TRAFFIC OFFENCES PROCEDURE AMENDMENT ACT 2006

WHEREAS it is expedient to enact the Traffic Offences Procedure

Act 1974:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act, which amends the Traffic Offences Procedure Act 1974
(the “principal Act”), may be cited as the Traffic Offences Procedure
Amendment Act 2006.

Inserts new section 1A
2 The principal Act is amended by inserting next after the heading
“PART II TICKET SUMMONS PROCEDURE” the following section —

“Interpretation of Part II
1A In this Part —

“police officer” and “officer” include a traffic officer and a
traffic warden;

“traffic officer” means a person appointed as a traffic
officer under section 7 of the Motor Car Act 1951;

“traffic warden” means a person appointed as a traffic
warden under section 29 of the Road Traffic Act
1947.”.

Amends section 10
3 Section 10 of the principal Act is amended —

(a) by inserting in the definition “police officer”, next after
the word “includes”, the words “a traffic officer and”; and

(b) by inserting next after the definition “registered owner”
the following definition —

“ “traffic officer” means a person appointed as a traffic
officer under section 7 of the Motor Car Act 1951;”
