EDUCATION AMENDMENT RULES 2009



The Minister responsible for Education, in exercise of the powers
conferred by section 8 of the Education Act 1996, makes the following
Rules:

Citation
1 These Regulations, which amend the Education Rules 2006 (the
“principal Rules”), may be cited as the Education Amendment Rules
2009.

Amends rule 2
2 Rule 2 of the principal Rules is amended by deleting the
definitions “administrator” and “principal”.

Amends rule 3
3 Rules 3(3) and (4) of the principal Rules are amended by deleting
the words “Chief Education Officer” and replacing them with the words
“Commissioner of Education”.

Amends rule 4
4 Rule 4(1) of the principal Rules is amended by deleting the words
“an administrator” and replacing them with the words “a principal”.

Amends rule 5
5 Rule 5(2) of the principal Rules is amended by deleting the words
“Permanent Secretary” and replacing them with the words
“Commissioner of Education”.

Amends rule 7
6 Rule 7 of the principal Rules is amended—

(a) in the marginal note to the rule and in paragraphs (1) to
(5), by deleting the word “administrator” and replacing it
with the word “principal”, wherever it occurs;

(b) in paragraphs (5)(b), (d), (e) and (f) by deleting the words
“Chief Education Officer” and replacing them with the
words “Commissioner of Education”.

Amends rule 8
7 Rule 8 of the principal Rules is amended—

(a) in paragraphs (1), (2), (3) and (7), by deleting the word
“administrator” and replacing it with the word
“principal”;

(b) in paragraph (4), by deleting the words “Chief Education
Officer” and replacing them with the words
“Commissioner of Education”; and

(c) in paragraph (5), by deleting the words “through the
administrator to the Minister” and replacing them with
the words “to the principal”.

Amends rule 11
9 Rule 11 of the principal Rules is amended—

(a) in paragraph (3), by deleting the word “administrators”
and replacing it with the word “principals”; and

(b) in paragraph (5), by deleting the word “administrator”
and replacing it with the word “principal”.

Amends rule 13
10 Rule 13(2) of the principal Rules is amended by deleting the
words “Chief Education Officer” and replacing them with the words
“Commissioner of Education”.

Amends rule 15
12 Rules 15(1) and (2) of the principal Rules are amended by
deleting the words “Chief Education Officer” and replacing them with the
words “Commissioner of Education”.

Amends rule 16
13 Rule 16(3) of the principal Rules is amended by deleting the
words “Chief Education Officer” and replacing them with the words
“Commissioner of Education”.

Amends rule 18
15 Rule 18(3) of the principal Rules is amended by deleting the
words “Chief Education Officer” and replacing them with the words
“Commissioner of Education”.

Amends rule 21
16 Rule 21 of the principal Rules is amended—

(a) in paragraph (1), by deleting the word “administrator”
and replacing it with the word “principal”; and

(b) in paragraph (2), by deleting the words “administrator
shall notify the Chief Education Officer” and replacing
them with the words “principal shall notify the
Commissioner of Education”.

Amends rule 24
17 Rule 24(4) of the principal Rules is amended by deleting the
words “Chief Education Officer” and replacing them with the words
“Commissioner of Education”.

Amends rule 26
18 Rules 26(1) and (2) of the principal Rules are amended by
deleting the words “Chief Education Officer” and replacing them with the
words “Commissioner of Education and the relevant School Board”.

Amends rule 30
19 Rule 30 of the principal Rules is amended by repealing
paragraph (2).

Amends rule 31
20 Rule 31 of the principal Rules is amended by deleting the words
“Chief Education Officer” in the two places where they occur and
replacing them with the words “Commissioner of Education”.

Amends rule 37
21 Rule 37 of the principal Rules is amended—

(a) in paragraphs (1), (2) and (3), by deleting the words
“Chief Education Officer” and replacing them with the
words “Commissioner of Education”; and

(b) in paragraph (2), by deleting the word “administrator”
and replacing it with the word “principal”.

Amends rule 38
22 Rules 38(1) and (2) of the principal Rules are amended by
deleting the word “administrator” and replacing it with the word
“principal”.

Amends rule 39
23 Rule 39 of the principal Rules is amended—

(a) in paragraph (1), by deleting the word “administrator”
and replacing it with the word “principal”; and

(b) in paragraph (2), by deleting the words “Chief Education
Officer” and replacing them with the words
“Commissioner of Education”.

Amends rule 40
24 Rule 40 of the principal Rules is amended by deleting the word
“administrator” and replacing it with the word “principal”, and by
deleting the words “Chief Education Officer” in the two places where they
occur and replacing them with the words “Commissioner of Education”.
