The Minister responsible for education, in exercise of the power conferred by
section 5 of the Bermuda Government Scholarships Act 2008, makes the following
Regulations:

Citation
These Regulations may be cited as the Bermuda Government Scholarships

Regulations 2013.

Interpretation
In these Regulations—

“the Act” means the Bermuda Government Scholarships Act 2008;

“candidate” means an applicant for a Scholarship;

“Permanent Secretary” means the permanent secretary for the Ministry responsible
for education;

“scholar” means the holder of a Scholarship;

“Scholarship” means a Bermuda Government Scholarship.

Education test
The educational test for the Bermuda Government Scholarships shall be that

the candidate has successfully completed a secondary education programme approved by
the Minister for the purposes of this regulation which qualifies the candidate for entry into
an approved college or university.

Any candidate who produces to the Permanent Secretary documentary
evidence that he has successfully completed a programme referred to in paragraph (1) shall
be considered eligible for selection as a scholar, provided that—

he possesses Bermudian status;

he has been educated in Bermuda for at least five consecutive years; and

he satisfies the other conditions prescribed in the Act and in these
Regulations.

Scholar may accept additional funding
Subject to this regulation, a scholar may accept additional funding by way of

scholarship, bursary, grant or award from his place of study or from another source.

A scholar who accepts such additional funding shall notify the Permanent
Secretary as soon as practicable as to the nature and amount of the funding.

Applications for award of Bermuda Government Scholarships
Every candidate shall, not later than 15th April of the year in which the

Scholarship is to be awarded, or such other date as may be specified by the Permanent
Secretary by an advertisement published in the Gazette, make written application to the
Permanent Secretary.

Scholarships shall be awarded by the Minister under the Act as soon as is
reasonably practicable before 15th August of that year.

Requirements in respect of applications
Every candidate shall attach to his application—

a copy of his birth certificate;

confirmation from the Department of Immigration of his Bermudian
Status;

a certificate from the principal or manager of the secondary school or
programme at which the candidate has been a student, as to the period
during which the candidate has been educated in Bermuda;

a letter as to his extra-curricular or co-curricular activities signed by the
principal or manager of his school or a person who has knowledge of the
above;

two letters of recommendation attesting to his academic achievements and
character;

acceptance letter from an approved college or university offering his
programme of study;

statement of estimated costs of tuition and accommodation;

statement whether he currently holds or will hold or intends to hold any
scholarship, bursary, grant or award from his place of study or from
another source;

secondary school or university or college record or other document, as the
case may be, evidencing grades obtained up to the end of the term or
semester immediately preceding date of application;

any other document or information that may be requested by the
Permanent Secretary for the purpose of the candidate’s application for a
Scholarship.

Any application that is not made in accordance with these Regulations will be
deemed to be incomplete and will not be considered by the Board.

Payment of annual value of scholarship
The annual value of the scholarship shall be paid annually as a lump sum,

unless the Permanent Secretary otherwise determines.

As soon as practicable after the end of the school year and, in any event, prior
to the commencement of a new school year, the scholar shall provide to the Permanent
Secretary a certificate from the head of the approved college or university at which the
scholar is pursuing his studies to the effect—

that the work and conduct of the scholar have been satisfactory; or

that the scholar has been prevented from pursuing his studies by serious
illness or other unavoidable cause.

Without provision of such a certificate to the Permanent Secretary the
Scholarship shall lapse.

But in special circumstances, on the written application of a scholar who has
not provided such a certificate, the Board may decide—

that the Scholarship shall not lapse, and

that the scholar shall be permitted to continue to hold his Scholarship
subject to satisfaction of such conditions consistent with the Act and these
Regulations as the Board may impose.

Method of payment
Upon receipt by the Permanent Secretary of the certificate specified in regulation

7(2), the Permanent Secretary may authorise the payment of any sums of money due to the
scholar with respect to his Scholarship to be made to the scholar or to his order.

Suspension of Scholarship
Subject to this regulation the Board, after giving a scholar an opportunity to

be heard, may sanction the suspension of his Scholarship for cause, including any case
where the Board is satisfied that the scholar has failed to comply with any provision of the
Act or these Regulations.

The Board, at least 21 days before any suspension takes effect, shall give
written notice to the scholar—

setting out the reasons for the Board’s decision; and

advising him of the right to appeal to the Minister.

An appeal brought by the scholar (or by his parent of guardian if he is under
the age of 18 years) must be made in writing to the Minister within 14 days of the date of
the Board’s notice given under paragraph (2), and the Minister’s decision shall be final.

Revocation of 1958 Regulations
Subject to regulation 11(2), the Bermuda Government Scholarships Regulations

1958 are revoked.

Commencement and transitional provision
These Regulations come into operation on the same date as the Bermuda

Government Scholarships Amendment Act 2013 (“the commencement date”) and apply with
respect to persons awarded a Scholarship on or after that date.

Accordingly, in accordance with section 8(2) of that Act, the Bermuda
Government Scholarships Regulations 1958 shall continue to apply to persons who were
awarded a Scholarship before the commencement date.
