An Act Respecting the
Rights of Fishing in Nova Scotia
1 This Act may be cited as the Angling Act. R.S., c. 14, s. 1.
2 In this Act,
(a) "lawfully fishing" means fishing in accordance with thegame laws of the Province and the laws of the Dominion ofCanada and any regulations made thereunder for the purpose ofsport, and includes the taking and carrying away of any fishlawfully caught;
(b) "occupant" means a person having the right, exclusive of thepublic, to fish in any river, stream or lake either as the owner ofthe lands abutting thereon or otherwise;
(c) "owner" means a person having the rightful possession ofand control over lands, either as holder of the legal title, as tenantor otherwise, and includes joint owners and tenants in common;
(d) "timberland" means uncultivated land used or held only orprimarily for lumber purposes;
(e) "uncultivated land" means land that is in its natural wildstate, and includes also land that has been wholly or partiallycleared, but is otherwise in its natural state. R.S., c. 14, s. 2.
Right to go upon land, river, stream or lake
3 (1) Any resident of the Province shall have the right to go onfoot along the banks of any river, stream or lake, upon and across anyuncultivated lands and Crown lands for the purpose of lawfully fishingwith rod and line in such rivers, streams or lakes.
(2) Any resident of the Province shall have the right to go on, uponor across any river, stream or lake in boat or canoe or otherwise, for thepurpose of lawfully fishing with rod and line in such rivers, streams orlakes.
(3) The rights conferred by this Section shall not in any way limit orrestrict the right of any owner or occupant to compensation for actualdamages caused by any person going upon or across such lands for thepurpose aforesaid, and shall not be construed to give the right to buildany fires upon such lands.
