BERMUDA HOSPITALS BOARD AMENDMENT ACT 2008

WHEREAS it is expedient to amend the Bermuda Hospitals
Board Act 1970:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act, which amends the Bermuda Hospitals Board Act 1970
(hereinafter referred to as the "principal Act"), may be cited as the
Bermuda Hospitals Board Amendment Act 2008.

Amends section 1
2 Section 1 of the principal Act is amended by repealing the
definition of “Executive Director” and replacing it with the following —

“Chief Executive Officer” means the person appointed to be Chief
Executive Officer under section 7;”.

Amends section 4
3 Section 4 of the principal Act is amended —

(a) in subsection (1)(c) —

(i) by deleting “five” and substituting “seven”;

(ii) by deleting “sixteen”, and substituting “ten”; and

(b) by inserting the following new subsection after
subsection (2)—

“(2A) The term of office of appointed members shall be
such as to ensure, so far as possible, the expiration in
any such year of not more than one half of the terms of
office of those members.”.

Amends section 5
4 Section 5(4) of the principal Act is amended by deleting “six” and
substituting “four”.

Amends section 7
5 Section 7 of the principal Act is amended —

(a) in the Heading, by deleting “Executive Director” and
substituting “Chief Executive Officer”;

(b) in subsection (1), by deleting “Executive Director” and
substituting “Chief Executive Officer”;

(c) in subsection (2)(b), by deleting “Executive Director” and
substituting “Chief Executive Officer”;

Amends section 8
6 Section 8(4) of the principal Act is amended by inserting after the
word “Board” where it first appears, the words “through the Chief
Executive Officer”.

Amends section 26
7 Section 26(3)(b) of the principal Act is amended by deleting
“Executive Director” and substituting “Chief Executive Officer”.

Consequential Amendment
8 The Bermuda Hospitals Board (Medical Staff) Regulations 1996
are amended by deleting the words “Executive Director” wherever they
appear and substituting the words “Chief Executive Officer”.
