The Minister responsible for Tourism, in exercise of the powers
conferred by section 14 of the Hotels (Licensing and Control) Act 1969,
makes the following Regulations:

Short title
1 These Regulations, which amend the Hotels (Licencing and
Control) Regulations 1976 (the “principal Regulations”), may be cited as
the Hotels (Licensing and Control) Amendment Regulations 2007.

Amends Regulation 2
2 Regulation 2 of the principal Regulations is repealed.

Amends Regulation 6
3 Regulation 6 of the principal Regulations is amended—

(a) by deleting the word “firm” and substituting the word
“fire”;

(b) by adding next after the word “facilities” the words “,
including a hard-wire smoke detection system or any
other system approved by the Chief Fire Officer,”; and

(c) by adding next after the word “therefrom” the words
“and the fire alarm facilities shall be in accordance with
the life safety code of the Fire Services Department”.

Inserts Regulations 19A to 19E
4 The principal Regulations are amended by inserting after
Regulation 19 the following Regulations—

“Swimming pools and whirlpools
19A Every swimming pool and whirlpool of a hotel shall be
operated and maintained in a safe and sanitary manner and
shall have a water disinfection system that is approved by the
Chief Medical Officer.

Life saving and first aid at swimming pools and private
beaches
19B (1) Every operator shall provide and maintain at every
swimming pool and private beach belonging to the hotel such life
saving apparatus or equipment and first aid supplies as the
Director may specify in writing.

(2) No person shall wilfully or negligently remove or
interfere with any life saving apparatus or equipment or first aid
supplies provided under paragraph (1).

Warning signs at swimming pools and private beaches
19C Every operator shall cause one or more notices or signs to
be displayed in a conspicuous place near any private beach
belonging to the hotel, warning bathers of the potential risk of
unseen currents and undertow and of the dangers of swimming
in poor weather conditions.

Water Supply
19D (1) Every water supply used for drinking, food
preparation and hygiene shall—

(a) be obtained from a source approved by the Chief
Medical Officer and comply with the Department of
Health potable water quality guidelines;

(b) undergo continuous disinfection by a method
approved by the Chief Medical Officer; and

(c) be monitored and analyzed at a frequency to be
determined by the Chief Medical Officer.

(2) There shall be no cross connection between the water
supply mentioned in paragraph (1) and non-potable water
sources.

Restrictions on use of gray water and reclaimed water
19E (1) Treated gray water or reclaimed water shall only be
used for flushing and irrigation if—

(a) the water undergoes continuous disinfection by a
method approved the Chief Medical Officer;

(b) the water complies with the Department of Health
bacteriological guidelines for gray and reclaimed
waters;

(c) the flushing water is coloured using a non-toxic dye
to distinguish it from other sources of water; and

(d) the water is monitored and analyzed at a frequency to
be determined by the Chief Medical Officer.

(2) In this section,

“gray water” means waste discharged from lavatories, bathtubs,
showers, clothes washers or laundry trays; and

“reclaimed water” means domestic wastewater that has received
secondary treatment by a wastewater treatment works.”.

Amends Regulation 24
5 Regulation 24 of the principal Regulations is amended by
repealing paragraph (2).

Amends Regulation 34
6 Regulation 34 of the principal Regulations is amended by
deleting the words “or venetian blinds” in paragraph (e) and substituting
the words “or any other window treatment”.
