Amending Reg. 611 of R.R.O. 1990

(Safety Inspections)

1. The definitions of “dual fuel”, “dump vehicle”, “dump vehicle inspection sticker”, “original equipment manufacturer propane fueled motor vehicle”, “propane fueled motor vehicle” and “propane vehicle inspection sticker” in section 1 of Regulation 611 of the Revised Regulations of Ontario, 1990 are revoked.

2. Section 3 of the Regulation is amended by striking out “a propane fueled motor vehicle”.

3. Sections 6 and 7 of the Regulation are revoked.

4. Subsection 8 (1) of the Regulation is revoked and the following substituted:

(1) A commercial vehicle is prescribed as a type or class of vehicle to which section 85 of the Act applies if it has a combined gross weight exceeding 4,500 kilograms.

5. Sections 9 and 12 of the Regulation are revoked.

6. Subsection 13 (2) of the Regulation is amended by striking out “a propane vehicle inspection sticker or a dump vehicle inspection sticker”.

7. (1) Subsection 1 (9) of Schedule 1 to the Regulation is revoked.

(2) Subsection 2 (12) of Schedule 1 to the Regulation is amended by striking out the portion before clause (a) and substituting the following:

(12) Despite subsections (10) and (11), with the service brakes properly adjusted, they may be tested using a plate type dynamic tester approved by the Director or a commercially available roller type dynamic brake tester, in the manner prescribed by the manufacturer and,

8. Subsection 1 (4) of Schedule 2 to the Regulation is amended by striking out the portion before clause (a) and substituting the following:

(4) Despite subsections (2) and (3), with the service brakes properly adjusted, they may be tested using a plate type dynamic tester approved by the Director or a commercially available roller type dynamic brake tester, in the manner prescribed by the manufacturer and,

9. Schedules 3, 7 and 8 to the Regulation are revoked.

10. This Regulation comes into force on the later of January 1, 2010 and the day this Regulation is filed.
