PUBLIC SERVICE COMMISSION AMENDMENT REGULATIONS

2008



The Governor, in exercise of the powers conferred upon him by
section 84(5) of the Constitution of Bermuda, after consultation with the
Premier and the Public Service Commission, makes the following
Regulations:

Citation
1 These Regulations, which amend the Public Service Commission
Regulations 2001 (“the principal Regulations”), may be cited as the
Public Service Commission Amendment Regulations 2008.

Staff Medical Board
2 In regulation 30(1)(b) of the principal Regulations (Composition
of Staff Medical Board to include two medical practitioners who are not
officers), delete “who are not officers,”.

Procedure for handling cases of gross misconduct
3 (1) The Second Schedule to the principal Regulations (procedure
for handling cases of alleged gross misconduct) is amended as follows.

(2) Delete paragraph 3(b) and substitute—

“(b) refer the case to the Head of the Civil Service.”

(3) Delete paragraph 4.

(4) In paragraph 5 delete “Where the Head of the Civil Service
determines to deal with the case himself he shall” and substitute “Where

a case has been referred to the Head of the Civil Service under paragraph
3(b) he shall”.

(5) After paragraph 6 insert—

“6A The Head of the Civil Service shall invite the
officer’s job supervisor and Head of Department, and any other
officers whom he considers relevant to the case, to appear before
him.”

(6) At the end of paragraph 7 add “or dismiss the allegation”.
