COMMISSION FOR UNITY AND RACIAL EQUALITY
AMENDMENT ACT 2005

WHEREAS it is expedient to amend the Commission for Unity
and Racial Equality Act 1994:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act, which amends the Commission for Unity and Racial
Equality Act 1994 (the "principal Act"), may be cited as the Commission
for Unity and Racial Equality Amendment Act 2005.

Amends section 3
2 Section 3 of the principal Act is amended by repealing
subsection (7) and substituting the following subsection ⎯

"(7) The quorum at a meeting of the Commission shall be fifty
per cent plus one of the Commissioners serving at the time.".

Substitutes section 6A
3 Section 6A of the principal Act is repealed and the following
sections are substituted ⎯

"Request for information from Department of Statistics
6A (1) The Commission may, in writing, request from the Chief
Statistician any information or data it requires to discharge its
functions.

(2) The Chief Statistician shall comply with a request made
under subsection (1) where he is satisfied that the information
requested by the Commission ⎯

(a) is information that the Commission reasonably
requires to discharge its functions under this Act;
and

(b) is not contrary to any provision of the Statistics Act
2002.

(3) The information or data supplied by the Chief
Statistician under subsection (2) shall, subject to the Statistics
Act 2002, be in such form or classification as may be specified in
the request made under subsection (1).

Register of employers
6AA The Commission shall establish and maintain in such form
as it considers appropriate, a register of employers from the
information or data received from the Department of Statistics.".

Amends section 6C
4 Section 6C of the principal Act is amended by repealing
subsections (1) and (2) and substituting the following subsections ⎯

"(1) The Commission may in addition to whatever information is
supplied by the Department of Statistics, on giving reasonable
notice, require employers to furnish such information about
employees and applicants for employment as the Commission
may reasonably require to discharge its functions under this Act.

(2) Every employer required by the Commission to furnish it
with information under subsection (1), shall furnish such
information in such form and within such period as the
Commission may specify.".

Amends section 6D
5 Section 6D of the principal Act is amended —

(a) by repealing subsection (1); and

(b) by repealing subsection (2) and substituting the
following subsection—

"(2)An employer who —

(a) without reasonable excuse, fails to furnish
information required under section 6C; or

(b) knowingly provides false information,

commits an offence and is liable on conviction by a court
of summary jurisdiction to a fine not exceeding
$5,000.00.".

Revocation
6 The Commission for Unity and Racial Equality (Registration and
Returns) Regulations 2000 are revoked.
