An Act to provide for the preparation of a Public Seal of Botswana; to provide for the custody and use thereof; and to provide for matters incidental thereto or connected therewith.

[Date of Commencement: 30th September, 1966]

 

1.       Short title

 

            This Act may be cited as the Public Seal Act.

 

2.       Preparation of Public Seal

 

            (1) The President shall cause a device to be prepared as the Public Seal of Botswana.

            (2) Such device shall embody the Arms or Ensigns Armorial of Botswana or part thereof.

            (3) When such device has been prepared the President shall publish the same in the Gazette, and thereupon that device shall be the Public Seal of Botswana.

 

3.       Custody of the Public Seal

 

            (1) The President, by notice published in the Gazette, may appoint a person holding office in the service of Botswana to be the Custodian of the Public Seal and may give directions as to the manner in which it shall be kept and used.

            (2) In default of any appointment, the President shall be the Custodian of the Public Seal.

 

4.       Authentication

 

            Whenever the Public Seal is affixed to any document or other thing, the affixation shall be authenticated by the signature of the Custodian of the Public Seal.

 

5.       Public Seal not available

 

            If a Public Seal of Botswana is required for use before the device to be prepared under this Act is available, the President may, by Order, prescribe some other device which shall be the Public Seal of Botswana until the other device is available.
