An Act to make provision for regulating title purchase of agricultural produce from the primary producers thereof.

1. Short title
This Act may be cited as the Purchase of Agricultural Produce Act.
2. Interpretation
In this Act, unless the context otherwise requires-
"agricultural produce" means any of the following-
(a) crops;
(b) vegetables, fruits, flowers or plants;
(c) horses, cattle, sheep, goats, swine, mules, donkeys or poultry;
(d) the produce of any domestic animals including the carcasses, eggs, bones, horns, hooves, hides, fur, feathers, hair or wool, but does not include milk, cream, cheese or butter
produced in Botswana;
"licence" means any licence issued under section 7 of the Trade and Liquor Act or the Control of Livestock Act.
3. Credits prohibited
No person shall purchase or offer to purchase any agricultural produce from the primary producer thereof subject to a condition that the purchase price of the agricultural produce shall be regarded in whole or in part as a credit for the purpose of enabling the seller of such produce to make future purchases of any kind from the purchaser.
4. Penalties
Any person who contravenes section 3 shall be guilty of an offence and liable to a fine not exceeding Pl00 or to imprisonment for a term not exceeding three months, or to both, and if such person is a licence holder the court may in addition to any other penalty order the cancellation of any licence in respect of which the offence was committed.
