The Minister responsible for marine and port services, in
exercise of the powers conferred by section 10(1)(a), (aa) and (b) of the
Marine Board Act 1962, gives the following Notice:

Citation
1 This Notice may be cited as the Marine Board (Control Over
Maritime Traffic) Notice 2009.

Interpretation
2 In this Notice—

“Ferry Reach” means all that area from the airfield landing light
pylons close to the Bermuda Institute of Ocean Sciences
thence westward along the Reach to a line extending from the
north side of the Reach to Little Roque Island thence to the
eastern edge of Roque Island thence south eastwards to
Stone Crusher Corner at Kindley Field Park;

“race” means a closed circuit power boat race held at a time and
on a date referred to in paragraph 3 of this Notice.

Power boat races
3 Power boat closed circuit races may be held between the hours of
11:00 am and 2:00 pm at Ferry Reach on the following dates in 2009 —

(a) January 18;

(b) February 1 and 15;

(c) March 1, 15 and 29;

(d) April 12 and 26;

(e) May 10 and 24.

Patrol of course
4 (1) Ferry Reach shall be patrolled by Marshall boats during the
races.

(2) All mariners, pilots and boatmen shall exercise extreme
caution during the races, especially in approaching and entering Ferry
Reach.

Non-application of speed limits
5 No speed limit referred to in the Schedule to the Marine Offences
Procedure Act 2006 or fixed by paragraphs 2 and 3(1) of the Marine
Board (Declaration of Speed Limits for Boats) (Mariners) Notice 2001
shall apply to persons and boats participating in the races, or practice
races.
