The Minister of Transport, in exercise of the powers conferred by
section 59(1)(a) and (b) of the Merchant Shipping Act 2002, makes the
following regulations:

Citation
1 These Regulations may be cited as the Merchant Shipping
(Ships' Doctors) Regulations 2004.

Interpretation
2 In these Regulations —

"owner" in relation to a ship means the registered owner of the
ship unless that ship has been chartered by demise or is
managed, either wholly or in part, by a person other than the
registered owner under the terms of a management
agreement; in that case "owner" includes the demise
charterer or person managing the ship, as the case may be;

"qualified doctor" means a medical practitioner registered to
practice medicine in the countries listed in the Schedule to
these regulations.

Carriage of qualified doctor
3 The owner of a Bermuda ship having more than one hundred
persons on board and engaged on an international voyage of more than
three days or on a voyage which is more than one and a half day's sailing
time from a port with adequate medical equipment, shall carry a
qualified doctor.

Exemption
4 Notwithstanding regulation 3, the Minister may grant exemption
from all or any of the provisions of these regulations (as may be specified
in the exemption) for classes of cases or individual cases on such terms
as he may so specify and may, subject to giving reasonable notice, alter
or cancel any such exemption.

Offences
5 (1) A person who contravenes regulation 3 commits an offence is
liable on summary conviction to a fine not exceeding $10,000.00.

(2) It shall be a defence for a person charged under this
regulation to show that he took all reasonable precautions and exercised
due diligence to avoid the commission of the offence.

Revocation
6 The Merchant Shipping (Ships’ Doctors) Regulations 1986 are
revoked.
