) the manufacture and sale of feeds for which industrial equipment is not readily available to package the product in sizes referred to in subsection (1).
(3) Subsections (1) and (2) shall cease to be in force on January 1, 1994.

Samples for Analysis
36 (1) A sample of feed submitted by an inspector for analysis shall represent fairly the lot of feed from which the sample is taken and be of sufficient size to be satisfactory for analytical purposes.
(2) Where the feed to be analysed is in packages having a mass of more than 5 kg, approximately equal portions shall be taken from not less than five separate packages of the feed or, where the lot contains less than five packages, approximately equal portions shall be taken from each of the packages.
(3) Where the feed to be analysed is in bulk, approximately equal portions shall be taken from not less than five separate sections of the bulk.
(4) Where the feed to be analysed is in packages each having a mass of 5 kg or less, one unbroken package may constitute a sample.
(5) Where a portion of the feed that is to be analysed appears mouldy or otherwise damaged in a manner to affect its suitability for feeding purposes, separate samples may be taken of the undamaged portion and the damaged portion.
Detentions
37 (1) Any article seized pursuant to section 9 of the Act may be detained by an inspector at any place by attaching a detention tag to the article or to any part of it.
(2) Where an article is detained pursuant to subsection (1), an inspector shall deliver or mail a notice of detention to its owner or to the person in possession of it.
(3) No person shall alter or remove a detention tag or sell or move any detained article unless an inspector gives written authorization to the person to do so.
(4) Where an article is released from detention, an inspector shall deliver or mail a notice of release to its owner or to the person in possession of it.
(5) Any article forfeited under section 9 of the Act shall be disposed of in the following manner:
(a) in the case of a feed that is fit for consumption by livestock, it shall be
(i) sold and the proceeds deposited to the credit of the Receiver General, or
(ii) donated to a charitable institution;
(b) in the case of a feed that is not fit for consumption by livestock, it shall be disposed of in a safe manner; and
(c) in the case of an article other than a feed, it shall be sold and the proceeds deposited to the credit of the Receiver General.

Alfalfa meal dehydrated (IFN 1-00-025) consists of the aerial part of the alfalfa plant, reasonably free of other crop plants, weeds and mold, that has been finely ground and dried by thermal means. Alfalfa stems sun-cured ground (or Alfalfa stem meal (IFN 1-00-165) consists of the finely ground sun-cured aerial part of the alfalfa plant from which the leaves have been removed. It shall be reasonably free of other crop plants and weeds. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.

Cellulose powdered (or Cellulose) (IFN 1-15-514) is the purified, mechanically disintegrated polysaccharide consisting of glucose in a beta (1-4) linkage prepared by processing alpha cellulose obtained as a pulp from fibrous plant materials.
1.8
Cereals grass meal dehydrated (or Dehydrated cereal grass) (IFN 1-16-289) consists of the aerial part of a cereal grass, reasonably free of other crop plants, weeds and mold, that has been finely ground and dried by thermal means. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.

Maize cobs, dehydrated, fine ground (or Corn cobs, dehydrated, fine ground or Fine grind maize cob meal or Fine grind corn cob meal) (IFN 1-02-781) consists of the entire corn cob that has been finely ground and dried by thermal means. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.

Maize, cob fractions, screened (or Corn, cob fractions, screened or Maize cob fractions or Corn cob fractions) (IFN 1-02-779) consists of the hard woody, ring or beeswing fractions obtained by screening ground corn cobs. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.

Oats hulls (IFN 1-03-281) consists of the outer coverings of threshed oats and any by-product obtained in the milling of table cereals or in the groating of oats, from clean oats and containing more than 22 percent crude fibre. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.
1.12
Oats groats by-product less than 22 percent fibre (or Oat feed or Oat mill by-product) (IFN 1-03-332) consists of the by-product obtained in the manufacture of oat groats, consisting of oat hulls and particles of the groat and containing not more than 22 percent crude fibre. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.

Peanut pods (or Peanut hulls) (IFN 1-08-028) consists of the outer hull or the peanut shell. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.

Peanut seed coats (or Peanut skins) (IFN 1-03-631) consists of the outer covering of the peanut kernel, exclusive of hulls, as obtained in ordinary commercial processing. Maize bran (or Corn bran) (IFN 4-02-841) consists of the outer coating of the corn kernel with little or none of the starchy part or germ.
4.2.4
Maize ears ground (or Corn ears ground or Maize and cob meal or Corn and cob meal) (IFN 4-02-849) consists of the entire ground ear of corn, including the kernels, without husks, with no greater proportion of cob than occurs naturally in the ear.
4.2.5
Maize flour (or Corn flour) (IFN 4-08-024) consists of the fine sized hard flinty portions of ground corn containing little or none of the bran or germ.
4.2.6
Maize grain fines (or Corn grain fines or Maize feed meal or Corn feed meal) (IFN 4-02-880) consists of the fine siftings obtained from screened cracked corn, with or without its aspiration products added.
4.2.7
Maize grits (or Corn grits or Hominy grits) (IFN 4-02-886) consists of the medium sized hard flinty portions of ground corn containing little or none of the bran or germs.
4.2.8
Maize grits by-product (or Corn grits by-product or Hominy feed) (IFN 4-02-887) consists of a mixture of corn bran, corn germ and part of the starchy portion of either white or yellow corn kernels or mixture thereof, as produced in the manufacture of pearl hominy, hominy grits or table meal. It shall contain not less than 4 percent crude fat. If prefixed by the words “white” or “yellow”, the product shall correspond thereto.
4.2.9
Maize extractives fermented condensed (or Corn extractives fermented condensed or Condensed fermented maize extractives or Condensed fermented corn extractives) (IFN 4-02-890) is obtained by the partial removal of water from the liquid resulting from steeping corn in a water and sulphur dioxide solution that is allowed to ferment by the action of naturally occurring lactic acid producing microorganisms, as practised in the wet milling of corn. It shall be labelled with guarantees for minimum crude protein and minimum dry matter.
4.2.10
Oats groats (IFN 4-03-331) consists of cleaned oats without hulls.
4.2.11
Rice bran with germs (or Rice bran) (IFN 4-03-928) consists of the pericarp or bran layer and germ of rice, with only such quantity of hull fragments, chipped, broken, or brewer’s rice, and calcium carbonate as is unavoidable in the regular milling of edible rice. It shall contain less than 13 percent crude fibre. It shall be labelled with guarantees for maximum calcium carbonate when the calcium carbonate exceeds 3 percent.
4.2.12
Rye flour by-product less than 8.5 percent fibre (or Rye middlings) (IFN 4-04-031) consists of rye feed and rye red dog combined in the proportions obtained in the usual process of milling rye flour. It shall contain less than 8.5 percent crude fibre.
4.2.13
Soybean flour by-product (Soybean mill feed) (IFN 4-04-594) consists of soybean hulls and the offal from the tail of the mill resulting from the manufacture of soy grits or flour. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre and maximum moisture.
4.2.14
Wheat bran (IFN 4-05-190) consists of the coarse outer covering of the wheat kernel as separated from cleaned and scoured wheat in the usual process of commercial flour milling.
4.2.15
Wheat flour less than 1.5 percent fibre (IFN 4-05-199) consists principally of wheat flour together with fine particles of wheat bran, wheat germ and the offal from the “tail of the mill”. It shall contain less than 1.5 percent crude fibre.
4.2.16
Wheat flour by-product less than 7 percent fibre (or Wheat middlings) (IFN 4-05-201) consists of a small proportion of fine bran particles, germ and a large proportion of floury endosperm particles as separated in the usual processes of commercial flour milling. It shall contain less than 7 percent crude fibre.
4.2.17
Wheat flour by-product less than 9.5 percent fibre (or Wheat shorts) (IFN 4-05-205) consists of the fine bran particles, germ and a small proportion of floury endosperm particles as separated in the usual processes of commercial flour milling. It shall contain less than 9.5 percent crude fibre.
4.2.18
Wheat mill run less than 9.5 percent fibre (or Wheat mill run) (IFN 4-05-206) consists of all parts of the wheat kernel, except flour, separated in the usual processes of commercial flour milling. The parts included are wheat bran, wheat shorts, and wheat middlings. It shall contain less than 9.5 percent crude fibre.
4.3

4.3.1
Cereals grain screenings grade 1 (or No. 1 Feed screenings) (IFN 4-02-154) means No. 1 Feed Screenings referred to in the Off Grades of Grain and Grades of Screenings Order.
4.3.2
Cereals grain screenings grade 2 (or No. 2 Feed screenings) (IFN 4-02-155) means No. 2 Feed Screenings referred to in the Off Grades of Grain and Grades of Screenings Order.
4.3.3
Cereals grain screenings refuse (or Refuse screenings) (IFN 4-02-151) means refuse screenings referred to in the Off Grades of Grain and Grades of Screenings Order.
4.3.4

4.4
Molasses and Related Products
4.4.1
Beet sugar molasses (or Beet molasses) (IFN 4-30-289) is a by-product of the manufacture or refining of sucrose from sugar beets. It shall be labelled with a guarantee for minimum total sugars expressed as invert.
4.4.2
Beet sugar pulp dehydrated (or Plain dried beet pulp) (IFN 4-00-669) consists of the dried residue from sugar beets that have been cleaned and freed from crowns, leaves and sand and that have been extracted in the process of manufacturing sugar. It shall be labelled with guarantees for minimum crude protein, maximum moisture and maximum crude fibre.
4.4.3
Beet sugar pulp, molasses dehydrated added (IFN 4-00-672) consists of a free-flowing and friable dried molasses product made by dehydrating molasses that has been mixed with plain dried beet pulp, an absorbent material. It shall be labelled with guarantees for minimum crude protein, minimum invert sugars, maximum crude fibre and maximum moisture.
4.4.4
Beet sugar molasses, soybean mill run dehydrated added (IFN 4-30-291) consists of a free-flowing and friable dried molasses product made by dehydrating molasses that has been mixed with soybean mill run, an absorbent material. It shall be labelled with guarantees for minimum crude protein, minimum invert sugars, maximum crude fibre and maximum moisture.
4.4.5
Beet sugar molasses, corn cob fractions dehydrated added (IFN 4-30-292) consists of a free-flowing and friable dried molasses product made by dehydrating molasses that has been mixed with corn cob fractions, an absorbent material. It shall be labelled with guarantees for minimum crude protein, minimum invert sugars, maximum crude fibre and maximum moisture.
4.4.6
Sugarcane molasses (IFN 4-13-251) is a by-product of the manufacture or refining of sucrose from sugarcane. It shall be labelled with a guarantee for minimum total sugars expressed as invert.
4.4.7
Sugarcane molasses distillers solubles condensed (or Molasses distillers condensed solubles) (IFN 4-04-697) is obtained by condensing to a syrupy consistency the residue from the yeast fermentation of sugarcane molasses after the removal of alcohol by distillation. It shall be labelled with a guarantee for maximum moisture.
4.4.8
Sugarcane molasses, soybean mill run dehydrated added (IFN 4-16-831) consists of a free flowing and friable dried molasses product made by dehydrating molasses that has been mixed with soybean mill run, an absorbent material. It shall be labelled with guarantees for minimum crude protein, minimum invert sugars, maximum crude fibre and maximum moisture.
4.5
Animal and Vegetable Fats
4.5.1
Animal fat (or Feeding fat) (IFN 4-00-409) consists of the fat obtained from the tissues of mammals or poultry or both. If the product bears a name descriptive of its kind or origin; e.g. tallow, lard or grease, it shall correspond thereto. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for maximum moisture, maximum insoluble matter, maximum unsaponifiable matter and maximum free fatty acid.
4.5.2
Animal vegetable fat (or Animal vegetable feeding fat) (IFN 4-12-249) consists of the fat of mammals or poultry and vegetable fat in any combination. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for maximum moisture, maximum insoluble matter, maximum unsaponifiable matter and maximum free fatty acid.
4.5.3
Canola oil low erucic acid low glucosinolates (or Canola oil) (IFN 4-06-144) consists of the oil extracted from whole seeds of the species Brassica napus or Brassica campestris the oil component of which seed contains less than 2 percent erucic acid and the solid component of which seed contains less than 30 micromoles of any one or any mixture of 3-butenyl glucosinolate, 4-penteny1 glucosinolate, 2-hydroxy-3-butenyl glucosinolate and 2-hydroxy-4-pentenyl glucosinolate per gram of air dry, oil free solid (GLC method of the Canadian Grain Commission). It shall be refined, bleached and deodorized. It shall have a saponification value (milligrams potassium hydroxide per gram of oil) of not less than 182 and not more than 193. It shall have an erucic acid content of less than 2 percent (w/w) of the component fatty acids. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for maximum moisture, maximum insoluble matter, maximum unsaponifiable matter, maximum free fatty acids and maximum erucic acid.
4.5.4
Coconut kernels with coats oil (or Coconut oil) (IFN 4-09-320) consists of the oil extracted from the whole kernels of Cocos nucifera L. It consists predominantly of glyceride esters of fatty acids. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for maximum moisture, maximum insoluble matter, maximum unsaponifiable matter and maximum free fatty acids.
4.5.5
Maize endosperm oil (or Corn endosperm oil or Maize oil or Corn oil) (IFN 4-02-852) consists of the oil extracted from corn gluten. It consists predominantly of glyceride esters of fatty acids. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for maximum moisture, maximum insoluble matter, maximum unsaponifiable matter and maximum free fatty acids.
4.5.6
Soybean seeds oil (IFN 4-07-983) consists of the oil from soybean seeds that are commonly processed for edible purposes. It consists predominantly of glyceride esters of fatty acids. If partially hydrogenated, it shall be so indicated on the label. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for maximum moisture, maximum insoluble matter, maximum unsaponifiable matter and maximum free fatty acids.
4.5.7
Soybean lecithin (or Soy lecithin) (IFN 4-04-562) is the product obtained from soybean oil by a degumming process. It contains lecithin, cephalin and inositol phosphatides together with glycerides of soybean oil and traces of tocopherols, glucosides and pigments. It shall be labelled with guarantees for maximum crude fat, maximum free fatty acids and maximum moisture.
4.5.8
Vegetable oil (IFN 4-05-077) consists of the product of vegetable origin obtained by extracting the oil from seeds or fruits that are commonly processed for edible purposes. It consists predominantly of glyceride esters of fatty acids and contains no additions of free fatty acids or other material obtained from fats. If an antioxidant(s) is used, the common name or names shall be indicated on the label. It shall be labelled with guarantees for minimum total fatty acids, maximum moisture, maximum unsaponifiable matter and maximum insoluble matter.
4.6
Others
4.6.1
Bakery waste dehydrated (IFN 4-00-466) consists of a mixture of bread, cookies, cake, crackers, flours and doughs that have been mechanically separated from non-edible material, artificially dried and ground. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre, maximum moisture and maximum salt.
4.6.2
Cattle whey condensed (or Condensed whey) (IFN 4-01-180) consists of the residue remaining after the removal of a portion of the moisture from whey by 8thermal means. It shall be labelled with guarantees for minimum crude protein, minimum lactose, maximum moisture and minimum total solids.
4.6.3
Cattle whey cultured condensed (or Condensed cultured whey) (IFN 4-01-181) is the residue obtained by partially removing water from lactic acid bacteria cultured whey. It shall be labelled with one or both of the following statements:
“This product is free of antimicrobial activity and is not a source of viable microbial cells.”; or
« Ce produit est exempt d’activité anti-microbienne et n’est pas une source de cellules microbiennes vivantes. »
It shall also be labelled with guarantees for minimum crude protein, maximum equivalent crude protein from non-protein nitrogen and minimum total solids.
4.6.4
Cattle whey dehydrated (or Dried whey) (IFN 4-01-182) consists of the residue remaining after the drying of or evaporating of whey by thermal means. It shall be labelled with guarantees for minimum crude protein, minimum lactose and maximum moisture.
4.6.5
Cattle whey low lactose dehydrated (or Dried whey product) (IFN 4-01-186) consists of the residue obtained by drying whey by thermal means from which a portion of the lactose has been removed. It shall be labelled with guarantees for minimum crude protein, minimum lactose and maximum moisture.
4.6.6
Lactose C12H22O11 (IFN 4-02-486) is the disaccharide containing galactose and glucose. It shall be labelled with a guarantee for minimum lactose.
4.6.7
Cereals breakfast process residue (or Cereal-offal or Cereals food fines) (IFN 4-01-199) consists of particles of breakfast cereals obtained as a by-product of their processing. It shall be labelled with guarantees for minimum crude protein, maximum crude fibre, maximum moisture and maximum salt.
4.6.8
Cornstarch (IFN 4-02-889) is the granular polymer consisting of amylose and amylopectin which has been separated from the mature seed endosperm of corn.
4.6.9
Apple pomace dehydrated (or Dried apple pomace) (IFN 4-00-423) consists of the sound, dried residue obtained by the removal of cider from apples. It shall be labelled with guarantees for minimum crude protein, maximum moisture and maximum crude fibre.
4.6.10
Maize grain starch heat hydrolyzed (or Corn grain starch heat hydrolyzed or Malto dextrins) (IFN 4-08-023) is the dried purified concentrated product of nutritive saccharides derived from the starch of corn and having a dextrose equivalent less than 20. It shall be labelled with a guarantee for maximum dextrose equivalent (as determined by A.O.A.C. method 31.245, 14th edition).
4.6.11
Maize syrup (or Corn syrup) (IFN 4-20-104) is the purified concentrated aqueous solution of nutritive saccharides obtained from corn starch and having a dextrose equivalent not less than 20. It shall be labelled with a guarantee for minimum dextrose equivalent (as determined by A.O.A.C. method 31.245, 14th edition).
4.6.12
Maize syrup process residue (or Corn syrup process residue or Maize syrup refinery insolubles or Corn syrup refinery insolubles) (IFN 4-04-893) consists predominantly of the fatty fraction of corn starch together with protein and residual carbohydrate obtained in the refining of corn syrup. It shall be labelled with guarantees for minimum crude fat, maximum ash and maximum moisture.
4.6.13
