DEVELOPMENT AND PLANNING (DRAFT BERMUDA PLAN

2008 EXTENSION) ACT 2009

Assent Date: 6 December 2009

Operative Date: 6 December 2009

WHEREAS it is provided by section 10 of the Development and

Planning Act 1974 (“the Act”)—

(a) that the Minister may by notice published in the Gazette,

prior to the approval of a development plan by the

Legislature under the Act, declare a draft development

plan to be operative as a development plan from such

date as may be specified in the notice and until that

approval is obtained; but

(b) that, if that approval is not obtained within eighteen

months of the publication of such a notice, a draft

development plan so published shall cease to be so

operative;

AND WHEREAS the Minister of the Environment and Sports, by

notice published in the Gazette on 30 May 2008 under section 10 of the

Act, declared the Draft Bermuda Plan 2008 to be operative from 6 June

2008;

AND WHEREAS it is expedient that the operation of the Draft

Bermuda Plan 2008 should be extended beyond the period of eighteen

months, notwithstanding the restriction in that behalf imposed by

section 10 of the Act;

Be it enacted by The Queen's Most Excellent Majesty, by and

with the advice and consent of the Senate and the House of Assembly of

Bermuda, and by the authority of the same, as follows:

Short Title

1 This Act may be cited as the Development and Planning (Draft

Bermuda Plan 2008 Extension) Act 2009.

Extension of operation of Draft Bermuda Plan 2008

2 Notwithstanding the proviso to section 10(1) of the Development

and Planning Act 1974, the Draft Bermuda Plan 2008 shall continue to

be operative under that section as a development plan until 30 June

2010.
