Order Suspending the Application of Concessions On Imports of Certain Products Originating in the United States
P.C. 2005-615 2005-04-19Her Excellency the Governor General in Council, on the recommendation of the Minister for International Trade, pursuant to subsections 13(1) and (3) of the World Trade Organization Agreement Implementation ActFootnote a, hereby makes the annexed Order Suspending the Application of Concessions On Imports of Certain Products Originating in the United States.

1 In this Order, U.S. goods means goods that are classified under the following tariff item Nos. in the List of Tariff Provisions set out in the schedule to the Customs Tariff that originate in the United States, as determined in accordance with sections 1 and 2 of the Most-Favoured-Nation Tariff Rules of Origin Regulations:

(a) 0103.10.00;
(b) 0103.91.00;
(c) 0103.92.00;
(d) 0301.10.00;
(e) 0303.79.00;
(f) 0307.10.10;
(g) 0307.10.20; and
(h) 2402.20.00.

Exception

2 This Order does not apply to U.S. goods that are in transit to Canada on May 1, 2005.

Surtax

3 Rights and privileges on U.S. goods under the Customs Tariff are partially suspended by imposing a surtax on those goods in an amount of 15% ad valorem on the value for duty as determined in accordance with sections 45 to 55 of the Customs Act.

Effective Period

4 This Order shall have effect for the period commencing on May 1, 2005 and ending on April 30, 2006.

Coming into Force

5 This Order comes into force on May 1, 2005.
